A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS ADOPTING A NEGATIVE
DECLARATION FOR CODE AMENDMENT CA12-0001
AMENDMENT OF THE BUTTE COUNTY CODE, CHAPTERS 2,13 AND 20 TO UTILIZE A
ZONING ADMINISTRATOR AND TO BUTTE COUNTY CODE 20-133
TO ALLOW EXCEPTIONS TO CUL-DE-SAC LENGTH STANDARDS
WHEREAS, the Board of Supervisors directed staff to prepare amendments to Butte County Code to
enable a Zoning Administrator consistent with Butte County General Plan Policy LU-P5.1 in order to streamline
County permit processes; and
WHEREAS, staff prepared amendments to Butte County Code Chapters 2, 13, and 20 as directed in
consultation with Butte County Public Works, Butte County FirelCalFire, County Counsel, and other affected
agencies and individuals; and
WHEREAS, the Planning Commission considered CA12-0001 on December 13, 2012, supported
proposed amendments to Butte County Code to enable a Zoning Administrator, and supported an additional
amendment to BCC section 20-133 to allow exceptions to cul-de-sac length standards with approval of Butte
County FirelCalFire, generally consistent with CalFire (State) standards for exceptions to cul-de-sac standards;
and
WHEREAS, the Board of Supervisors has considered Code Amendment CA12-0001 and a Negative
Declaration prepared for the project in accordance with the California Environmental Quality Act (CEQA}; and
WHEREAS, said code amendments were referred to various affected public and private agencies,
County departments, and referral agencies for review and comments, including review by the County's `Users'
Group' which supported the proposed amendments; and
WHEREAS, a duly noticed public hearing was held on February 26, 2013, and the Board of Supervisors
has considered public comments, the recommendation of the Planning Commission, and a report from the
Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors take the following actions:
I. Adopts a Negative Declaration with the following findings:
A. An Initial Study was completed in compliance with the California Environmental Quality Act.
Said study identified no significant environmental effects.
B. The Board of Supervisors has considered the Negative Declaration, together with comments
received during the review process.
C. On the basis of the whole record before the Board of Supervisors, including the Initial Study and
any comments received, there is no substantial evidence that the Code Amendment CA12-0001,
would have a significant impact on the environment. The custodian of the record is the
Department of Development Services. The location of the record is 7 County Center Drive,
Oroville CA 95965.
D. The Negative Declaration reflects the independent judgment and analysis of Butte County, which
is the Lead Agency.
II. Finds that the collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is
required prior to filing a Notice of Determination for the project, unless verification from the California
Department of Fish and Game is provided that the project is exempt from the fee requirement. If a
required fee is not paid far the project, the project will not be operative, vested or final and any local
permits issued for the project will be invalid {Section 711.4 (c) (3)).
PASSED AND ADOPTED by the Butte County Board of Supervisars this 12~' day of March, 2013 by the
following vote:
