The "PA-R" Zone is intended to facilitate the development of centers of resi denti al activities and related uses without regard to the traditional limitations on lot size, road frontage, setback, side yards and rear yards. Said zone is to be applied only to areas determined to be suitable far such uses, as evidenced by a development plan to be submitted by the applicant to the Commission, and to be evaluai:ed by reference to existing and proposed land uses, the County General Plan and any applicable precise plans. Said development plan shall be legally binding on the developer or subsequent owners. Further,. said zone should be applied only where its peripheral boundaries can be adequately integrated with the sur- rounding public road system and surrounding zones without creating nuisances from noise, fumes, congestion or other causes. SECTION 2. USES PERMITTED. Those uses permitted in the "R-3" (P~edium Density Resi- dential) District and accessory uses shall be permitted within I, said zone, provided said uses, cluster or otherwise, and uses (accessory thereto, are shown on the plan on file in the off ice of the Butte~County Planning Department. SECTION 3. LOT REGULATIONS. In said zones there shall be no minimum lot size, setback, side yard, rear yard, or lot width or frontage requirements. 26. l SECTION 4. ACCESS REQUIREMENTS. 2 Rccess to each lot or to the common area serving said lot 3 shall be provided in accordance with the requirements of Chapter 4" 20 of the Butts County Code including the improvement standards 5 set forth in the resolution,af standards adapted pursuant thereto. 6 Vehicular and pedestrian movement in said parcel, adequate 7 far the use intended sha11 be evidenced by rights of way of ease- 8` ments granted on a final subdivision map or rights of way or 9 easements granted. by separate instrument pursuant to approval of 14 the Board of Supervisors. SUPERSESSION. 2I In the event the regulations for this zone clearly can-- 22 flict with the terms of any other applicable ordinance of the 23 County of Butte except Building, Electrical, Plumbing, and Sewage 24 Codes, the provisions hereof shall control. The provisions of 25 this ordinance -shall be construed to be in harmony with all such 2s ordinances unless clearly in conflict therewith. SECTION 8. The minimum size of any "PA-R" zone shall be three ~3) acres. SECTION 9. OF'F-STREET PARKING. Off=streetparking shall be required pursuant to the following formula: Residential llses: Twa (2) parking spaces for each living unit. Said parking area may be owned individually or by the owners of more than one lot in common. SECTION 10. PROCEDEIRE. Any appli.catian far rezoning to Planned Area-Residential 'shall be accompanied by a preliminary development plan to be sub- mitted to the subdivision committee far review and report pursuant to Section 20-I.3 of the Butte County Code. As to form and content, the preliminary development map and the revietiv process shall conform to the requirements of said Code for a tentative subdi- vision map. Upan_receipt of the recommendations of~'the committee the Planning Director shall set the application far hearings as in the case of other rezoning applications. SECTION lJ.. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date became a supplement to and part of the Zoning Enabling Ordinance. 3. 1 SECTION 12. The hereinafter described area situate in the 2 County of Butte, State of California, shall be and it is hereby 3 zoned as a "PA-R" (Planned Area-Residential} District and such 4 areas sha11 be subject to the restrictions and restricted uses and ~ regulations hereinafter specified and provided.
