A RE50LUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
CERTIFYING THAT 1T HAS REVIEWED AND CONSIDERED
A NEGATIVE DECLARATION
PREPARED BY THE DUDLEY RIDGE WATER DISTRICT FOR
THE BUTTE COUNTY-WESTSIDE DISTRICTS MULTI-YEAR STATE WATER PROJECT TABLE A WATER TRANSFER
AND AUTHORIZING PARTICIPATION IN THE TABLE A TRANSFER FOR 2012 AND 2013 THROUGH THE APPROVA! OF THE
AS50CIATED AGREEMENTS WITH THE WESTSIDE DISTRICTS AND THE CALIFORNIA DEPARTMENT OF WATER
RESOURCES AND THE
KERN COUNTY WATER AGENCY AND THE DEPARTMENT
OF WATER RESOURCES
WHEREAS, the Board of Supervisors has considered entering into a water transfer with Westside Districts,
through the approval of the three associated agreements: Agreement Between Westside Water Districts and the County
of Butte for Lease of a Portion of the County of Butte's State Water Project Table A Amount for 2012 and 2013;
Agreement Among the Department of Water Resources of the State of California, Dudley Ridge Water District and
County of Butte for the Delivery of a Portion of County of Butte's State Water Project Allocated Table A Water (SWPAO
#12016}; Agreement Among the Department of Water Resources of the State of California, Kern County Water Agency
and County of Butte for the Delivery of a Portion of County of Butte's State Water Project Allocated Table A Water
(SWPAO # 12017] and in accordance with the terms of the County's State Water Project (5WP] Water Supply Contract;
and
WHEREAS, Dudley Ridge Water District, acting as lead agency, determined it was appropriate to prepare a
Negative Declaration for the Butte County-Westside Water Districts Multi-Year State Water Project Table-A Water
Transfer; and
WHEREAS, the Board of Supervisors, as a responsible agency, consulted with Dudley Ridge, as the lead agency,
during the environmental review process; and
WHEREAS, the Board of Supervisors, as a Responsible Agency has reviewed and considered the Negative
Declaration prepared by Dudley Ridge Water District for the water transfer in accordance with the California
Environmental Quality Act; and
WHEREAS, the other Westside Districts are member units of the Kern County Water Agency (KCWA], which is a
SWP contractor serving much of Kern County; and
WHEREAS, KCWA, as a Responsible Agency has reviewed and considered the Negative Declaration prepared by
Dudley Ridge Water District for the water transfer in accordance with the California Environmental Quality Act; and
WHEREAS, the Negative Declaration does not identify any significant impacts within the jurisdiction of the Board
of Supervisors as supported by the following:
No new construction or improvements by Butte County, the Westside Districts or the California
Department of Water Resources would occur with the proposed water transfer;
The delivery of the Table A water from Butte County to the Westside Districts would occur
within the operating conditions of the State Water Project as determined by current licenses,
permits, regulatory constraints, interim remedial actions and all applicable Biological Opinions
and would therefore have no impacts upon the environment that would require mitigation; and
WHEREAS, a duly noticed public hearing on the Butte County-Westside Districts Multi-Year State Water Project
Table-A was held before the Board of Supervisors on July 31, 2012; and
WHEREAS, the Board of Supervisors has considered the staff report and recommendation of the Butte County
Department of Water and Resource Conservation and the Butte County Department of Development Services, Planning
Division, and public comments.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors takes the following actions:
1. Certifies that it has reviewed and considered the Negative Declaration for the Butte County --Westside Districts
Multi-Year State Water Project Table-A Water Transfer prepared by the Dudley Ridge Water District.
2. Finds the Negative Declaration to be adequate far the purpose of entering into the Table A water transfer
between Butte County and the Westside districts.
3. Finds that there are no significant impacts within the jurisdiction of the Board of Supervisors identified in the
Negative Declaration.
4. Finds that there is no need for the Board of Supervisors to modify the Table-A water transfer agreements to
mitigate any potential impacts.
5. Authorizes the Clerk of the Board to prepare and file a Notice of Determination.
6. Approves the Agreement Among the Department of Water Resources of the State of California, Dudley Ridge
Water District and County of Butte for the delivery of a Portion of County of Butte's State Water Project
Allocated Table A Water (SWPAO #12016) and authorizes the Chair to sign subject to review by County Counsel
and the Auditor/Controller.
7. Approves the Agreement Among the Department of Water Resources of the State of California, Kern County
Water Agency and County of Butte for the Delivery of a Portion of County of Butte's State Water Project
Allocated Table A Water (SWPAO # 12017) and authorizes the Chair to sign subject to review by County Counsel
and the Auditor/Controller
8. Approves the Agreement Between Westside Districts and the County of Butte for Lease of a Portion of the
County of Butte's State Water Project Table A Amount for 2012 and 2013 and authorizes the Chair to sign
subject to review by County Counsel and the Auditor/Controller.
9. The custodian of the record is the Butte County Department of Water and Resource Conservation. The location
of the record is 308 Nelson Avenue, Oroville CA 95965.
