HomeMy WebLinkAbout1139ORDINANCE NO. 1139 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUANT TO ORDINANCE N0. 47'5, AS AMENDED, OF SAID COUNTY. 7 8 s 1a 11 12 13 14 15 is 17 18 19 20 21 22'. 23 24 25 26 27 28 29 30 31. 32 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, being the Zoning Enabling Ordinance. of said County, as amended, DOES ORDAIN, as follows: SECTION 1. The hereinafter described area situate in the County of IBUtte, State of California, shall be and it is hereby zoned as an "A-2 Limited" District and subject to all of the restricted uses applicable to the uses of an "A-2 Limited" District, said area so zoned being located in the unincorporated area of Butte County, south of Oroville, more particularly described as follows: Lots 1, 2, and 3 of Block 22 "Villa Verona" per map recorded as Wall Map #12 in the Office of the Recorder, County of Butte, State of California, con- taining 15 acres. SECTION 2. REGULATIONS FOR AN "A-2 LIMITED" DISTRICT: 2.1 The provisions of this classification shall apply to property as described in Section 1. 2.2 USES PERMITTED: The following uses are permitted within all parts of the II District: a. Lawful uses of land now established. b. Single-family dwellings and accessory buildings. c. Agricultural uses and buildings. 2.3 USE PERMITS REQUIRED: No multiple-family dwellings, new commercial buildings, industrial uses of land or buildings, public or quasi-public uses including schools, churches, public utility buildings will be ~lallowed without first securing a use permit approved by the 'Planning Commission. 2.4 MINIMUM SETBACK REQUIRED: Fifty (50) feet from the centerline of the road, except where the road is classified as a Federal Aid Secondary road, then the minimum setback shall be fifty-five (55) feet from the center- line of said road. -1- 1 2,1 3 4' 5 6 7 8 9 10 11 12. 13 14 15 16 17 18 19 2a 21 22- 23: 24 25" 26 27. 28 29 30 31 32 2.5 BUIi,DING SITE AREA REQUIREMENT: Each single-family residence shall be located on a site 'not less than eight thousand, one hundred and twenty-five (8,125) square feet. 2.6 SIDE YARD REQUIREMENTS: The minimum side yard shall not be less than five (5).-feet. 2.7 REAR YARD REQUIREM~;NTS: The minimum rear yard shall not be less than five (5) feet. 2,8 OFF-STREET PARTING REQUIREMENT: 1. Residential uses:' a. Single family dwellings; two (2) spaces per dwelling. b. Multiple family dwellings; two (2) spaces per dwelling unit. c. Boarding::houses;'oneEl):~:~space per guest room. d. Motels; one (1) space per sleeping unit or dwelling unit. e. hotels; one (1) space per bedroom. f. Fraternities, sororities and dormitories devoted to housing students; to be determined by the Planning Department based on the circumstances ~~ of each case; however in no case shall there be -- less than one and one--half (12) spaces per each 100 square feet of sleeping area. 6+lhere the total required area includes a fraction, the next highest whole unit shall be provided. 2. Institutional uses: a. Hospitals and other similar uses involving over- night care or treatment; one(1) space per each three (3) beds set aside for such care or treat- ment. b, Elementary and Junior High Schools; one (1) space for each employee and each faculty member. -2- i 1 c. High Schools; one (1) space for each twenty E20) 2 students and one (1) space for each faculty 3 member. 4 d. Junior Colleges, Colleges and Universities; one 5 (].) space far each ten (10) students and one (1) 6 space for each faculty member and employee. 7 3. other Uses: 8 a. Public or private permitted uses incorporating 9 indoor or outdoor assembly ar spectator areas, Z0 such as churches, mortuaties, lodge buildings, 11' clubhouses, auditoriums, theatres, stadiums, 12 arenas; one (1) space per each four fixed seats 13 in the assembly or spectator area, plus one (1) 14 space per each eight (8) feet of fixed bench 15 length in the assembly or spectator area, plus 16 one (1) space for each twenty-eight (28) square 17 feet of assembly or spectator area in which no lg fixed seats or benches are maintained. lg b. Passenger terminals; one (1) space per each 20 gross hundred (100) square feet of waiting room 21 area. 22 The definition of "parking space", as it appears in para- 23 graph 25, of Ordinance No. 1002, shall apply to this section, pro- 24 vided that, in the case of any of the uses described in 3, above, 2g the required parking space may be located off the use site and 2g within a walking distance of three hundred (300) feet therefrom. 27 Any proposed use which falls into more than one of the 28 above categories shall be subject to the greater of the applicable 29 off-street parking requirements. In addition, the Planning Commis- 30 Sion may require additional off-street parking for any such use, 31 the total amount so required not to exceed the combined total of 32 each separately applicable requirement. - 3- 1 2.9 TRUCK LOADING AND UNLOADING SPACE: 2 Private off-street loading space for the handling of all g goods, materials and equipment shall be provided. Such space 4 shall be of sufficient area and of such design as to permit the 5 parking and unloading of vehicles without extending into any g existing street beyond the curb line. 7 SECTION 3. A11 uses of land within the District not $ specifically authorized and permitted under Section 2 are prohibite 9 SECTION 4. Penalties for any violation of the zoning here- 10, by imposed within the District shall be as provided in the Zoning 11 Enabling Ordinance, and in compliance with the provisions of the 12 Zoning Enabling Ordinance this Ordinance shall from and after its 13 effective date become a supplement to and part of the Zoning 14- Enabling Ordinance. 15 SECTION 5. In compliance with the provisions of said 16 Zoning Enabling Ordinance, the same is hereby amended by adding 17 this ordinance in full. 18 SECTION 6. This ordinance shall be and is hereby declared 19 to be in full force and effect from and after thirty (30) days 20 after the date of its passage, and before the expiration of fifteen 21 {15} days after its passage this Ordinance shall be published 22 once with the names of the members voting for and against it in the 23 Oroville Mercury-Register a newspaper published in 24 the County of Butte, State of California. 25 PASSED AND ADOPTED by the Board of Supervisors of the Count 26! of Butte, State of California, this 19$hday of January , 27 1971, by the following vote: 2g AYES: Supervisors Gilman, Madigan, Maxon, McBillop, and Chairman Reynolds 29 NOES: Nene 30 ABSENT: None ~ ~ ~ ~E E.
