RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND ENTER INTO
AGREEMENTS FOR THE ACQUISITION OF REAL PROPERTY FOR PUBLIC ROAD PURPOSES, AGREEMENTS FOR
TEMPORARY CONSTRUCTION EASEMENTS, AND PERMITS TO ENTER AND CONSTRUCT IMPROVEMENTS FOR
OWNERS BENEFIT FOR THE LINCOLN BOULEVARD SIDEWALK IMPROVEMENT PROJECT FROM 100 FEET
SOUTH OF ARNOLD AVENUE TO 50 FEET NORTH OF IDORA STREET, FEDERAL HIGHWAY SAFETY
IMPROVEMENT PROGRAM PROJECT HSIPL-5912087)
WHEREAS, the Butte County Department of Public Works is charged with the responsibility for
studying, recammending, constructing, and maintaining improvements within the system of County of Butte
roadways; and
WHEREAS, the County of Butte and the Department of FubIic Works has pursued and been awarded
grant funding programmed through the Federal Highway Administration (FHWA) Highway Safety
Improvement Program {HSIP) authorized by Congress through SAFETEA LU and as overseen by delegated
authority to the State of California Department of Transportation (Caltrans) for a proposed project to install
curb, gutter, sidewalk, tie-in pavement, illuminated pedestrian crossings, and associated storm drainage
improvements on the east side of Lincoln Boulevard from 100 feet south of Arnold Avenue to 150 feet north of
Elgin Street; and
WHEREAS, the Lincoln Boulevard Sidewalk Improvement Project for construction of said curb, gutter,
sidewalk, tie-in pavement, illuminated pedestrian crossings, and associated storm drainage improvements
together with asphalt overlay and restriping of that segment of Lincoln Boulevard appears on the County of
Butte Capital Improvement Project (CIP) List, as approved by the Butte County Board of Supervisors; and
WHEREAS, the Butte County Board of Supervisors shall be required to enter into a project agreement
with Caltrans and the FHWA to be eligible to participate in reimbursement through the Highway Safety
Improvement {HSIP} for the construction of said curb, gutter, sidewalk, tie-in pavement, illuminated pedestrian
crossings, and associated storm drainage improvements; and
WHEREAS, the project agreement requires that the County of Butte complete and certify all right of
way and easement acquisitions necessary to deliver right of way certification to Caltrans to construct the
project; and
WHEREAS, the Butte County Department of Public Works has obtained environmental clearance for
the project as required under the California Environmental Quality Act (CEQA) and National Environmental
Policy Act (NEPA) Guidelines; and
WHEREAS, a portion of the north end of the Lincoln Boulevard Sidewalk Improvement Project limits
from Idora Street to 150 feet north of Elgin Street was subsequently annexed to the City of Oroville and
relinquished from Butte County control, such that the limits of the Lincoln Boulevard Sidewalk Improvement
Project for construction of said curb, gutter, sidewalk, tie-in pavement, illuminated pedestrian crossings, and
associated storm drainage improvements has been reduced from 100 feet south of Arnold Avenue to 50 feet
north of Idora Street.
NOW THEREFORE. BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State
of California, in order to complete the delivery of the right of way certification to Caltrans, authorizes the
Director of Public Works to negotiate and sign the agreements for Acquisition of Real Property for Road
Purposes, Agreements for Temporary Construction Easements, and Permit to Enter and Construct
Improvements for Owners Benefit for the Lincoln Boulevard Sidewalk Improvement Project from 100 feet
south of Arnold Avenue to 50 feet north of Idora Street, Federal Highway Safety Improvement Program Project

10th day of September, 2013, by the following vote:
