HomeMy WebLinkAbout1209ORDINANCE N0. 1209 l 2 3 4 5 6 7 8 9 to 11 12 13 14 15 16 17 18 19' 20. 21 22. 23. 24 25 26 TO EXTEND AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE AN "R-1" {SINGLE-FAMILY RESIDENTIAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "R-1" ESingle-Family Residential) District, for a 9v,~, .~ , period of 1~Bd days, and such area shall be subject to the re- strictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, near Chico, California, more particularly described as follows: Lot 1 through Lot 107 of Butte Creek Estates, per map recorded in Map Book 34 on pages 34, 35, 36 and 37 in the office of the Recorder, County of Butte, State of California. SECTION 2. The following regulations shall apply in an "R--1" {Single-Family Residential) District: 2.1 USES PERMITTED a. Single-family dwellings, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. c. Household pets (but not including livestock, poultry or poisonous reptiles.) l 2.2 LOT AREA: 2 a. Minimum required area of a lot per dwelling unit 3 shall be no less than eight thousand one hundred 4'; twenty-:five (8,125) square feet. 5 2.3 LOT WIDTH: 6 a. Minimum lot width shall not be less than sixty-five ry (65) feet. $ 2.4 FRONT YARD: 9 a. Minimum front yard shall be fifty (50} feet from 10 _. the centerline of the road, except where the road 11 is classified by the County as a Federal Aid 12 Secondary Road the minimum building setback require- 13 ments shall be fifty-five (55) feet from the center- i4 line of said road. 15' 2.5 SIDE YARDS: 16 a. Minimum side yard shall not be less than five (5} 17 feet. lg 2.6 The following uses subject to securing a use permit 19I in each case: 20 a. Golf courses and country clubs. 21' b. Public and quasi-public uses including churches, 22 firehouses, hospitals, parks, playgrounds, schools 23 and public utility buildings. 24 SECTI ON 3. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in Section 15 of Ordinance No. 475. Tn compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names 'of all members voting for and against the same in the Chico Enterprise-Record, a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. The existing A-2 zone permits uses incompatible with the recently developed single family dwelling nature of the sub- ject area. 2. The Planning Commission is considering a petition requesting rezoning of the subject area to R-1 and R-2. 3. This urgency ordinance is necessary to preserve the public health, safety and welfare in the subject area until said rezoning to R-1 and R-2 is decided.
