HomeMy WebLinkAbout1195it ORDINANCE N0. 195 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-2 LIMITED" DISTRICT, PURSUANT Tp ORDINANCE N0. 475, AS AMENDED. 2 '3 4' The Board of Supervisors of the County of Butte, State of 5' California, under and pursuant to Ordinance No. 475, being the 6 Zoning Enabling Ordinance of said County, as amended, DOES ORDAIN 7 AS FOLLOWS: $' SECTION 1. 9` The hereinafter described area situate in the County of 10', Butte, State of Califarnia, shall be and it is hereby zoned as an 11 "A-2 Limited" District and subject to all of the restricted uses 12' applicable to the uses of an "A-2 Limited" District, said area sn 13' zoned being located in the unincorporated area of Butte Caunty, 14. in Paradise, more particularly described as follows: 15 All that property previously zoned a "S-H" (Scenic Highway) District by Butte County Ordinance No. 913 lying on each 16 side and within three hundred and fifty (350) feet from the centerline of Clark Road, from the southerly Paradise 17' Irrigation District Boundary to the northerly-most Paradise Irrigation District Boundary. 18 SECTION 2. REGULATIONS FOR l#N "A-2 LIMITED" DISTRICT: 19 2.1 The provisions of this classification shall apply to 20 property as described in Section 1. 21 2.2 USES PERMITTED: 22 The following uses are permitted within all parts of the 23 District: 24 a. Lawful uses of land now established. 2~. b. Single-family dwellings and accessory buildings. 26 c. Agricultural uses and buildings: -1- l 2 3 4 5, 6 7 gi 9' 10 11' 12. 13 14 15 16 1'7 18 19 20 21 22 23 24' 2S ' 26 2.3 USE PERMITS REQUIRED: No multiple-family dwellings, new commercial buildings, industrical uses of land or buildings, public or quasi-public uses including schools, churches, public utility buildings caill be allowed without first securing a use permit approved by the Planning Commission. 2.4 MINIMUM SETBACK REQUIRED: Fifty (50) feet from the centerline of the road, except where the road is classified as a Federal Aid Secondary road, then the minimum setback shall be fifty-five (55) feet from the center- line of said road. 2.5 BUILDING SITE AREA REQUIREMENT: Each single-family residence shall be located on a site not less than eight thousand, one hundred and twenty-five (8,125) square feet. 2.6 SIDE YARD REQUIREMENTS: The minimum side yard shall not be less than five (5) feet. 2. 7 REAR YARD REQUIREMENTS The minimum rear yard shall not be less than five (5) feet. 2.8 OFF-STREET PARKING REQUIREMENT: 1. Residential uses: a. Single family dwellings; two (2) spaces per dwelling. b. Motels; one (1) space per sleeging unit or dwelling unit. e. Hotels; one {1) space per bedroom. f. Fraternities, sororities and dormitories devoted to housing students; to be determined by the Planning Department based on the circumstances of each case; however in no case shall there be less than one and one-half (1?~) spaces per each 100 square feet of sleeping area. Where the total required area includes a fraction, the next highest whole unit shall be provided. 2. Institutional uses: a. Hospitals and other similar uses involving over- night care or treatment; one (1) space per each three (3) beds set aside for such are or treat- ment. b. Elementary and Junior High Schools; one (1} space for each employee and each faculty member. c. High. Schools; one (1) space for each twenty (20) students and one (1) space for each faculty member. d. Junior Colleges, Colleges and Universities; one (1) space for each ten {10) students and one (1) space for each faculty member and employee. -3- l 2 3 10 11 12 13 14 15 16 17 18 19' 20 21 22 23 24 2° 26' 3 . Other Uses a. Public or private permitted uses incorporating indoor or outdoor assembly or spectator areas, such as churches, mortuaties, lodge buildings, clubhouses, auditoriums, theatres, stadiums, area~fs; one (1) space per each four fixed seats in the assembly or spectator area, plus one (1) space per each eight (8) feet of fixed bench length in the assembly or spectator area, plus one (1) space for each twenty-eight (28j square feet of assembly or spectator area in which no fixed seats or benches are maintained. b. Passenger terminals; one (1) space per each gross hundred (100) square feet of waiting room area. The definition of "parking space", as it appears in para- graph 25, or Ordinance No. 1002, shall apply to this section, pro- vided that, in the case of any of the uses described in 3, above, the required parking space may be located off the use site and within a walking distance of three hundred (300) feet therefrom. Any proposed use which falls into more than one of the above categories shall be subject to the greater of the applicable off-street parking zequirements. rn addition, the Planning Commis- sion may require additional off--street parking for any such use, the total amount so required not to exceed the combined total of each separately applicable requirement. -4- 1' 2 3 4 5 6 7 8 9 10 11 12! 13' 14: 15, 16' 17 18 19 2d 21 22 23 24 2~ 26 2.9 TRUCK LOADING AND UNLOADING SPACE: Private off-street loading space for the handling of all goads, materials and equipment shall be provided. Such space shall be of sufficient area and of such design as to permit the parking and unloading of vehicles without extending into any existing street beyond the curb line. SECTION 3. All uses of land within the District nat specifically authorized and permitted under Section 2 are pro- hibited. ' SECTION 4. Penalties for any violation of the zoning here- by imposed within the District shall be as provided in the Zoning Enabling Ordinance, and in compliance with the provisions of the Zoning Enabling Ordinance this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. In compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance in full. SECTION 6. This ordinance shall be and is hereby declared to be in full force anc~ effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (l5) days after its passage this Ordinance shall be published 011Ce with the names of the members voting for and against it in the Paradise Post a newspaper published in the County of Butte,.
