WHEREAS, this Board has received a request far vacation of a portion of a drainage easement as described
below; and
WHEREAS, the Planning Commission has considered this vacation, and found the request consistent with the
Butte County General Plan, and
WHEREA5, this Board initiates a proceeding to vacate a portion of a drainage easement as described in the
attached Exhibit A and shown on the attached Exhibit B; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and Highways Code (commencing
with Section 8320) this Board shall set a date, hour and place for a hearing on the request for vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That this Board hereby gives notice that at its regular meeting nn June 11, 2013, at 9:50 a.m., in the Board
Chambers, Butte County Administration Building, 25 County Center Drive, Oroville California, a hearing shall be
held to hear ail persons interested in the vacation of that certain portion of a drainage easement along the
western boundary of the Sierra Moon Subdivision between Keefer Slough and Mud Creek in north Chico, County
of Butte, State of California, mare particularly described in the attached Exhibit A, and shown on the attached
Exhibit B.
2. That a map showing the portion of the drainage easement to be vacated is on file in the Office of the Butte
County Department of Public Works, 7 County Center Drive, Oroville, California 95965.
3. That at the conclusion of said hearing the Board intends to vacate a portion of said drainage easement.
4. That this vacation proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9 ofithe Califiornia
Streets and Highways Code (commencing with Section 8320J.
5. That this Resolution be posted and published pursuant to the provisions of Chapter 3 of Part 3 of Division 9 of
the California Streets and Highways Code.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 21St day of May by the following vote:
AYES: 5uperr-isors Wahl, Kirk, Lambert, Teeter and Chair Connelly
