HomeMy WebLinkAbout1318Ordinance No. 133.8 AN ORDINANCE AMENDING CERTAIN SECTIONS OF ARTICLE VI, OF CHAPER 2 OF THE BUTTE COUNTY CODE PERTAINING TO THE PERSONNEL AND MERIT SYSTEM 1. 2; 3 4 5 6 7 8' 9 10 11 12 i3; 14 15 16 17' 18 19 20 21 22 23 24 25' 26 The Board of Supervisors of the County of Butte, State of California, DO ORDAIN as follows: The following amendments are made to Article VI of Chapter 2 of the Butte County Code: I. Section 2-31 of the Butte County Code, enacted by Section 6 of Ordinance No. 729, is amended to read as follows: Section 2-31p Salary ranges and rates. A11 classes of positions in the classification plan shalt be assigned a salary range or rate as provided for by a salary ordinance. Employees appointed to positions in the classification plan shall be paid a salary within the range or rate so provided for"in the salary ordinance and according to the procedures established by the personnel resolution provided for by section 2-28, II. Section 2-33 of the Butte County Code, enacted by Section 8 of Ordinance No. 729, and amended by Ordinance No. 1098, is amended to read as follows: Section 2-33o Probationary and Permanent Status of em Appointed•.department heads shall hold their position fay a term of office as provided by law or ~at the pleasure of the board of supervisors, as the case may be, as set forth in the personnel resolutiono Except for employees holding an exempt :::~ position as prescribed in section 2-32 and an employee appointed to the classification of deputy sheriff, any other employee appointed to 'a position in the classified service who successfu ly completes a probationary period of six (6) months following his i 1 appointment shall have permanent status. An employee appointed 2 to the classification of deputy sheriff who successfully completes 3 a probationary period of twelve (12) months following his 4 appointment shall have permanent status. A permanent employee 5 who is promoted to a more responsible position and who successfull 6 completes a probationary period of six (6) months in the new T position shall have permanent status in the new position except S that an employee promoted to the position of deputy sheriff must 9 successfully complete a probationary period of twelve:::(12) months 10' before gaining permanent status in the new positiono The status 11 of employees regulated by Federal grant-in-aid programs shall be 12 as prescribed by the personnel resolution and by the rules of the 13 Inter-Agency Merit System Division, State Personnel Board of the 14 State of California, 15 III. Section 2-35 of the Butte County Code, enacted by 16 Section 10 of Ordinance No. 729, is amended to read as follows: 17 Section 2-35. Dischar a and Disci linar Action. 18 An employee with permanent status may be discharged, _ 19 demoted or suspended only for reasonable cause. When a 20 department head believes reasonable cause exists he shall give 2I the employee a written notice specifying the disciplinary action 22 to be taken, the effective date and the reason for the action. 2~ IV. Section:2-36 of the Butte County Code, enacted by 24 Section 11 of Ordinance 729 and amended by Ordinance Noo 816, is 25 amended to read as follows: 26 ...a 2a . 6 '7 8 9 IO I1 12 I3 14 15 ~6 17 18 19 20 Section 2-36, Appeals Commission. At the beginning of each fiscal year the Board of Supervisors shall appoint an appeals commission consisting of three persons, The commission shall hear employee grievances and hear appeals from discharge, demotion or suspension which may be filed by an employee who has permanent status, When an appeal is filed, the commission shall conduct a hearing as provided by the personnel resolution. The commission shall establish procedur governing the hearings. Following the hearing the commission shall make a finding regarding the existence of cause and recommendations regarding appropriate action. The commission's findings and recommendations shall be a matter of public record. Any action of the appeals commission shall be final and not subjec to judicial review.
