HomeMy WebLinkAbout1325Ordir ice No. 1325 AN ORDINANCE PURSUANT TO REVENUE AND TAXATION CODE §15501 REGARDING REASSESSMENT OF PROPERTY DESTROYED BY MAJOR MISFORTUNE OR CALAMITY __.__.. 1 The Board of Supervisors of the County of Butte DO 2 ORDAIN as follows: 3 1. This ordinance is adopted pursuant to the provisions 4 of §155.1 of the Revenue and Taxation Code and Section 2:8 of 5 Article 13 of the California Constitution. In that Butte County e sustained severe damage due to inordinately low temperatures 7 during the month of December, 1972, which low and freeing 8 temperatures caused severe damage to both orchards and crops, th 9 Governor has been requested to declare this area to be in a stat 10 of disastero This ordinance shall become operative only in the 11 event that the Governor declares this County to be in a state of 12 disaster. 13 2. Every person who at 12:01 a.m. on March 1, 1972 was 14 the owner of, or had in his possession, or under his control, 15 any taxable property, or who acquired such property after such 18 date and is liable for the taxes thereon for the fiscal year of 17 1972-73,and which property was thereafter damaged or destroyed, 18 without his fault, by a major misfortune or calamity, if such 19 property was damaged or destroyed by the major misfortune or 20 calamity which caused the Governor to proclaim the area or regio. 21 to be in a state of disaster, may between June 1, 1973 anal June 22 1973 apply for reassessment of such property by delivering to th 23 assessor a written application showing the condition and value, 24 if any, of the property immediately after the damage or destruc- 26 tion which damage must be shown therein to be in excess of 28 $1,000. 1 2 3 4 5 e 7 8 9 10 11 12 13 14 15 16 17 18 19 20 2i 22 23 24 25 28 The application shall be executed under penalty of perjury, or if executed outside the State of California verified by affidavit. 3. The application shall be duly processed by the assessor pursuant to Revenue and Taxation Code §155,1 and the applicant may appeal any such determination by the assessor pursuant to the aforementioned Revenue and Taxation Code seetiono 4. NELSON, County Clerk and ex-officio Clerk of the Board By--~~ ~ ~`G~ 20 PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY AND REQUESTING GOVERNOR TO PROCLAIM A STATE OF EMERGENCY WHEREAS, Ordinance No. 1323 of the County of Butte empowers the Board of Supervisors to proclaim the existence or threatened existence of a local emergency when said County is affected or likely to be affected by a public calamity; and WHEREAS, said Board of Supervisors does hereby find that conditions of extreme peril to life and property have arisen within said County caused by heavy freezing and extreme weather conditions commencing on the 5th day of December, 1972; and WHEREAS, the aforesaid conditions necessitate the proclama- Lion of the existence of a local emergency; and WHEREAS, it has now been found that local resources are unable to cope with the effects of said emergency. NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said County; and IT IS FURTHER PROCLAIMED AND ORDERED that a copy of this proclamation be forwarded to the Governor of California with the request that he proclaim a state of emergency in the County of Butte for the purpose of tax relief for growers of crops affected by said freeze as outlined in Section 2.8 Article 13 of the Constitution of the State of California; and IT IS FURTHER PROCLAIMED AND ORDERED that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the .Board of Supervisors of the County of Butte, State of California; and IT IS FURTHER ORDERER that a copy of this proclamation be forwarded to the State Director of the Office of Emergency Services.
