HomeMy WebLinkAbout1212ORDINANCE NO. 1212 _ rn ~_vrcnoo_ AN INTERIPq: ORDINANCE ZONING A PORTION OF COUNTY OF BUTTE AN "A-3" (AGRICULTURAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AT~IENDED. 6 7 8 9 10 11 12 13 i4 15 16 17 18 19' 20 21 22 23 24' 25 26 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby i0 zoned as an "A-3" (Agri cu] tural ) District, .for a period of 'F8~9. days, and such area shall be subject to the restrictions and re- stricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, California, more particularly described as follows: A71 of Sections 20, 21, 22, 27, 28, 29, 32, 33 and 34, T21N R3E, MDB&P4. SECTION 2. REGULATIONS FOR AN "A-3" DISTRICT: The following regulations shall apply in an "A-3" District: 2.1 USES PERN~ITTED: a. Single-family dwellings. b. General farming, horticulture, commercial livestock, poultry .production, warehousing and storage. c. Accessory buildings and uses pertinent to the permit- ted uses, including agricultural processing plants. d. Noosing facilities {including mobile homes) to accom- modate only agricultural employees and their families employed by the owner or operator of the premises; and provided further that such housing facility shall 1 2 3' 4: 5 6 7' 8 9 10 I1 12 I3 14 15 161 17' 18 19 20' 21 22 23 24 25 26 e 2.2 IN EACH CASE: be considered accessory to the main building and shall conform to the provision pertaining to required yard and open space for d~~~ellings. Mobile homes to house one family when such mobile home is the only housing facility located on the premises, provided the following conditions are con- formed to: 1. The floor area within the .mobile home shall not be less than five hundred (500) square feet. 2. The.parcel of land conforms to Section 2.3 (mini- mum lot area of 5 acres}, or is a smaller parcel of land lawfully created prior to the enactment of this Ordinance, subject to written approval by .the Director of Planning. THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT a. Golf courses and country clubs. b. Public or quasi-public uses including churches, fire houses, hospitals and cli°nics, parks and playgrounds, schools, public utility buildings and professional buildings. 2.3 MINIMUM LOT AREA REQUIRED: Minimum lot area shall not be less than five (5) acres. 2.4 FRONT YARD REQUIRED: Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is c]assified by the County as a Federal Aid Secondary Road 2. 1 and the minimum building setback requirement shall be fifty-five 2 (55) feet from the centerline of said road. 3' 2.5 SIDE YARD REQiIIRED: Minimum side yard shall not be 4 less than five (5) feet. 5 SECTION 3. All uses of land not specifically authorized 6' and permitted under Section 2 are prohibited within the district. ~ SECTION 4. The penalties for the violation of the zoning 8 hereby imposed within the district shall be as provided in Section 9 I5 of Ordinance No. 475. In compliance with the provisions of 10 the Zoning Enabling Ordinance, this ordinance shall from and 11 after its effective date become a supplement to and part of the 12; Zoning Enabling Ordinance. I3 SECTION 5. This urgency ordinance shall take effect 14 immediately upon its passage, and before the expiration of fifteen 15 (15) days after its passage shall be published once with the names 16 of all members voting for and against the same in the 17 Enterprise-Record a newspaper in general circulation 18 in the County of Butte, State of California. The facts constitu- 19 ting the urgency on which this ordinance is based are: 20' I. The existing "A-2" Zoning permits uses which may be 21 incompatible with the development of the subject area 22' in a manner inconsistent with the location of Butte 23 Junior College in said area. 24 2. The Planning Gommissio,n will soon be considering 2B possible rezoning of all, or parts of, the subject 26' area to zoning districts compatible with the develop- ment of a junior college site. 3. 1 3. This urgency ordinance is necessary to preserve the 2 public health, safety, and welfare in the subject area 3 until said rezoning studies are completed and acted upon. 5 PASSED AND ADOPTED by the Board of Supervisors of the 6 County of Butte, State of California, on the 16th day of 7' November 1971, by the following vote: 8 9 AYES: Supervisors Gilman, Madigan, Maxon, McKillop and Chairman Reynolds 10, NOES: None lI ABSENT: None 12 N a rman 1,3` B County Board of Supervisors 14 ATTEST: CLARK A.
