AN ORDINANCE AMENDING BUTTE COUNTY CODE SECTIONS
2-72 RELATING TO MEETINGS AND ACTIONS OF THE BUTTE
COUNTY PLANNING COMMISSION AND 2-40 RELATING TO
ZONING ENFORCEMENT AND AMENDING SECTION 13.5 OF
ORDTNANCE N0. 475 RELATING TO APPEALS FROM PLANNING
COMMISSION ACTIONS.

California do ordain as follows:
Section 1. Section 2-72 of the Butte County Code is amended
Ito read as follows:
Section 2-72.Meetings and Actions,
The planning commission shall hold at least one regular
meeting each month, A majority of the members of the
commission constitute a quorum for the transaction of
business. No act of the commission shall be valid or
binding unless a majority of all the members concur therein,
provided that a tie vote shall be deemed to be a denial of
the relief applied for,
Section 2. Section 2-40 of the Butte County Code is amended
read as follows:
Section 2-40, Duties of Department.
The duties to be perfarmed by the department of public
works shall be as follows:
(a) Supervise, prepare, or obtain designs and plans
for roads, bridges and county buildings;
(b) Handle all technical matters pertainirg to
subdivisions;
(c) Perform surveying and mapping;
(d) Inspect county roads, bridges and buildings;
(e} Issue bu~7d.ing permits;
(f) Construct and maintain, and contract for the
construction, and maintenance of roads, bridges and
drainage;
(g) Do all things pertaining to county dumps;
(h) Do all things pertaining to county ferries;
(i) Assist in all matters pertaining to wafter
development and control;
(j) Perform the duties of the road department as
defined by law.
Section 3, Section 13.5 of Ordinance No, 475, as amended by
Ordinance No. 1044 is amended to read as follows:
"13.5. The determination of the Planning Commission shall
be final unless a written appeal is filed with the Clerk
of the. Board of Supervisors by 5:00 p,m, on the eighth
calendar day following the date of the determination,

provided that if said eigh~- day falls on a legal holiday,
the appeal may be filed by 5:00 pom. on the nex't'.:day ~n
which the office of the Clerk is open for business. The
Clerk shall immediately forward a copy of said appeal to
the Planning Commission. No use permit may be issued until
said time for appeal has expired, nor may such permit be
issued in the event an appeal is filed until the Board
of Supervisors act on said appeal, '.:Within~~ten~ dayrss::of ;the-
date of the filing of an appeal, the Board of Supervisors
shall set a date fora hearing. Said hearing shall be
advertised and noticed pursuant to Government Code Section
65905. The Board of Supervisors shall decide such
appeals on the grounds set out in Section 13.4 above.
The Board hearing shall be conducted de novo provided that
all applications, papers, maps, exhibits and-staff
recommenda~5°__~- made or presented to the Planning
Commission may be considered by the Board. The decision of
the Board shall be final and not subject to review except
by a court of competent jurisdictions
Section 4. Operative:Dateo This Ordinance shall become
operative at the expiration of thirty (30) days from and after its
passage.
Section 5, Publicationo Before the expiration of fifteen (15)
days from and after its passage, this Ordinance shall be published
at least once in Oroville Mernury , a newspaper of general
circulation, printed and published in the County of Butte, together
with the names. of the members of the Board of Supervisors of the
county of $utte voting for and against the same.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California, this 13th day of July , 1971, by
the following vote, to wit:
