HomeMy WebLinkAbout1233ORDINANCE N0. 7.233 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUPITY OF BUTTE AN "5-1" (P1EDIUM DEPISITY SUBURB API RESIDENTIAL) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED. The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DO.ORDAIN as follows: SECTION 1. The hereinafter described area situate in the 7 8' 9 10, 11. 12 13' 14 15 16 1T 18 19 20'. 21 22; 23' i 24 2S 26' :County of Butte, State of California, shall be and it is hereby zoned as an "S-1" (P4edium Density Suburban Residential} District 'for a period of 120 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County near Chico, California, more particularly described as follows: All that property located east of the existing "A-3" District ar-d west of the following described line: beginning at the intersection of Glenwood Road and the southwesterly line of Lot 2 of "8idwell 2nd Sub per map recorded in Map Book 5 on page 27; thence southeasterly along the southwesterly line of Lots 72, 73, 74, 75, 76, 77, 78, 79 and 80 to the southwest corner of Lot 81:; thence S77°36'E, 279.37 ft.; thence south 125 ft. to Sacramento Ave.; thence east along Sacramento Ave. to Oak Lawn Ave.; thence south along Oak Lawn Ave. to the north line of "Oak Lawn P~lanor Sub"; per map recorded in hlap Book 17 on page 37; thence east along the north line of said "Oak Lawn P4anor Sub" to the west line of Lot 8 of said "Bidwell 2rrd Sub"; thence south along the west line'of said Lot 8 to the southwest corner of said Lot 8; also being the nortlivaest corner of Lot 9, said "Bidwell 2nd Sub"; thence east to the northeast corner of said Lot 9; thence south 503 ft.; thence west 92.5 ft.; thence south 209 ft.; thence east 78.5 ft.; thence south 274.9 ft. to Stevrart Avenue; thence south along Stewart Avenue and the southerly prolongation of Stewart Avenue to Big Chico Creek; thence easterly along Big Chico Creek, to the northeast corner of Lot 3 of "Oak Manor", per map recorded in Map Book 34 on page 45; thence southwesterly to the southeast corner of 1 said "Oak Manor"; thence southerly across Oak Park Avenue to the northeast corner of Lot 9 of "Morehead 2i Ranch Sub No. 1"; per map recorded in Map Book 9 on page 14; thence southerly along the east line of 3 Lot 9, Lot 12 and Lot 19 to the north line of Lot 21, said "Morehead Ranch Sub No. 1"; thence continuing 4 south on the southerly prolongation of said Lot 19 to Chico River Road; thence west along Chico River 5 Road to the northeast corner of Lot 79 of "P~ary E. O'Conner Sub", per map recorded in Map Book 8 on 6 page 19; thence southwesterly along the east line of said "Mary E. O'Conner Sub" to Little Chico 7' Creek; all maps recorded in the office of the Recorder, County of Butte, State of California. 8` Excepting therefrom Assessor's Parcel Numbers 9 42-19-34 (Shultz Use Permit), 43-26-03 and 43-29-72 (Vistec inc. REGULATIONS FOR AN "S-1" DISTRICT. The 13, following regulations shall apply in an "S-I" District: 14 2.1 USES PERMITTED: T5, a. Single family dwellings, not including tents or 16' mobile homes. 17 b. Accessory buildings pertinent to the permitted uses. 18 2.2 Agricultural uses, except livestock, subject to. the 19! follpwing requirements: 20 a. for .each horse or head of cattle over one year of 21 age, one (1) acre. 22 b. For each head of sheep or goats, one (1) acre for 23 the first head and pne half (z) acre for each head 24 thereafter.- 25. c. Fo-r each head of swine over ten weeks of age> one 26: (1} acre. 2. 1. 2, 13 4 6 7! 8 9 10 11'' 12 13 14' 15 I6'! i 17 18 19. 20: 21 22 23 2~. 23 26 2.3 LOT AREA: Minimum required area of a lot per dwelling unit shall not be less than eight thousand, one Hundred twenty-five (F3,125) square feet. 2.4 LOT WIDTH: Minimum lat width shall not be less than sixty-five (65) feet. 2.5 FRONT YAitD': Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55) feet from the centerline of said road. 2.6 SIDE YARD: Minimum side yards shall not be less than five (5) feet. SECTION 3. The following uses subject to securing a use permit in each case: a. Public and quasi-public uses, including churches. b. Hospitals, parks and playgrounds, schools and public utility buildings. SECTIOhJ 4. All uses of land within the district not specifically authorised and permitted in Sections 2 and 3 are prohibited. SECTION 5. The penalties for the violation of the zoning hereby imposEd within the district shall be as provided in Section 15 of Ordinance No. 475. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. 3. i 1 SECTION 6. This urgency ordinance shall take effect 2 immediately upon its passage, and before the expiration of fifteen 3 (15) days after its passage shall be published once with the names 4 of ali members of the Board of Supervisors voting for and against ~ the same in the. Chico Enterprise Record a newspaper in s general circulation in the County of Butte, State of California. ~' The facts constituting the urgency on which this ordinance is g: based are: g 1. The existing A-2 Zone permits uses which ma,y be 10 incompatible with the developed single family dwelling nature of 11' the subject area. 12 2. The planning commission will soon be considering a 13!. petition requesting rezoning of the subject area into zoning 14 districts more restrictive than the existing districts. 15 3. This urgency ordinance is necessary to preserve the 16 Public health, safety and welfare in the subject area until said 17, rezoning to S-1 is decided. 18 PASSED AND ADOPTED by the Board of Supervisors of the 19 County of Butte, State of California, on the 25th day of 20 January 1972, 6y the following vote: 21 AYES:.
