HomeMy WebLinkAbout1125ORDINANCE NO. 1125 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-R" (AGRICULTURAL- RESIDENTIAL) DISTRICT, AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS. 7 8 9 10 11 12 13 14 15 16' 17 18 19 20 21 22 23 24 25 26 27 28 29. 30 31 32 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "A-R" (Agricultural-Residential) District and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, and more particularly described as follows: Located North of Chico, California, more particularly described as follows: The easterly 1856.02 feet of Parcel 3 and the easterly 2590.0 feet of Parcel 2'of "Priesing Lands" per map recorded in Map Baok 7 on page 23, said map recorded in the Office of the Recorder, County of Butte, State of California. SECTION 2. REGULATIONS FOR AN "A-R" DISTRICT: The following regulations shall apply in an "A-R" District: 2.1 USES FERPdITTED: a. Single-family dwelling, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. c. Agricultural uses. d. Livestock, subject to requirements as follows: 1) Minimum lot area to be devoted to residential use shall be not less than eight thousand one hundred twenty-five (8,125) square feet. 2) Exclusive of the-area devoted to. the. residential use, the following lot or parcel area shall be required for each animal raised or kept on the premises: a) For each horse or head of cattle over one (1) year of age----eight thousand one hundred twenty-five (8,125) square feet. 1 b) For each head. of swine over ten (10) weeks 2 of age--eight thousand one hundred twenty- 3' five (8,125) square feet. 4 c1 For each head of sheep or goats--two thousand 5 (2,000) square feet. 6 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 7 IN EACH CASE: 8 a. Duplex dwellings and multiple-family dwellings. 9' b. Golf courses, country clubs- if permitted, would 10 permit accessory uses such as driving range, pro 11 shop, cocktail bar, restaurant. 12' c. Public and quasi-public uses including churches, 13 firehouses, hospitals, parks and playgrounds, schools 14' and public utility buildings. 15 d. Commercial poultry farming and livestock farming. 16 e. Veterinary clinics, outpatient. 17 f. Nurseries and plant gardens. 18. 2.3 LOT AREA REQUIRED: 1g Minimum required area of a lot per dwelling unit shall 20 be not less than eight thousand one hundred twenty-five (8,125) 21 Square feet. 22 2.4 LOT WIDTH REQUIRED: 23 Minimum lot width shall not be less than sixty-five (65) 24 feet. 2g 2.5 FRONT YARD REQUIRED: 2g Minimum front yard shall be fifty (50) feet from the center 2q line of the road, except where the road is classified by the County 28' as a Federal Aid Secondary Road, the minimum building setback re- 29 quirement shall be fifty-five (55) feet from the centerline of road 30 2:6 SIDE YARD REQUIREMENT: 31 Minimum side yard shall not be less than five (5) feet. 32 -2- 1 2 3 5 6 7 8 9 Z0 11 12 13 14. 15 16' 17 18 19 20 21' 22 23 24 25 26 27 28 29 30 31 32 SECTION 3. In compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance in full. SECTION 9. The penalties for the violation of the zoning jhereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. This emergency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of alI members voting for and against the same in the Chico FntPr~rfse-Record , a newspaper in general circulation in the County of Butte, State of California.
