The Board of Supervisors of the County of Butte, State of :alifornia, under and pursuant to Ordinance No. 475, as amended, end declaring an emergency, DO ORDAIN as folloti~rs: SECTION 1. The hereinafter described area situate in the county of Butte, State of California, shall be and it is hereby zoned as an °A-3" (Agricultural} District for a period of 90 days, end such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte :ounty near Chico, California, more particularly described as =01 1 ows Beginning at the southwest corner of "Pomona Add." per map recorded in map book 4 on page 40 in the office of Butte County Recorder; t~~ence east to the southeast corner of said "Pomona Add." being the west line of Dayton Road; thence S 18oO4'W along Dayton Road 2,554.7b feet; thence leaving Dayton Road iV72°O7'W, 2,714.1 feet; thence Nib°04'E, 20 feet; thence fJ72o07'W, 29 feet; thence Nlt`3o04'E to the centerline of "Little Chico Creek:, thence meandering northeasterly along the center sine of Little Chico Creek to the south line of "Ffenry's Third Add.", per map recorded in map book 9, page 2$, in the office of Butte County RecordE thence northeast along said south line of "Henry's Add." 174 feet to the point of beginning. Containing 105.52 acres, more or less. SECTION Z, REGULATIONS FOR AN "A-3" DISTRICT: The following regulations shall apply in an A-3 District: 2.l USES PERMITTED a. Single-family dwellings. Ira b. General farming, horticulture, commercial livestock poultry production, warehousing and storage. c. Accessory buildings and uses pertinent to the permitted uses, including agricultural processing plants. d. Housing facilities (including mobile homes) to accomo-- date only agricultural employees and their families employed by the owner or operator of the premises; and provided further that such housing facility small be considered accessory to the main building and shall conform to-the provision pertaining to required yard and open space for dwellings. e. Mobile Homes to house one family when such Mobile Home is the only housing facility located on the premises, provided the following conditions are con- formed to: 1) The floor area within the Mobile Home shall not be less than five hundred (500} square feet. 2) The parcel of land conforms to Section 2.3 (minimum lot area of 5 acres}, or is a sma]ler parcel of land lawfully created prior to the enactment of this Ordinance, subject to written approval by tt~e Director of Planning. 2.2 The following uses subject to securing a use permit in each case: a. Go]f courses and country clubs. b. Publfc or quasi-public uses including churches, houses, hospitals and clinics, parks and playgrounds, :~~ x; -2- 1 schools, public utility buildings and professional 2 buildings. 3 c. Hunting and fishing camps and gun clubs when located 4 on sites of not less than five {5) acres, providing 5 that said hunting and fishing camps and gun clubs e shall conform to the provisions of the California 7 Administrative Code {Title 25), Division 4. Tempo- 8 rary Trailer Parks. 9 2.3 MINIMUM LOT AREA REQUIRED; Minimum lot area shall not 10 be Less than five (5} acres. lI - 2.4 FRONT YARD REQUIRED: Minimum front yard shall be 12 fifty {5O) feet from the centerline of the ra~ad, except where the 13 road is classified by the County as a Federal Aid Secondary Road 14 and the minimum building setback requirement shall be fifty five 15 {55) feet from the centerline of said road. 18 2.5 SIDE YARD REQUIRED: Minimum side yard shall not be 17 less than five {5} feet. 18 SECTION 3. In compliance with the provisions of said 1g Zoning Enabling Ordinance, the same is hereby amended by adding 20 this Ordinance in full. 21 SECTION 4. The penalties for the violation of the zoning 22 hereby imposed within the district shall be as provided in the 23 Zoning Enabling Ordinance. In compliance with tl~e provisions of 24 the Zoning Enabling Ordinance, this Ordinance shall from and after 25 its effective date became a supplement ta.and part of the Zoning 26 Enabling Ordinance. -3- a: "~,r~ ., t... 1 SECTION 5. A declaration of the facts 5 constituting the necessity therefore is as follows: 6 The adoption of such Interim zoning Plan is necessary in' 7 the public interest. to maintain the status quo in such district 8 pending the determination of the application for such permanent 9 detail zoning. ?~ SECTION 6.
