HomeMy WebLinkAbout1186ORDINANCE N0. 118 AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ZONING A PORTION OF SAID COUNTY AS AN "S-2" (MEDIUM-DENSITY SUBURBAN RESIDENTIAL) DISTRICT 1 PURSUANT TO ORDINANCE N0. 475, AS AMENDED 2 3 The Board of Supervisors of the County of Butte, State 4 of California, under and pursuant to Ordinance No. 475 of said 5 County, being the Zoning Enabling Ordinance as amended, DOES ORDAIN g as follows: 7' SECTION 1. The hereinafter described area situate in the g County of Butte, State of California, shall be and it is hereby 9 zoned as an "S-2" (Medium-Density Suburban Residential) District lo' and such area shall be subject to the restrictions and restricted 11 uses and regulations hereinafter specified and provided. Said 12; area so zoned being located near•Oroville.in the unincorporated are 13 of Butte County, California, and particularly described as follows: 14 All that part of the south half of the southwest quarter lying 5auth of Forbestown Road (8UT 759-4) 15 and the west 216 ft. of the southeast quarter of the southwest quarter lying north of Forbestown Road 16 (BUT 759-4); 17 Containing 43 acres, more or less. 1g; SECTION 2. Regulations for an "S-Z" District. The 19 following regulations shall apply in an "S-2" District: 20' 2.1 USES PERMITTED: 21 a. Single-family dwellings, not including tents or 22 mobile homes. 23 b. Accessory buildings pertinent to the permitted uses. 241 2.2 Agricultural uses, except livestock, subject to 25 the following requirements: 26 a. For each horse or head of cattle over one year of age, eight thousand one hundred twenty-five (8,125) sq. ft. 1 b. For each head of swine over ten (10) weeks of age, 2 eight thousand one hundred twenty-five (8,125) sq. ft. 3 c. For each head of sheep or goats, two thousand (2,000) ~ sq. ft. ~ 2.3 LOT AREA: Minimum required area of a lot per dwelling g unit shall be not less than one (1) acre. 7 2.4 LOT WIDTH: Minimum lot width shall be not less than g one hundred thirty (130} feet. g 2.5 FRONT YARD: Minimum front yard shall be fifty (50) lp! feet from the centerline of the road except where the road is 1.1 classified by the County as a Federal Aid Secandary Road, the 12 minimum building setback requirement shall be fiftyWfive (55} ~3' feet from the centerline of said road. 1~ 2.6 SIDE YARD: Minimum side yard shall be not ]ess than 15 ten (10) feet. 16 SECTION 3. The following uses subject to securing a 17 use permit in each case: lg' a. Public and quasi-public uses, including churches. 19 b. Hospitals, parks and playgrounds, schools and public 20, utility buildings. Z1' SECTION 4. All uses of land within the district not 22 specifically authorized and permitted in Sectians 2 and 3 are 2g prohibited. 2~ SECTION 5. In compliance with the provisions of said 2g Zoning Enabling Ordinance, the same is hereby amended by adding 26 to Section 5 thereof this Ordinance in .full. -2- l SECTION S. The penalties for the violation of the zoning 2 hereby imposed within the district shall be as provided in the 3 Zoning Enabling Ordinance. In compliance with the provisions of 4' the Zoning Enabling Ordinance, this Ordinance shall from and after 5' its effective date become a supplement to and part of the Zoning 6"" Enabling Ordinance. 7' SECTION 7.
