HomeMy WebLinkAbout13-018WHEREAS, Public Resources Code (PRC} Sections 42800 et seq. established the waste fire program for the State of
California and assigns responsibility for its implementation to the California Department of Resources Recycling and
Recovery (CalRecycle}; and
WHEREAS, PRC Section 42889(e) allows the California Department of Resources Recycling and Recovery to expend
available money in the California Tire Recycling Management Fund to pay the costs of cleanup, abatement, or other
remedial action related to the disposal of used whole tires; and
WHEREAS, procedures established by the State of California and adopted by CalRecycle require the jurisdiction-
applicant to certify by resolution the approval of the jurisdiction's governing authority for submittal of a grant application
before submission of said application to CalRecycle; and
WHEREAS, a cooperative approach with jurisdictions within Butte County, with the County acting as lead agency, for
the collection, disposal, public education and outreach for waste tires is deemed to the be an efficient and cost effective
means for local government to address the problem posed by these wastes; and
WHEREAS, if awarded, the applicant will enter into a Grant Agreement with the California Department of Resources
Recycling and Recovery for implementation of said grant;
NOW, THEREFORE, BE YT RESOLVED that the County of Butte authorizes the Department of Public Works to act
as Lead agency in submitting to the California Department of Resources Recycling and Recovery an application for the
Local Government Waste Tire Amnesty Grant Program - FY 2013114 (TA1 Cycle) on its behalf; and
BE IT FURTHER RESOLVED that the Butte County Department of Public Works Director is hereby authorized and
empowered to execute all grant documents necessary to secure grant funds and implement the approved grant project; and
BE IT FURTHER RESOLVED that this authorization is effective for the Waste Tire Amnesty Grant (TA1) with a term
from receipt of the Notice to Proceed until the end of the grant reporting term, September 30, 2015.
PASSED AND ADOPTED by the Board of Supervisors, County of Butte, State of California, this 29'h day of January,
2013, by the following vote:
