AN ORDINANCE Ok' THE COUNTY OF BUTTE ALlOPTING BY REFERENCE THE UNIFORM
MECHANICAL CODE, 19'70 EDITION, 'WITH APPENDICES THERETO AS PREPARED AND PUBLISHEI
BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS,PROVIDING FOR THE APPLICA-
TION OF REGULATIONS THEREIN CONTAINED TO THE UNINCORPORATED AREAS OF THE COUNTY.
OF BUTTE AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF,
The Board of Supervisors of the County of Butte`do ordain as follows
in order to provide minimum standards for the proper regulation of
building construction, the Uniform Mechanical Code, 1970 Edition, with appendice
thereto, prepared and published by the International Conference of Building
Officials, is hereby adopted, incorporated, and made apart of this ordinance
by reference without further publication as though set forth at length herein
and is hereby declared to be the Mechanical Code for the County of Butte and
shall apply to and govern all building construction in the unincorporated areas
of the County except as hereinafter provided.
Whenever any of the following names or terms are used in said Uniform
Mechanical Code, such name or term shall have the meaning ascribed to it by this
section as follows:
Building Official shall mean the Director of Public Works of
the County of Butte.
City shall mean the County of Butte.
City Clerk shall mean County Clerk. Ex-officio Clerk of the
Board of Supervisors shall mean County Clerk.
City_Council shall mean the Board of Supervisors of the County
of Butte.
Housing Act shall mean the State Housing Act {Section 17910 et.
sec., of the Health & Safety Code of the State of California).
Mayor shall mean the Chairman of the Board of Supervisors of
the County of Butte.
Section 203 of said Uniform Mechanical Code is hereby deleted.
The Local Appeals Board of the County of Butte which was established by
Resoluton;,No'.`.,h/+3: by the Butte County Board of Supervisors shall hear any and
all appals regarding the application and enforcement of this ordinance.
1 Section 301 of said Uniform Mechanical Code is hereby amended by the addi-

3 9• No permits shall be required for any agricultural building. Agxi-
¢ cultural buildings are defined as follows: "Agricultural building
5 is a building located on agricultural property and used to shelter
g farm implements, hay, grain, poultry, livestock, or other farm
7 produce, in which there is no human habitation, is not used
g commercially, and which is not used by the public."
g No permits shall be required for detached structures which have a
10 total net area, including additions, of not moaee than 200 square
lI feet, which would have an occupancy classification of Type J as
12 defined in the Uniform Building Code, and which would be detached
13 a minimum of 6 feet from any building requiring a building permit.
14 This exemption shall apply to tool sheds, wood sheds, and other
15 storage sheds. This exemption shall not apply to laundry buildings,
16 bath houses, carports, garages, and pump houses.
17 Section 303{b) of said Uniform Mechanical Code is amended to read as

19 Every mechanical. permit issued under the provisions of this ordinanc
20 shall expire by limitation and become null and void one {1) year fro
2]. the date of'issuanee of said permit; provided, however, if said
82 mechanical permit is issued in conjunction with a building permit,
28 said mechanical permit will remain active as long as the building
24 permit is active.
25 Section 30~. of said Uniform Mechanical Code is amended by the addition of
26 the following:
27 22. A mechanical permit may be transferred from the original
28 permittee to another person due to a change in ownership or contrac--
Zg tor, and the transfer fee shall be X3.00.
30 It shall be unlawful for any person, firm., or corporation to perform any
31 act contrary to or in violation of any provisions of said Uniform Mechanical
S2 Code or of this ordinance.

Any person, fixm,or corporation violating or causing or permitting the
violation of any of the provisions of this ordinance shall be guilty of a
misdemeanor and upon conviction thereof shall be punished by a fine of not more
than ~G500.00 or by imprisonment in the County Jail for a term not exceeding
six {6) months ox by both such fine and imprisonment.
If any section, sub-section, sentence, clause, or phrase of this ordinance
is for any reason held by a court of competent jurisdiction to be invalid, such
u$ecision shall not affect the validity of the remaining portions of this ordi-
nance. The Board of Supervisors hereby declares that it would have passed this
ordinance and each section, sub-section, sentence, clause, and phrase thereof
irrespective of the fact that any one or more sections, sub-sections, sentences,
clauses, or phrases be declared invalid.
This ordinance shall take effect and be in force at the expiration of
thirty (30)days from and after its passage and before tY~ expiration of fifteen
(15) days after its passage shall be published once with the names of the member
voting for and against the same in a newspaper of general circulation printed
and published in the County of Butte.
