The Board of Supervisors of the County of Butte9 State of
California, DO ORDAIN as follows:
Section lP Section 2041 of the Butte County Code is
amended to read as follows:
Sec. 20-41P Illegally Created Parcels.
AP Subject to B., below, no building, septic tank
or other land use permit of any type shall be issued by any
department, board or commission for any parcel created in
violation of any provision of this chapter except with the approva
of the board of supervisors. The board of supervisors, after
receiving a written request from the applicant, directed to the
clerk of the board, may authorize issuance of any such permit
subject to any requirements which are necessary, in the opinion
of the board, for the preservation of the health, safety and
welfare of the general neighborhood and of the citizens of the
County of Butte, provided that such requirements do not exceed
those which could be imposed under any statute or ordinance
regulating land division at the time of application for said
permitP
B. No building, septic tank, or other land use permit
of any type shall be issued by any departments board or commission
for any parcel created between October 4, 195b and June 27, 1963
in violation of ordinance No, 557 unless the person awning said
parcel,at the time of application for such permit, either:

3 2, Executes an affidavit showing that as of the
~ date he acquired ownership, said owner was unaware
~ that said parcel was created in violation of ordinance
6 Noo 5570 Each owner of record as of the date of
q said application shall execute such an affidavit.
g "Owner'" shall include a person holding an option to
g'' purchase or a purchaser under a contract of sale,
1p' Any permits issued pursuant to such an affidavit
11 shall be limited to one single family dwelling unit,
12 together with accessory structures for each such
13 parcel,
14 C, An applicant under A, or B, above shall be
15 deemed to be a "subdivider{~ for the purpose of appealling any
16 decision pursuant to Section 20-39 above,
17 That this Ordinance shall take effect thirty (30) days
lg after the date of its adoption, and before the expiration of
19 fifteen (15) days after its passage, it shall be published with
2p the names of the members voting for and against same, once
21; in a newspaper published in the County of Butte, State of
22 California.
