ORDINANCE NO. '1299;.
AN INTERIM ORDINANCE ZONING A PORTION OF THE
COUiVTY OF BUTTE ArT "S-2" (SUBURBAN RESIDENTIAL)
1 The Board of Supervisors of the County of Butte, State of
2 California under and pursuant to Ordinance No. 475, as amended,
3 and declaring an emergency, DO ORDAIN, as follows:
4 SECTION 1. The hereinafter described area situate in the-
6 County of Butte, State of California, shall be and it is hereby
6 zoned as an "S-2" (Suburban-Residential)~Distri:ct for a period of
? 90 days, and such area shall be subject to the restriction:

8 and restricted uses and regulations hereinafter specified and
9 provided. Said area so zoned being located near Oroville, more
10 particularly described as follows:
~1 Being portions of Section ll, 12, 13 & 14, T19N, R4E,
MDB&M. Described as:

Beginning at a point in the centerline of Olive ~iigh-
13 way said point located.500 ft. west of Ward Blvd.
intersection thence N 33°5&• W, 226.$ ft; thence
14 S 88°29' W, 650.2 ft; thence N 0°43' E,.1320 ft. more
or less to the north line of said Section l4; thence meander
16 west along said north line.to Palermo Canal; thence
1B northerly along Palermo Canal to the - ~ west
line of said Section 11; thence north along said-
~7 west line to the northwest corner of said Section li;
thence Qast along the north line of Section 11 & 12 to
~8 Canyon Drive; thence easterly along Canyon Drive to the
northeast corner of "Oroville-Wyandotte Fruitlands
~~ Unit #2" per map recorded in map book 11 on pages 11
and 12 in the Office of Butte County Recorder; said
20 corner being in the north line of said Section 12;
thence continuing east along the north line of Section
21 12 to the north quartet corner of said Section 12;
thence south along the north south centerline of said

Lot 301 of "Kelly Ridge Estates Unit #1", per map
23 recorded in map book 38 on pages 5 thx'u 10, in the
Office of Butte County Recorder; thence south easterly

#1P, to the southwest corner of Lot 104 said "Kelly
Ridge Estates Unit #1"; thence leaving said Sub. southerly
to the northeast corner of Lot 8 of "Monte Vista
2g Terrace subdivision Unit #1", per map recorded in
map book 20 on page 3; thence south along the east line

thence southerly along the east line of Lots 7 thru
2 ~1 of said Subdivision to the- southeast corner of
said Subdivision; thence continuing south parallel
3 with and 2513 ft. east of the centerline of Riverview
Drive to the north line of "BallantRae Manor, Units
4 #1 & 2, per maps recorded in map boak 24 on pages
42 and 43 and book 30 on page 20; thence easterly
6 and southerly along the north and east lines of said
"Ballantrae Manor Subdivision" to the south line of
6- Section 12; .thence west-along the .south.l~.ne of said
Section 12 to Riverview Drive; .thence southerly along
`~ Riverview Drive to Olive Highway; thence westerly
along the Olive Highway to the point of beginning,

9 Excepting therefrom Assessor's Parcel No. AP 34-2~-52
(C-1 Ord. 1124}, as shown on maps on file in the
10 Office of Butte County Assessor, on the first Monday
of March, 1972.

SECTION 2, Regulations for an "S-2" District. The

l~ following regulations shall apply in an "S-2" District:
2.1 USES PERM2TTED;

a. Single-family dwellings, not including tents or

mobile homes.

b. Accessory buildings pertinent to the permitted uses.

2.2 Agricultural uses, except livestock, subject to the

19'following requirements:
20 a. For each horse or held of cattle over one year of age
21 eight thousand one hundred twenty-five {8,125) square feet.
b. For each head of swine aver ten (10) weeks of age,

2~ eight thousand one hundred twenty-five {8,125) square feet.
~ c. Far each head of sheep or goats, two thousand (2;n00)
~ square feet.
2fi 2.3 LOT AREA: Minimum required area of a lot per dwell-
ing unit shall be not less than one {1) acres.

2.4 LOT WIDTH: Minimum lot width shall be not less than
one hundred thirty (13Q} feet.
2.5 FRONT YARD: Pdinimum front yard shall be fifty (50)
feet from the centerline of the road except where the road is
classified by the County as a Federal Aid Secondary Road, the
minimum building setback requirement shall be fifty-five (55)
feet from the centerline of said road.
2.6 SIDE YARD:. Minimum side yard shall be not less- than ~,
ten (1QJ feet.
SECTION 3. The following uses subject to securing a Use
Permit in each case:
a. Public and quasi-public uses, including churches.
b. Hospitals, parks and playgrounds, schools and public
utility buildings.
SECTION 4. All uses of land within the district not
specifically authorized and permit~ed~in Sections 2 and 3 are
prohibited.
SECTION 5. In compliance with the provisions of said
Zoning Enabling Ordinance, the same is hereby amended by adding
this Ordinance in full.
SECTION 6. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in the
Zoning Enabling Ordinance. In compliance with the provisions of
the Zoning Enabling Ordinance, this Ordinance shah. from and.after
its effective date become a supplement to and part of the Zoning
Enabling Ordinance.

SECTION 7. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
(l5} days after its passage shall be published once with the names
of all members of the Board of Supervisors voting for and against
the same in the Oroville Merc.ur~,rL,_ __ ._, a newspaper
in general circulation in the County of. Butte, Mate of California.
-The facts constituting the urgency on which this Ordinance is
based are:
].. The existing A-R bone permits uses which may be
imcompatible with the developed sing~.e family dwelling nature of
.the subject area.
2. The Planning Co~+mission is considering a petition
requesting rezoning of the subject area into zoning districts more
restrictive than the existing districts..
3. This urgency ordinance is necessary to preserve the
public health, safety and welfare in the subject area until said
rezoning to "S-2" is decided.
