HomeMy WebLinkAbout1214ORDINANCE PlO. 1214 TO EXTEND RN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE AN "S-1" (MEDIUM-DENSITY SUBURBAN RESIDENTIAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475 1 AS AMENDED. 2' 3' The Board of Supervisors of the County of Butte, State of 4 California, under and pursuant to Ordinance No. 475, as amended, 5' and declaring an emergency, DOES ORDAIN as follows: 6 SECTION 1. The hereinafter described area situate in the 7 County of Butte, State of California, shall be and it is hereby 8 zoned as an "S-1" (Medium Density Suburban Residential) District, 9' for a period of 9o days, and such area shall be subject to the 10' restrictions and restricted uses and regulations hereinafter 11 specified and provided. Said area so zoned being located in the T2 unincorporated area of Butte County near Chico, California, more 13' particularly described as follows: 14 All that property located east of the existing "A-3" District and west of the following described line: 15 beginning at the intersection of Glenwood Road and the southwesterly line of Lot 2 of "Bidwell 2nd Sub"; 16 per map recorded in h9ap Book 5 on page 27; thence southeasterly along the southwesterly line of Lots 17' 72, .73, 74, 75,. 76, 77, 78, 79 and 80 to the southwest corner of Lot 81; thence S77°36'E, 279.37 ft.; thence 18' south 125 ft. to Sacramento Ave.; thence east along Sacramento Ave. to Oak Lawn Ave.; thence south along 19 Qak Laurn Ave. to the north line of "Oak Lawn Manor Sub per map recorded in Map Book 17 on page 37; thence 20 east along the north line of said "Dak Lawn Manor Sub" to the west line of. Lot 8 of said "Bidwell 2nd Sub"; 21 thence south along the west line of said Lot 8 to the southwest corner of said Lot 8; also being the narth- 22 west corner of Lot 9, said "Bida~ell 2nd Sub"; thence east to the northeast corner of said Lot 9; thence 23 south 503 ft.; thence west 92.5 ft.; thence south 209 ft.; thence east 78.5 ft.; thence south 274.9 ft. 24 to Stewart Ave.; thence south along Stewart Ave, and the southerly prolongation of Stewart Ave. to Big 25' Chico Creek; thence easterly along Big Chico Creek, to the northeast corner of Lot 3 of "Oak Manor", per 26 map recorded in Map Book 34 on page 45; thence 1. 1 southwesterly to the southeast corner of said "Oak Manor"; thence southerly across Oak Park Avenue tv 2 the northeast turner of Lot 9 of "Morehead Ranch ". Sub No. 1"; per map recorded in Map Book 9 on page 14; 3 thence snutherly along the east line of Lot 9, Lot 12 and Lot 19 to the north line of Lot 21, said "Morehead 4 Ranch Sub Plo. l; thence continuing south on the southerly prolongation of said Lot 19 to Chico River Road; thence S west along Chico River Road to the northeast corner of Lot l9 of "Mary E. O'Conner Sub", per map recorded in 6 Map Bvok 8 on page 19; thence southwesterly along the east line of said "Mary E. O'Conner Sub" to Little 7 Chico Creek; all maps recorded in the office of the Recorder, County of Butte, State of California. 8 Excepting therefrom Assessor's Parcel Numbers 9' 42-19-34 (Shultz Use Permit}, 43-25-03 and 43-29-72 (Vistec Inc. "PA-C"), and 42-19-19 (Priel}, as shown I0 on maps on file and of record in the office of the Butte County Assessor, State of California on the 11 first Monday of March 1971. 12 SECTION 2. REGULATIONS FOR AN "S-1" DISTRICT. The 13 following regulations shall apply in an "S-1" District: 14 2.1 USES PERMITTED: Z5 a. Single family dwellings, not includeng tents or 16 mobile homes. 17' b. Accessory .buildings pertinent to the permitted uses. 18 2.2 Agricultural uses, except livestock, subject to the 19 following requirements: 20 a. Far each horse or head of cattle over one year of 21 age, one (~) acre. 22 b. For each head of sheep or goats, one (1} acre for 23' the first head and one half (32) acre for each head 24 thereafter. 2g c. For each head of swine over ten weeks of age, one 26 (i) acre. 2. 1 2. 3 4 5 6 7. 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23'' 24 25 26 2.3 LOT AREA: Minimum required area of a lot per dlaelling unit shall not be less than eight thousand, one hundred tarenty-five (8,125) square feet. 2.4 LOT IJIDTN: Minimum lot width shall not be less than sixty-five (65) feet. 2.5 .:FRONT YARD: Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified. by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55) feet from the centerline of said road. 2.6 SIDE YARD: P~inimum side yards shall not be less than five (5) feet. SECTION 3. The following uses subject to securing muse permit in each case: a. Public and quasi-public uses, including churches. b. Hospitals, parks and playgrounds, schools and public utility buildings. SECTION 4. All uses of land within the district not specifi~cal1y authorized and permitted in Sections 2 and 3 are prohibited. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided 9n Section 15 of Ordinance No. 475. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. 3. 6 7 8 9' 10 X1 12 13 14 15 16 17 18 19' 20. 21 22 23 24 25 26 SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of all members voting for and against the same in the Chico Enterprise a newspaper in general. circula- tion in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. The existing A-2 Zone permits uses which may be incompatible with the developed single-family dwelling nature of the subject area. 2. The planning commission will soon be considering a petition requesting rezoning of the subject area into zoning districts more restrictive than the existing districts. 3. This urgency ordinance is necessary to preserve the public health, safety and welfare in the subject area until said rezoning to S-1 is decided.
