HomeMy WebLinkAbout11931 2' 3- 4 5 6 7 8 9 ld: 1.1 12 13 i4 15. i6 1'7 18 19 20 21 22 23! 24 25 28 ORDINANCE N0. 1193 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE AN "R-1" (SINGLE-FAMILY RESIDENTIAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "R-1" (Single-Family Residential) District, and such area shall be subject t6 the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County in Paradise, California, being a portion of the northwest quarter of Section 22, T22N R3E, MDB&M; generally described as located south of Honey Run Road and east of Little Grand Canyon Road; particularly described as: Assessor's Parcel Numbers 52-182-53; 52-182-54; 52-182-55; 52-182-57; 52-182-59; and 52-182-60, as shown on maps on file and of record in the office of the Butte County Assessor, State of California on the first Monday of March 1971. SECTION 2. The following regulations shall apply in an "R-1" (Single-Family Residential) District: 2.1 USES PERMITTED a. Single-family dwellings, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. c. Minimum required area of a lot per dwelling unit sha11 be no less than eight thousand one hundred twenty-five (8,125} square feet. 2.3 LOT WIDTH: a. Minimum lot width shall not be less than sixty-five (b5) feet. 2.4 FRONT YARD: a. hlinimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road the minimum building setback requirements shall be fifty-five (55) feet from the centerline of said road. 2.5 SIDE YARDS: a. Minimum side yard shall not be less than five (5) feet. 2.6 The following uses subject to securing a use permit in each case: a. Golf courses and country clubs. b. Public and quasi-public uses ine7uding churches, firehouses, hospitals, parks, playgrounds, schools and public utility buildings. SECTION 3. All uses of land within the district not specifically authorized and permitted in Section 2 are prohibited. SECTION 4. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in 2. 1' 2 3 4 5 6 T 8 9 10 11 12 13' 14 15. 16 17 18 19. 20 21 22 23 24 2:i 26 Section 15 of Ordinance No. 475. In compliance with the provision: of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen {15) days after its passage shall be published once with the names of all members voting for and against the same in the Paradise Post a newspaper in general circula- tion in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. The existing A-2 Limited zone permits uses which may be incompatible with the developed single family dwelling nature of the subject area. 2. The planning commission will soon be considering a petition requesting rezoning of the subject area to R-1. 3. This urgency ordinance is necessary to preserve the public health, safety and welfare in the subject area until said rezoning to R-i is decided.
