The Board of Supervisors hereby determines that projects of the following types Qrima:....facie do not have a significant effect on the environment: to Repair, modification or construction of single family and two family residences and their accessory buildingso 2. Installation of single family mobile homes and their accessory buildings. 3. Repair, remodeling, minor modifications of or additions to existing commercial buildings and multiple family dwellings which do not alter the character or function of such buildings or dwellingso 4. Construction in areas where there has already been substantial development and where the essential municipal services, including but not limited to electricity, highways, water, sewers, police and fire protection, are available. 5o Repair, modification or construction of commercial and industrial buildings and multiple--family residences, including their accessory buildings, where the area surrounding the site of the proposed repair, modification or construction has already been developed for uses of the type proposedo Provided, however, that this sub-section shall not be applicable to major (developments such as shopping centers. 1 6. Any repair, modification or construction for 2 which encroachment, utility :or sewage disposal permits are 3 required pursuant to projects of the types delineated in items 4 1~5 aboveo 5: 7. Repair of existing sewage disposal facilities 6 for the purpose of. complying with applicable State and County 7 sewage disposal requirementso 8 8. Issuance of a building permit for a project 9 for which a use permit was obtained pursuant to the provisions of 14. this ordinanceo 11' 9. Establishment of, ar any installation, con- 12 structian or maintenance performed by, underground utility district; 13 Section 20 This urgency ordinance shall take effect ~4 immediately upon its passage, and before the expiration of fifteen 15 (l5) days after its passage shall be published once with the ~g names of all members of the Board of Supervisors voting for and 17 against the same in a newspaper of general circulation in the 18 County of Butte, State of Californian This ordinance shall 19 expire 90 days from date of adoption of Ordinance Number 1296 of 20 the County of Butte. The facts constituting the urgency on which 2I this ordinance is based are: 22 a. Ori September 21, 1972, the California Supreme 23 Court filed its decision in the case of Friends of Mammoth et al 24 vo Board o~ Supervisors of Mono County interpreting the California 25 Environmental Quality Act of~1970 to be applicable to private 28 activities for which a permit is required from a local governmental 2. ,ate 1 entity, 2: b. It had not been foreseen that the California 3 Environmental Quality Act would be interpreted in this broad 4 manner, and the effect of the dec~.sion is to suddenly cause a 5 disruption of administrative procedures for processing applications g for building permits and for other actionso 7 c, That this d~.sruption of such activities has g engendered confusion and uncerta~.nty regarding proper procedures g. to be followed in such cases and has led to lengthy delays and ~4 the disruption of normal County business and could have significant lI detrimental effect upon the economy of the County of Butte and I2 could aggravate unemployment in the said County. fully ~3 d o That such disruptions have not been /avoided by 14 the existing provisions of Ordinance 1296 and that there are 15 a backlog of applica do ns of various permits which cannot be 16 timely processed. 17 e.
