HomeMy WebLinkAbout1287ORDINANCE N0. 1287 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "C--C" (COMMUNITY COMMERCIAL) l DISTRICT, AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS. 2' 3 The Board of Supervisors of the County of Butte, State of ~ California, under and pursuant to Ordinance No. 475, as amended, 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. The hereinafter described area situate in the 7 County of Butte, State of California, shall be zoned a "C-C" 8 (Community Commercial) District and subject to all of the restrict 9 uses applicable to a "C~-C" (Community Commercial) District, said 10 area so zoned being located in the unincorporated area of Chico, 11 California, particularly described as: 12 A portion of Lot 12 as shown on that certain map entitled, "Revised Map of the Twelfth Subdivision 13 of the John Bidwell Rancho", which map was recorded in the office of the Recorder of the County of Butt, 14 State of California, in Map Book 6 at page 11, more particularly described as follows: 15 Beginning at a point on the South line of said Lot 16 12, distant East 20.00 feet from the Southwest corner thereof; thence North 164.55 feet to a 17 point on the North line of the South half of the South half of said Lot 12; thence along said North 18 line, East 155.00 feet; thence South 164.55 feet to the South line of said Lot 12; thence along 19 said South line, West 155.00 feet to the place of beginning. 20 SECTION 2. REGULATIONS FOR "C-C" DISTRICTS. The 21 following regulations shall apply in all "C-C" Districts: 22 2.1 Uses permitted subject to plan approved by Planning 23 Commission. 24 a. Multiple dwellings and dwelling groups, subject to 28 the height limit, building site area, average lot width and yard 26 requirements specified for "R-3" Districts. -1- l b. Hotels, clubs and lodge halls, hospitals, sanitariums 2 and clinics. 3' c. Retail Stores and shops of alight commercial characte 4 and conducted within a building including appliances stores, banks, 5 barber shops, beauty parlors, book stores, cleaner or laundry agents 6: and launderettes, dress shops, drug stores, food stores, furniture 7 stores, millinery shops, professional offices, restaurants, refresh- 8 ment stands, service stations, shoe shops, storage garages, studios 9 and tailor shops, public utility commercial offices, and other use s 10 hich are of similar character to those enumerated and which will 11 of be detrimental ar obnoxious to the neighborhood in which they 12 are to be located. 13 it d. The following uses subject to securing a Use Permit 14 'n each case: Z5 1. All uses permitted in "R-1" and "R-2" Districts. 16 1 2. Mobile Home Parks. 17 3. Public and quasi-public uses. 18 4. Animal hospitals, auto sales, dancing academies or 19 alls, openair retail sales, theaters, pet shops, wholesale stores 20 r storage, undertaking establishments, used car sales, used or 21 econd hand goods, and other uses which are of similar character. 22 2.2 Building Height Limit: Forty-five (45) feet. 23 2.3 Minimum Lot Width required; Twenty-five (25) feet. 24 2.4 Eront Yard Required; None, except where frontage in a 25 lock is partially in an "R" District, in which case the front yard 2s hall be one-half that required in such "R" District. -2- 1 2.5 Side Yard Required: None, except where the side of a 2 lot abuts upon the side of a lot in an "R" District, in which case 3 the abutting side yard shall be not less than five (5) feet, and g except where the side yard on the street side of a corner lot abuts 5 on an "R" District, in which case the side yard on the street side g shall be one-half the corresponding front yard required in such "R" 7 Districts. g 2.6 Rear Yard Required: Twelve (12) feet, or five (5) g feet adjacent to an alley. 10 2.7 Off-street parking: Off-street parking area shall be ll approved in advance and as required by the Planning Commission. 12 2.8 Fences, screen plantings, etc; fences, screen plant- 13 ings and other obstructions shall not exceed three (3) feet in 14 height in front yards, nor six (6} feet in height in any required 15 rear or side yards. In the case of corner lots, fences, shrubs, 16 screen plantings or similax obstructions shall not exceed three 17 (3) feet in height within the sight distance area. lg SECTION 3. All uses of land within the District not lg specifically authorized and permitted under Section 2 are prohibit- 20 ed. 2I SECTION 4. Penalties for any violation of the zoning herek 22 imposed within the District shall be as provided in the Zoning 23 Ordinance, In compliance with. the provisions of the Zoning Enab- 24 ling Ordinance, this Ordinance shall from and after its effective 2g date become a supplement to and part of the Zoning Enabling 26 Ordinance. -3- 1' 10 11 12 13 14 15 16 17 18 is 20 21 22 23 24 23 26 SECTION 5. This Ordinance shall be and it is hereby declared to be in fu11 force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (15) days after its passage, this Ordinance shall be published once caith the names of the members voting for and against it, in the Chico Enterprise a newspaper published in the County of Butte, State of California.
