HomeMy WebLinkAbout13-076WHEREAS, Assembly Bill 720 amended sections 22031, 22032, and 22034 of the Public Contract Cade; and
WHEREAS, on January 1, 2013, Assembly Bil! 720 went into effect; and
WHEREAS, section 22031 te) requires that the Board of Supervisors or County Road Commissioner declare its
intention to use the authority set forth in section 22031{bJ(2) prior to commencing work; and
WHEREAS, in 1999 Butte County was a signatory to the California Uniform Public Construction Cost Accounting
Act; and
WHEREAS, Butte County Public Works provides capital project delivery support in the form of design, surveying,
construction management, inspection and material testing with County forces as Force Account work on all Capital
improvement Projects regardless of whether the construction work is performed by County forces or private
contractors; and
WHEREAS, in a letter dated September 2, 2011, to Mr. E. Dotson Wilson, Assembly Member Hall stated, "In
authoring AB 720, it is not my intent to restrict county force account work necessary to facilitate capital projects far the
purposes of contracting to the private sector. This would typically include design, engineering, inspection, testing, and
other force account work necessary to administer private contracts"; and
WHEREAS, Butte County does not anticipate that any projects will utilize County forces to perform construction
work an new road construction or road reconstruction, but, since capital project delivery support costs and construction
casts are aggregated in the same category by the State Controller, and it is not clear whether a declaration needs to be
made solely far the use of County forces providing capital project delivery support, the Butte County Board of
Supervisors makes the declaration set Earth below.
IVOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors:
1. Declares its intent to utilize its authority under Public Contract Code section 22031{b)(2J to perform force
account work far capital project delivery support, and, if construction work is to be performed by County
forces, a project specific declaration shall be made prior to commencing work.
2. Approves the use of County forces to perform construction services not to exceed 30 percent of the total
value of all work performed by force account other than maintenance and emergency work for new road
construction and road reconstruction as allowed under Public Contract Code section 22031{b)(2) subject to a
subsequent project specific declaration.

3. Approves the use of County forces to perform capital project delivery support work performed by force
account, such as design, surveying, construction management, engineering, inspection, material testing, and
other force account work needed to administer private contracts, which should not be included in the 30
percent farce account limit, as indicated in Assembly Member Hall's letter.
