RESOLUTION TO TRANSFER THE BUTTE COUNTY VICTIM/WITNESS ASSISTANCE CENTER FROM
THE BUTTE COUNTY PROBATION DEPARTMENT TO THE BUTTE COUNTY DISTRICT ATTORNEY
WHEREAS, the County of Butte desires to continue to undertake and operate the Butte County Victim/Witness
Assistance Center, funded in part, from funds made available through the California Victim/Witness Assistance Fund,
administered by the California Emergency Management Agency (Cal EMAy, with said continued operation to be
undertaken by the Butte County District Attorney; and
WHEREA5, due to changes in state statutes, specifically Marsy's Law, it is more efficient and effective to have the District
Attorney take over fiscal, staffing and operational management of the Butte County Victim/Witness Assistance Center.
NOW, THEREFORE, BE IT RESOLVED, that control and operation of the Butte County Victim/Witness Assistance Center
be transferred from the Butte County Chief Probation Officer to the Butte County District Attorney, effective January 1,
20L2.
BE IT FURTHER RESOLVED, pursuant to California Penai Code Section I3835.2(ay(2) the Butte County Board of
Supervisors recognizes the Butte County District Attorney Victim/Witness Assistance Center as the major provider of
comprehensive services to victims and witnesses in the county.
FURTHER RESOLVED, pursuant to California Penal Code Section 13835.2(a)(3) the Butte County Board of Supervisors
selects the Butte County District Attorney Victim/Witness Assistance Center as the agency to receive funds pursuant to
this article.
FURTHER RESOLVED, that the District Attorney is authorized to execute on behalf of the Board of Supervisors, revisions,
extensions, or amendments to any current grant award agreements and to return to the Board for future applications
and grant award agreements.
PASSED, APPROVED, AND ADOPTED by the Butte County Board of Supervisors this 13th day of December 2011 by the
following vote:
AYES: Supervisors Gonneliy, Wahl, Kirk, Yamaguchi and Chair Lambert
NOES: None
ABSENT: None
NOT VOTING: None
