SECTION 1, PURPOSE.
The "PA-R" Zone is intended to facilitate the development
of centers of resi denti al activities and related uses without
regard to the traditional limitations on lot size, road frontage,
setback, side yards and rear yards.
Said zone is to be applied only to areas determined to be
suitable far such uses, as evidenced by a development plan to be
submitted by the applicant to the Commission, and to be evaluai:ed
by reference to existing and proposed land uses, the County General
Plan and any applicable precise plans. Said development plan shall
be legally binding on the developer or subsequent owners.
Further,. said zone should be applied only where its
peripheral boundaries can be adequately integrated with the sur-
rounding public road system and surrounding zones without creating
nuisances from noise, fumes, congestion or other causes.
SECTION 2. USES PERMITTED.
Those uses permitted in the "R-3" (P~edium Density Resi-
dential) District and accessory uses shall be permitted within
I, said zone, provided said uses, cluster or otherwise, and uses
(accessory thereto, are shown on the plan on file in the off ice
of the Butte~County Planning Department.
SECTION 3. LOT REGULATIONS.
In said zones there shall be no minimum lot size, setback,
side yard, rear yard, or lot width or frontage requirements.

l SECTION 4. ACCESS REQUIREMENTS.
2 Rccess to each lot or to the common area serving said lot
3 shall be provided in accordance with the requirements of Chapter
4" 20 of the Butts County Code including the improvement standards
5 set forth in the resolution,af standards adapted pursuant thereto.
6 Vehicular and pedestrian movement in said parcel, adequate
7 far the use intended sha11 be evidenced by rights of way of ease-
8` ments granted on a final subdivision map or rights of way or
9 easements granted. by separate instrument pursuant to approval of
14 the Board of Supervisors. Desirably minimum width of any such
].I easement is twenty X20} feet.
12 SECTIOPd 5. LOT COVERAGE.
13 No Tat (when considered together with its proportionate
14 share of any commas space) sha71 be permitted building coverage
~S: greater than that shown on the development plan approved by the
16 Butte County Planning Commission and Butte County 6aard of Super-
7.7 visors and on file in the Planning Department, unless a revised
18 plan is submitted to the Planning Commission and Board of Super-
19; visors for approval.
2fl SECTION 6:. SUPERSESSION.
2I In the event the regulations for this zone clearly can--
22 flict with the terms of any other applicable ordinance of the
23 County of Butte except Building, Electrical, Plumbing, and Sewage
24 Codes, the provisions hereof shall control. The provisions of
25 this ordinance -shall be construed to be in harmony with all such

established .in a."PA-R" zone after the effective date of this
ordinance shall be deemed to be an "open space subdivision" for
the purposes of Section 20-30.2 of the Butte County Code.
SECTION 8. The minimum size of any "PA-R" zone shall be
three ~3) acres.
SECTION 9.
OF'F-STREET PARKING.
Off=streetparking shall be required pursuant to the
following formula:
Residential llses: Twa (2) parking spaces for each
living unit.
Said parking area may be owned individually or by the
owners of more than one lot in common.
SECTION 10. PROCEDEIRE.
Any appli.catian far rezoning to Planned Area-Residential
'shall be accompanied by a preliminary development plan to be sub-
mitted to the subdivision committee far review and report pursuant
to Section 20-I.3 of the Butte County Code. As to form and content,
the preliminary development map and the revietiv process shall
conform to the requirements of said Code for a tentative subdi-
vision map. Upan_receipt of the recommendations of~'the committee
the Planning Director shall set the application far hearings as
in the case of other rezoning applications.
SECTION lJ.. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in the
Zoning Enabling Ordinance, this Ordinance shall from and after its
effective date became a supplement to and part of the Zoning
Enabling Ordinance.

1 SECTION 12. The hereinafter described area situate in the
2 County of Butte, State of California, shall be and it is hereby
3 zoned as a "PA-R" (Planned Area-Residential} District and such
4 areas sha11 be subject to the restrictions and restricted uses and
~ regulations hereinafter specified and provided. Said areas so
6 zoned being in the unincorporated area of Butte County near
7. Oroville, California, mare particularly described as follows,:
g.. A portion of the southwest quarter of Saction l6,
T19N R4E, I'~DB&M; more particularly described as

10 Beginning at an iron pin on the east--west section line
common to Sectia~ns 16 and 21, T19N R4E, from vrhich
Yl~ iron pin the section corner common to Sections 16, l7,
20 and 21, Tl9N R4E, bears west 810.80 ft.; thence
12 east 1503.8 ft. more or less, to the southerly right
of way of Lower Wyandatte Road, tl~ence northwest along
13; a non-tangent curve, concave to tkie south, having a
radius of 760 ft. tradial bearing N42°06'36"E) through
14~ a~central. angle of 16°02'38" an arc length of 187.61 ft.;
thence N63°56'02"W, 317.61 ft.; thence narthuresterly
~5' along a curve concave to the southwest, having a radius
of 1970 ft., through a central angle of 5°38'23" an

thence northwesterly through a curve concave to the

central angle of 2°00'29" an arc length of 104.09 ft.;

Wyandotte Rnad, 200 ft.; thence west, 140 ft.; thence

Road, 250 ft.; thence N71°57'32"W, 347,32 ft.; thence

22 SECTION 13. This Ordinance shall be and it is hereby
23; declared to be in full farce and effect from and after thirty (30)
24 days after the date of its passage and before the expiration of
25 fifteen (15) days after its passage, this ordinance shall be
26` published once with the names of the members of the Board voting
