HomeMy WebLinkAbout1218ORDINANCE N0. x;218 TO EXTEND AN INTERIM ORDINANCE ZONING A PORTION OF TfiE ~~ ~~ COUNTY OF BUTTE AN A-3 (AGRICULTURAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED. 1 2 The Board of Supervisors of the County of Butte, State of 3 California, under and pursuant to Ordinance No. 475, as amended, 4 and declaring an emergency, DOES ORDAIPi as follows: 5 SECTION Z. The hereinafter described area situate in the 6 County of Butte, State of California';, shall be and it is hereby 7 zoned as an "A-3" (Agricultural) Dis'~trict, for a period of one (L) 8 year, and such area shall be subject'to the restrictions and re- 9: stricted uses and regulations herein',after specified and provided. TO Said area so zoned being located in ',the unincorporated area of 11' Butte County, California, more particularly described as follows: 12' All of Sections 20, 21; 22,'27, 28, 29, 32, 33 and 34, T2IN R3E, MDB&hi. 13 SECTION 2. REGULATIONS FOR',AN "A-3" DISTRICT: The I4 following regulations fall apply in an "A-3° District: 15 2.i USES PERMITTED: 16 a. Single-family dwellings. 1'7= b. General farming, horticulture, commercial livestock, 18 poultry production, warehousing and storage. 19 c. Accessory buildings and uses pertinent to the permit- 20' ted uses, including agricultural processing plants. 2l d. Housing facilities (including mobile homes) to accom- 22 modate only agricultural employees and their families 23 employed by the owner or operator of the premises; 2g and provided further that such housing facility shall 25 be considered accessory to the main building and shall 26 l conform to the provision pertaining to required yard 2 and open space for d~r~ellings. 3 e. Mobile homes to house one family when such mobile 4 home is the only housing facility located on the ~ premises, proyided the fallowing conditions are con- 6' formed to: 7 1. The floor area within the mobile home shall not g, be less than five hundred (500) square feet. g 2. The parcel of land conforms to Section 2.3 (mini- 10 mum lot area of 5 acres), or is a smaller parcel 17. of land lawfully created prior to the enactment 12 of this Ordinance, subject to written approval by 13 the Director of Planning. 34' 2.2 THE FOLL041ING USES SUBJ',ECT TO SECURING A USE PERMIT 15 IN EACFI CASE: 16 a. Golf courses and country clubs. lq b. Public or quasi-public uses including churches, fire lg houses, hospitals and clinics, parks and playgrounds, 19 schools, public utility! buildings and professional 20' buildings. 21 2.3 MINIP9UM LOT AREA REQUIRED: Minimum lot area shall 22. not be less than five (5) acres. 23 2.4 FRONT YARD REQUIRED: Minimum front yard shall be g4 fifty (50) feet from the centerline',of the road, except i~ahere the 2g road is classified by the County as 'a Federal Aid Secondary Raad 26, and the minimum building setback requirement shall be fifty-five (55) feet from the centerline of 5ai,d road. 2. 1 2.5 SIDE YARD REQUIRED: Minimum side yard shall not be 2 less than five (5} feet. 3 SECTION 3. All uses of land''not specifically authorized 4, and permitted under Section 2 are prohibited within .the district. ~; SECTION 4. The penalties for the violation of the zoning g hereby imposed within the district shall be as provided in Section 7 15 of Ordinance No. 475. In compliance with the provisions of g the Zoning Enabling Ordinance, this ordinance shall from and after 'g its effective date become a supplement to and part of the Zoning l0 Enabling Ordinance. I1' SECTION 5. This urgency ordinance shall take effect 12 immediately upon its passage, and before the expiration of fifteen 13 (15) days after its. passage shall be, published once with the names 14 of all members voting for and against the same in the Or v'll 15 Mercury a pewSpaper in general circulation 16 in the County of Butte, State of Caljfornia. The facts constitu- 17 ting the urgency on which this ordinance is based are: lg 1. The "A-2" Zoning permits uses which may be incompatible 19 with the development of the subject area in a manner 20 inconsistent with the location of Butte Junior College 81 in said area. 22 2. A zoning study is being conducted to consider possible 2g rezoning of all, or parts of, the subject area to 24 zoning districts compatible with the development of a 2g junior college site. 26 3. ', i 1' 3. This urgency ordinance is necessary to preserve the 2 public health, safety, and v~elfare in the subject area 3 until said rezoning studies are completed and acted 4 upon. s PASSED AND ADOPTED by the Board of Supervisors of the g County of Butte, State of California, on the ~~ day of 7 December 1971, by the follov~ing vote: 8 AYES: Supervisors Gilman, Madi~an~ Pdcl:illop and Chairman P~eynolds. 9 10 NOES : Supervisor Zylax~:;n 11 ABSENT: None 12' 13 ~.
