O~ ~ Ups, +°° A y}~ ~~ Vim. • ~~~~ 4~~0 ~oQ: ': ~e • ., i * ~a ~ :, ~ ~. re~~g~,a8 ~ IJ N ~~ ~'~~ COUNTY OF BUTTE, STATE OF CAL.IFORNiA Resolution No. 13-164 RESOLUTION RATIFYING ACCEPTANCE OF HEALTH REALIGNMENT FUNDING SHIFT PER WELFARE AND INSTITUTIONS CODE SECTION 17600.50(a) WHEREAS, Butte County participates in the County Medical Services Program ("CMSP") which provides health care coverage to low-income adults in 35 rural and semi-rural counties; and WHEREAS, Welfare and Institutions Code Section 17600.50(a) was enacted as part of the Realignment Trailer Bills to the FY 2013-14 State Budget which will reduce overall funding for CMSP beginning January 2014 resulting from the loss of State Health Realignment funding (composed of State Sales Tax and Vehicle License Fee revenues) for CMSP; and WHEREAS, Section 17600.50(a) effectively protects County Health Realignment funding for local purposes and limits each CMSP County's Health Realignment contribution to the State to the amount the County would otherwise pay to participate in CMSP, and provides funding to CMSP to assist in providing services for the remaining uninsured; and WHEREAS, the County Medical Services Program Governing Board ("Governing Board") adopted a resolution confirming acceptance for the approach set forth in Section 17600.50(a) in determining payments to the Family Support Services Subaccount attached as Exhibit A ("CMSP Resolution"); and WHEREAS, the County believes it is in the best interest of the County, CMSP and the other counties participating in CMSP to confirm acceptance for the approach set forth in Section 17600.50(a) in determining payments to the Family Support Services Subaccount, and ratify the actions taken by the Governing Board in the CMSP Resolution; and NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors does hereby resolve the following actions: 1. Approve of the approach set forth in Section 17600.50(a) in determining payments to the Family Support Services Subaccount; 2. Approve and ratifies the actions of the Governing Board in the CMSP Resolution; 3. Authorizes the Public Health Director of Butte County to provide a copy of this Resolution to the Governing Board and the Director of the California Department of Finance. PASSED AND ADOPTED by the Butte County Board of Supervisors this 5t" day of November, 2013 by the following vote: AYES: Supervisors Wahl, Kirk, Lambert, Teeter and Chair Connelly NOfS: None ABSENT: None NOT VOTING: None .„~ ~r~~ ~°" f ATTEST: ~' Paul Hahn, Chf f Adr~l~inistrative Off er and Clerk of the hoard of Supervisors ~ ~~_~L~° BILL CONNELLY, Chair Butte County Board of Supervisors EXHIBIT A -CMSP RESOLUTION COUNTY MEDICAL SERVICES PROGRAM GOVERNING BOARD RESOLUTION 2013-1 WHEREAS, the County Medical Services Progranz ("CMSP" or the "Program") provides health care coverage to low-income adults in 35 rural and semi-rural counties; and WHEREAS, the County Medical Services Program Governing Board {"Governing Board"} provides policy direction for the Program and, as part of its responsibility, the Governing Board sets beneficiary eligibility requirements, determines the scope of covered health care benefits, establishes the payment rates paid to health care providers participating in t11e Progranl, and approves the establishment of Pilot Projects such as Path2Health, a Low Income Health Program; and WHEREAS, the Governing, Board has received funding from counties participatuzg in CMSP, funds allocated to .CMSP from State Health Realignment revenues, and, with regard to Path2Health, federal Medicaid matching funds, but the autliarity for Patlz2Healtlz and the associated federal Medicaid matching funds expire December 31, 2013; and WHEREAS, the State legislature adopted the Realignment Trailer Bills to the FY 2013- 14 State Budget which will reduce overall funding for CMSP beginning 3anuary 2014 resulting from the loss of State Health Realignment fiinding (composed of State Sales Tax and Vehicle License Fee revenues) for CMSP; and WHEREAS, as part of the Realignment Trailer Bills, Welfare and Institutions Cade Section 17600.50{a) was enacted as follows: (a} A county t11at participated ul the Comity Medical Services Program iri the 2011-12 fiscal year, including the Counties of Alpine, Amador, Butte, Calaveras, Colusa, Del Norte, El Dorado,, Glenn, Humboldt, Imperial, Inya, Kings, Lake, Lassen, Madera, Morin, Mariposa, Mendocino, Modoc, Mono, Napa, Nevada, Plumes, San Benito, Shasta, Sierra, Siskiyou, Solano, Sonoma, Sutter, Telzanza, Trinity, Tuolumne, and Yuba and the Governing Board of the County Medical Services Program, shall adapt resolutions by December 4, 2013, that confirm acceptance far the following approach to deternzining payments to the Family Support Services Subaccaunt: (1} The amount of payments to the Family Support Services Subaccozint shall be equal to b0 percent of the su-n of the following: (A} The 1991 health realignment funds that. would have otherwise been allocated to the counties listed above pursua~zt to Sections 17603, 17604, 17606.10, and 17606.20 and the maintenance of effort in subdivision (a) of Section 17608. l 0 far these counties, as those sectioxzs read on January 1, 2012. 82444.00000\825094I.3 (B.) The 1991 lxealtlx realignnxent funds that would have otherwise been allocated to the County Medical Services Program pursuant to Sections 17603, 17604, 17605.07, and 1760G.20, as those sections read on 3azxuary 1, 2012. 2} Tlxe paymelxt computed in paragraph (1 }shall be achieved through the following: (A) Each county listed in subdivision (a) shall pay the anxounts otherwise payable to the Cowxty Medics! Services Pragrazn pursuant to subparagraph (B} of paragraph (2) of. subdivision ({) of Section 16809 to the Family Support Services Subaccount. (B} The County Medical Services Progranx shall pay the difference betweezx tlxe total computed in paragraph (1) and the anxount calculated in subparagraph (A) fi•ozn funds provided pursuant to the Welfare and Institutions Code. WHEREAS, Section I7600.50(a) effectively protects County Health Realignment funding for local purposes and limits each CMSP County's Health Realignment contribution to the State to the amount the County would otherwise pay to participate in CMSP, and provides funding to CMSP to assist in providing services for the remaining unilxsured; and WHEREAS, Section 17600.50(a) requires the Govcrzxizxg Board to adopt a resolution confirming acceptance for the approach set forth in Section 17G00.50(a) in determining payments to the Family Support Services Subaccount; and WHEREAS, tlxe Governing Board believes it is izx tlxe best interest of the Program and counties participating in CMSP to confirnx acceptance for tlxe approach set forth in Section 17G00.50(a} in deterizxizxing payments to the Family Support Services Subaccount; and NOW, THEREFORE, the County Medical Services Program Governing Board does lxereby resolve that: 1. The Governing Board approves of the approach set forth in Section 17GOO.SO(a) in determining payments to the Family Support Services Subaccount; 2. The Governing Board approves and ratifies tlxe actions of the Director of Policy & Planning and the Director of Finance & Adnxinistration and the staff of the Governing Board lxeretofore taken which are in conformity with the intent and purposes of these resolutions; ;. The Govezzxizxg Board authorizes tlxe Director of Policy & Planning and the Director of Finance & Adzninistxation of the Governing Board to implement and take such action on belxalf of the Governing Board as such individuals znay determine to be necessary or desirable, witlx advice of legal counsel, to caxry out all actions authorized by the Governing Board in tlxis Resolution; and 4.
