HomeMy WebLinkAbout1194ORDINANCE N0. 1194 AN INTERIPI ORDINANCE ZONING A PORTIOPJ OF THE COUNTY OF BUTTE AN "S-1" (MEDIUM DENSITY SUBURBAfV RESIDENTIAL) DISTRICT, PURSUANT TO ORDINANCE N0. 476, AS AMENDED. The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the 7 8 9 10 11. 12 13 14 15 16 17 18 19 ~, 20 21 22 23 24 25 26 County of Butte, State of California, shall be and it is hereby zoned as an "S-1" (Medium Density Suburban Residential) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area sa zoned being located in the unincorporated area of Butte County near Chico, California, more particularly described as follows: All that property located east of the existing "A-3" District and west of the following described line: beginning at the intersection of Glenwood Road and the southwesterly line of Lot 2 of "Bidwell 2nd S.ub"; per map recorded in Map Book 5 on page 27; thence southeasterly along the southwesterly line of Lots 72, 73, 74, 75, 76, 77, 78, 79 and 80 .to the southwest corner of Lat 81; thence S77°35'E, 279.37 ft.; thence south i25 ft. to Sacramento Ave.; thence east along Sacramento Ave. to Oak Lawn Ave.; thence south along Oak Lawn Ave. to the north line of"Oak Lawn Manor Sub"; per map recorded in Map Book 17 on page 37; thence east along the north line of said "Oak Lawn Manor Sub" to the west line of Lot $ of said "Bidwell 2nd Sub"; thence south along the west line of said Lot 8 to the southwest corner of said Lot 8; also being the northwest corner of Lot 9, said "Bidwell 2nd Sub"; thence east to the northeast corner of said Lot 9; thence south 503 ft.; thence west 92.5 ft.; thence south 209 ft.; thence east 78.5 ft.; thence south 274.9 ft, to Stewart Avenue; thence south along Stewart Avenue and the southerly prolongation of Stewart Avenue to Big Chico Creek; thence easterly along Big Chico Creek, to the northeast corner of Lot 3 of"Oak Manor", per map recorded in Map Book 34 on page 45; thence southwesterly to the southeast corner of 6 7! 8 9 10 11 12. 13 14 15 16 17 18' 19 20 21 22 23. 24, 25 26 said "Oak P~anor°`; thence southerly across Oak Park Avenue to the northeast corner of Lot 9 of "Morehead Ranch Sub No. 1";.per map recorded in Map Book 9 on page 14; thence southerly along the east line of Lot 9, Lot 12 and Lot' 19 to the north line of Lat 21, said "Morehead Ranch Sub No. 1"; thence continuing south on the southerly prolongation of said Lot 19 to Chico River Road; thence west along Chico River Road to the northeast corner of Lot 19 of "Mary E. O'Conner Sub", per map recorded in Map Book 8 an page 19; thence southwesterly along the east line of said "Mary E. O'Conner Sub" to Little Chico Creek; all maps recorded in the office of the Recorder, County of Butte, State of California. Excepting therefrom Assessor`s Parcel Numbers 42-19-34 (Shultz~Use Permit), 43-26-03 and 43-29-72 (Vistec Inc. "PA-C"), and 42-19-19 (Friel), as shown on maps on file and of record in the office of the Butte County Assessor, State of California on the first Monday of March 1971. SECTION 2. REGULATIONS FOR AN "S-1" DISTRFCT. The following regulations sha71 apply in an "S-1" District: 2.1 USES PERMITTED: a. Single family dwellings, not including tents or mobile homes. b. Accessory buildings pertinent to the permitted uses. 2.2 Agricultural uses, except livestock, subject to the following requirements: a. For each horse or head of cattle over one year of age, one (1) acre. b. For each head of sheep or goats, one (1) acre for the first head and one•half (Z} acre for each head thereafter. c. For each head of swine over ten weeks of age, one (1) acre. 2. 10 11 12' 13' 14 15 16 17 18 19 20 21 22 23 24 25 26 2.3 LOT AREA: Minimum required area of a lot per dwelling unit shall not be less than eight thousand, one hundred twenty-five (8,125) square feet. 2.4 LOT WIDTH: Minimum lot width shall not be less than sixty-five (65:) feet. 2.5 FRONT YARD: Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setbaclt requirement shall be fifty-five (55) feet from the centerline of said road. 2.6 SIDE YARD: P4inimum side yards shall not be less than five (5) feet. SECTION 3. The following uses subject to securing a use permit in each case: a. Public and quasi-public uses, including churches. b. Hospitals, parks and playgrounds, schools and public utility buildings. SECTION 4. All uses of land within the district not specifically authorized and permitted in Sections 2 and 3 are prohibited. ' SECTION 5. The penalties for the violation of the zoning hereby imposed within the district sha71 be as provided in Section 15 of Ordinance No. 475. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. 3. 6 7 8 9 10 11 12 13 14 15' 16 17 18 19 20. 21' 22 23I 24 2S 26 SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen {15) days after its passage shall be published once with the names of all members voting for and against the same in the Chico Enterprise-Record a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. The existing A-2 Limited Zone permits uses which may be incompatible with the developed single family dwelling nature of the subject area. 2. The planning commission will soon be considering a petition requesting rezoning of the subject area into zoning districts more restrictive than the existing districts. 3. This urgency ordinance is necessary to preserve the public health, safety and welfare in the subject area until said rezoning to S-1 is decided.
