COUNTY OF BUTTE AN "A-3 " (AG'tiICULTURAL) DISTRICT .
L ~ The Board of Supervisors of the County of Butte, State
2 of California under and pursuant to Ordinance No. 475, as emended,
3 and declaring an emergency, DO ORDAIN, as follows:
4 SECTION 1. The hereinafter described area situate in the
6: County of Butte,5tate of California, shall be and it i~ hereby
6 zoned as an "A-3" (Agricultural) District for a period of 90
7 days, and such area shall be subject to the restrictions and
$ restrictec'~ uses and regulations hereinafter specified and provided.
9 Said area so zoned being located in the unincarparatecl area of
10 Butte County at Durham, California, more particularly described
~~ as follo~,rs
~2 Parcel Generally located at the 'down of Durham. Beginning at
1 the intersection of Durham-Chico ~~ighway and the center-
~~ line of the Southern Pacific Railroad right-of~-way;
thence southerly along centerline of said right--of--
14 way to its intersection with Hanlon Road; thence west
along Hanlon Road and its extension to the south
~5 quarter corner of Section. 36,T21N, R1E; thence
16 north along the section centerline of said Section 36
and Section 25, T2IN, RIE, to Durham-Chico Highway;
17 thence north and east along Durham-Chico Highcray to
the paint of beginning. .
18 Containing 1,200 acres, more or less.

Lot 88 to its southeast corner; also being on
the west line of Lot 76,Durham State Land Settle-
ment; thence south along the nest line of Lot 76
to its southwest corner;also being on the north
line of the Durham--Oroville T-Tighway; thence west
along the north line of Durham-Orova.lle ~Iighway
to its intersection with the east line of Lott
Road; thence north along the east line of Lott
??oad to the point of beginning. Containing
191 acres, more or less.
SECTION 2. REGULATIONS EOP. AN "A-3" DISTRICT;
~;-The following regulations shall apply in an "A-3" District;
2.1 USES PEpMITTED:
a. Single-family dwellings.
b. General .farming, horticulture, commercial livestock,
I~poultry production, warehousing and storage.
c. Accessory buildings and uses pertinent to the
,permitted uses, including agricultural processing plants.
d. Housing facilities {including mobile homes) to
accommodate only agricultural employees and their families employ-
e:ed by the owner or operator of the premises; and provided further
that such housing facility shall be considered accessory to the
main building and shall conform to the provision t~ertaining to
the required yard and open space for d.~rellings.
e, n~tobile Homes to house one family when such mobile
.home is the only housing facility located on the premises, provid--I
`ed the following conditions are conformed to:
1. The floor area within the mobile home shall not be
less than five hundred (500) square feet.

2. The parcel of land conforms to Section 2.3 (minimum
lot area of_ 5 acres), or is a smaller parcel of land lawfully
`created prior to the enactment of this Ordinance, subject to
written approval by the Director of Planning.

a. Golf Courses and country clubs.
b. Public or quasi-public uses including churches, fire
'houses, hospitals, and clinics, parks and playgrounds, schools,
public utility buildings and professional buildings.
c. Hunting and fishing camps, including those which
'accommodate recreational vehicles and travel trailers, and gun
clubs; when located on sites of not less than five (5} acres.
2.3 ~'f1INIMU~~I I~OT AREA REQUIRED
'~inimum lot area shall not be less than five (S) acres.
2.4 FRONT YARD REQUIRED:
~?inimum front yard shall be fifty (50) feet from the centerline
of the road, except where the road is classified by the County
as a Federal Aid Secondary Road and the minimum building setback
requirement shah. be fifty--five (5S) feet from the centerline of
said road.
2.5 SIDE YARD REQUIRED:
Minimum side yard shall not be less than five (5) feet.
SECTION 3. All uses of land within the distract not
specifically authorized and permitted in Sections 2 and 3 are
prohibited.

1 SECTIONS 4: The penalties for the violation of the zoning
2 hereby imposed within the district shall be as provided in Section
3 !l5 of Ordinance r1o. 475. In compliance with the provisions of the
4 ':Zoning Enabling Ordinance, this ordinance shall from and after its
6 effective date become a supplement to and part of the Zoning
6 `Enabling Ordinance.
7: SECTION 5. This urgency ordinance shall take effect
S~~iznmediately upon its passage, and before the expiration of fifteen.
9 (15) days after its passage shall be published once with the names
1Q of all members of the Board of Supervisors voting for and against
11 the same in the , a ne~•rspaper in
12 ,general circulation in the County of Butte, State of California.
13 The facts constituting the urgency on which this ordinance is
14 based are;
16 ~.. The existing A-2 Zone permits uses which may be
lg incompatible with the developed single family dwelling nature of
17~the subject area.
18 2. The Planning Contmissian wi11 soon be considering a
19 petition requesting rezoning of the subject area into zoning
2D districts more restrictive than the existing districts.
21: 3. This urgency ordinance is necessary to preserve the
~ public health, safety and welfare in the subject area until said
23- rezoning is decided.
