HomeMy WebLinkAbout1249ORDINANCE N0. ~~~Q 1 2' 3! 4 5 6 ',7 8 9 10 lI 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 AN ORDINANCE OF THE COUNTY OF BUTTE ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1970 EDITION, WITH APPENDICES THERETO, AS PREPARE- AND PUBLISHED BY THE TNTERNATIONAL CONFERENCE OF BUILDING OF'T'ICIALS, PROVIDING FOR THE APPLI- CATION OF REGULATIONS THEREIN CONTAINED TO THE UNINCORPORATED AREAS OF THE COUN' OF BUTTE. The Board of Supervisors aB the County of Butte do ordain as fo]1ows: Section 26-1 of the Butte County Code is amended to read as follows: Tn order to provide minimum standards for the proper regulation of building construction, the Uniform Building Code, 1970 Edition, with appendices thereto, prepared and published by the International Conference of Building Officials, is hereby adopted, incorporated, and made apart of this chapter by reference without further publication as though set forth at length herein and is hereby declared to be the Building Code for the county and shall apply to and govern all building construction in the unincorporated areas of the county except as hereinafter provided. Section 26-3 of the Butte County Code is amended to read as follows: The Uniform Building Code as adopted by Section 26-1 is amended as follows: Section 204 of the Uniform Building Code is hereby deleted. The local appeals board of the county which was established by Resolution No. 6~.-3 by the County Board of Supervisors shall hear any and all appeals regarding the application and enforcement of this chapter. Sub-section 301 (a) of the Uniform Building Code is hereby amended by the addition of the following paragraphs: No permits shall be required for any agricultural building. Agricultural buildings are defined as follows: "Agricultural building is a building located on agricultural property and used to shelter farm imple- ments, hays grain, poultry, lipstock, or ather farm produce, in which there is no human habitation, is not used commercially and which is not used by the public." No permits shall be required for detached structures which have a total net area, including additions~of not more than 200 square feet, 1' which would have an occupancy classification of Type J as defined in the 2' Uniform. Building Code, and which would be detached a minimum of 6 feet 3 from any building requiring a building permit. This exemption shall apply ¢ to tool sheds, wood sheds, and other storage sheds. This exemption shall 5 not apply to laundry builclings, bath houses, carports, garages and pump 6; houses. 7' Section 302 (d) of the Uniform Building Code is amended as follows: i 8 "Every building permit issued under the provisions of this Code g shall expire by limitation and become null and void after one (1) year 10 from the date of issuance of said permit. 1f building is under construc- 11 Lion, before work can continue, a new permit shall. be first obtained 12 and the fee therefor sha~.l be one-half (2) the amount required for the 13' original permit; provided, no changes have been made in the original 14 plans. 15 Section 303 (b). Section 303(b) of the Uniform Building Code is hereby 16 amended to exclude plan checking fees on single family dwellings and duplexes 17 as well as their appurtenant structures. ~$ Section 303 of said Uniform Building Code is hereby amended by adding 19 subsection (c) as follows: 20 The building permit fees for factory built housing shall be computed 21 in the same manner as for regular building construction except that the 22 fee shall be one-half (2) of the building permit fee determined by Table 23 3A of said Uniform Building Code, 24 Section 303 of said Uniform Building Code is hereby amended by adding 2B subsection (d) as follows: 26 "Where an owner or contractor desires an additional set of approved 27 building plans, the fee for this service shall be X5.00 for residential 28 buildings, and X10.00 fox commercial buildings." 2g Section 303 of said Uniforzu Building Code is hereby amended by adding 30 subsection (e} as follows: 31 "After building plans have been checked by the Department of Public 32 Warks and if the owner or contractor t~eshe to significantly change or -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2B 26 27 28 29 30 31 32 redesign the building or structure which would constitute additional plan checking work, an additional plan check fee may be required." Chapter 70 of the appendix of the Uniform Building Code is hereby deleted. Sections 26-2 (as enacted by Butte County Ordinance #$$6), 26-l~. (as enacted by Butte County Ordinance #970), 26-~..1 (as enacted by Butte County Ordinance #1159), 26-5 (as enacted by Butte County Ordinance #$$6), and 26-6 (as enacted by Butte County Ordinance #$$6) wall remain in effect. This ordinance sha71 take effect and be in force at the expiration of thirty (30) days from and after its passage and before the expiration of fifteen (15) days after its passage shall be published once with the names of the member: voting for and against the same in a newspaper of general circulation printed and published in the County of Butte.
