HomeMy WebLinkAbout1288ORDINANCE NO. 1288 AN INTERIh~ ORDINANCE ZONING A PORTION OF THE COUNTX OF BUTTE AN "S-R" (SUBURBAN RESIDENTIAL) DISTRICT. 1 The Board of Supervisors of the County of Butte, State o 2 ;California under and pursuant to Ordinance No. 475, as amended, an 3 declaring an emergency, DO ORDAIN, as follows: 4 SECTION 1. The hereinafter described area situate in th 5 County of Butte, State of California, shall be and it is hereby 6 'zoned as an "S-R" (Suburban-Residential) district for a period of 7 90 days, and such area shall be subject to the restrictions and 8''restricted uses and regulations hereinafter specified and provided 9 Said area so zoned being located in the unincorporated area of l0 Butte County near Chico, California, more particularly described 11 as follows: 12 All that property located east of the existing "A-3" District and north of Sig Chico,Creek and being south 13 and west of the fallowing described Line; Beginning at the intersection of Glenwood Avenue and Oak Way; Thence 14'' easterly along Oak Tr7ay .to the southwesterly line of lot 76 of "Bidwell 2nd Sub."; Per map recorded in map book 15 5 on page 27; Thence southeasterly along the soLlth- westerly line of lots 76, 77, 78, 79, 80 to the 18 southwest corner of lot 81; Thence S 77 36' E, 279.37 ft.; Thence south I25 ft. to Sacramento Avenue; 17 Thence east along Sacramento Avenue to Oak Lavm Avenue; Thence south along Oak Lawn Avenue and its 18 sly extension to Big Chico Creek; all maps recorded in the office of the Recorder, County of Butte, 19 State of California. 20 Excepting therefrom Assessor's Parcel numbers 43-26- $I 03 and 43-29-72. (Vistec Inc. "PA-C") 22 Containing 367 acres more or less. 23 SECTION 2 . REGULATIONS FOR AN ~': Subur'l~an~ = `,:r, RESIDENTIAL 24 DISTRICT ES-R): ~ The following regulations shall apply to an ' '~tx}?urlia~;:~:-''.. Resident- 26 ial District (S`.-R) 2.1 USES PERMITTED: 1 a. Single-family dwellings, not including tents or mobile 2 homes. 3 b. Accessory buildings pertinent to the permitted uses. 2.2 AGRTCUI,TURAL USES, EXCEPT LIVESTOCK SUB~'ECT TO THE 5 FOLLOWING REQUIREMENTS: g a. For each horse or head of cattle over one year of 7 age, one half acre, 21,780 sq. ft. g b. For each head of swine over ten {10) weeks of age, g one half acre, 21,780 sq. ft. 10 c. For each head of sheep or goats, one quarter acre, 11 10,890 sq, ft. 12 2.3 LOT AREA: 13 Minimum required area of lot per dwelling unit shall be not 14 less than 8,125 sq. ft. 15 2.4 LOT WIDTH: lg Minimum lot width shall be not less than sixty-five feet. 17 2.5 FRONT YARD: lg Minimum front yard shall be fifty (50) feet from the 19 centerline of the road except where the road is classified by the 20 County of Butte as a Federal Aid Secondary Road, the minimum 21 building setback requirement shall be fifty-five (55) feet from the 22 centerline of said road. 23 2.6 SIRE XARD: 24 Minimum side yard shall be not less than five {5) feet. 2g SECTION 3. The following uses subject to securing a Use 2g Permit in each case: a. Public and quasi-public uses, including churches. -2- 1 b. Hospitals, parks and playgrounds, schools and public 2 utility buildings. 3 SECTION 4. All uses of land within the district not 4 specifically authorized and permitted in Sections 2 and 3 are 5 prohibited. 6 SECTION 5. The penalties for the violation of the zoning 7 hereby imposed within the district shall be as provided in Section 8 15 of Ordinance No. 475. In compliance with the provisions of the 9 Zoning Enabling Ordinance, this ordinance shall from and after its 10 effective date become a supplement to and part of the Zoning 11 Enabling Ordinance. 12 SECTION 6. This urgency ordinance shall take effect 13 immediately upon its passage, and before the expiration of fifteen 14 {15) days after its passage shall be published once with the names 15 of all members of the Board of Supervisors voting for and against 16 the same in the -Chico Enterprise a newspaper in general 17 circulation in the County of Butte, State of California. The facts 18 constituting the urgency on which this ordinance is based are: 19 1. The existing A=2 Zone permits uses which may be im- 20 compatible with the developed single family dwelling nature of the 2I subject area. 22 2. The Planning Commission will soon be considering a 23 etition requesting rezoning of the subject area into zoning distri 24 ore restrictive than the existing districts.. 25 3. This urgency ordinance is necessary to preserve the 26 ublic health, safety and welfare in the subject area until said ezaning to "S-R" is decided. -3- PASSED AND ADOPTED by the Board of Supervisors of the Couhty of Butte, State of California, on the 24 day of August 1972, by the following vote: AYES: Supervisors Douthit, Ladd, Maxon and Chairman Gi3.man.
