HomeMy WebLinkAbout1335ORDINANCE Np, AN INTERIM ORDINANCE ZONING A PORTION OF TFIE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-R" (1-1GRICULTURAL- RESIDENTIAL) DISTEICT, AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF B[IILDINGS. 1 The Board .of Supervisors of the County of Butte, State of 2 California, under and pursuant to Ordinance No. 475, as amended, 3 and declaring an emergency DO ORDAIN as follows: 4 SECTION I. The hereinafter described area situate in the 6 County of Butte, State of California, shall be and it is hereby 8 zoned as an "A-R" (Agricultural-Residential) District, for a perio 7 of gp days, and such area shall be subject to the restric- 8 Lions and regulations hereinafter specified and provided. Said 9 area so zoned being located in the unincorporated area of Butte 10 County more particularly described as follows: 11 Being a portion of Section 2, T17N R2E, MDB&M, and a portion of "Gridley Colony No. 9", per map on record 12 in Map Boak 9 an page 58 in the office of the Butte County Recorder, particularly described as: 13 All of Lots 2, 3, 4, 5, 6, 7, 8 and 9 of said 14 "Gridley Colony IVa. 9" and 15 All of Lot 1 of said "Gridley CoTany No. 9" excepting therefrom that portion of said Lot 1 lying north and 18 east of the following described line: Commencing at the northwest corner of said Lot 1; thence north 89° 17 50' east a distance of 210 ft., along the south right of way line of Gridley-Colusa Highway to the point 18 of beginning; thence south 05° 16' east, a distance of 397.5 ft; thence north 89° 21' east, a distance 19 of 123 ft; thence south 35 ft. to the south line of the Biggs-West Gridley Water District right of way; 20 thence east along the south line of said Biggs-West Gridley right of way 800 ft. more or less to the 21 centerline of Lot 1 of said "Gridley Colony Na. 9" said centerline of Lot 1 also being the Gridley City 22 Limits; thence south and east along Gridley City Limits line to Randolph Ave. 23 24 Alsa, the west half of the northwest quarter of Sec 2 T17N R2E, MDB&M ~ Containing 175 acres, more or less. 28 SECTION 2. REGULATIONS FOR AN "A R" DISTRICT: The following regulations shall apply in an "A-R" District 1 2:1 USES PERMITTED: 2 a. Single-family dwellings, not including tents or 3 trailers. 4 b. Accessory buildings pertinent to the permitted uses. ~ c. Agricultural uses. 8 d. Livestock, subject to requirements as follows: 7 1. Minimum lot area to be devoted to residential 8 use shall be not less than eight thousand one 9 hundred twenty-five (8,125} square feet. 10 2. Exclusive of the area devoted to the residential 11 use, the following lot or parcel area shall be 12 required for each animal raised or kept on the 13 premises: 14 a. Far each horse or head of cattle over one (1) 15 year of age--eight thousand one hundred 16 twenty-five (8,125) square feet. 17 b. For each head of swine over ten (10) weeks 18 of age--eight thousand one hundred twenty- ~'~ five (8,125) square feet. 20 c. For each head of sheep or goats--two thousand 21 (2,000) square feet. 22 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 23 N EACH CASE: 24 a. Duplex dwellings and multiple-family dwellings. 2b b. Golf courses, country clubs - if permitted, would 28 permit accessory uses such as drivngr range, pro -2- 1 shop, cocktail bar, restaurant. 2 c. Public and quasi-public uses including churches, 3 firehouses, hospitals, parks and playgrounds, schools 4 and public utility buildings. 5 d. Commercial poultry farming and livestock farming. 8 e. Veterinary clinics, outpatient. 7 f. Nurseries and plant gardens. $ 2.3 LOT AREA REQUIRED: Minimum required area of a lot 9 per dwelling unit shall be not less than eight thousand one hundrec 10 twenty-five (8,125) square feet. 11 2.4 LOT WIDTH REQUIRED: Mimumun lot width shall not be 12 less than sixty-five (65) feet. 13 2.5 FRONT YARD REQUIRED: Minimum front yard shall be 14 fifty (50) feet from the centerline of the road, except where the 15 road is classified by the County as a Federal Aid Secondary Road, 18 the minimum building setback requirement shall be fifty-five (55) 17 feet from the centerline of the road. 18 2.6 SIDE YARD REQUIREMENTS: minimum side yard shall not 19 be less than five (5) feet. 20 SECTION 3. In compliance with the provisions of said 21 Zoning Enabling-Ordinance, the same is hereby amended by adding 22 this Ordinance in full, 23 SECTION 4. The penalties for the violation of the zoning hereby imposed within the District shall be as provided in the 2~ Zoning Enabling Ordinance. Tn compliance with the provisions of 28 the Zoning Enabling Ordinance, this Ordinance shall from and after -3- 1 its effective date become a supplement to and part of the Zoning 2 Enabling Ordinance. 3 SECTION 5. For the immediate preservation of the public 4 peace, health and safety of the area hereinabove described, and S the residents and inhabitants thereof, it is necessary that this 6 ordinance take effect immediately. A declaration of the facts 7 constituting the necessity therefore is as follows: $ The adoption of such Interim Zoning Plan is necessary in 9 the public interest, to maintain the status quo in such district 10 pending the determination of the application for such permanent 11 detail zoning. 12 SECTION 6. This emergency ordinance shall take effect 13 immediately upon its passage, and before the expiration of fifteen 14 (15) days after its passage shall be published once with the names 15 of all members of the Board of Supervisors voting for and against 16 the same in the fr;_d]_ey_Herald a newspaper in general 17 circulation in the County of Butte, State of California. 18 PASSED AND ADOPTED by the Board of Supervisors of the 19 County of Butte, State of California, on the ].3-~h , day of 20 1973, by the following vote: 21 AXES: Supervisors CamerAn, Gilman, Ladd, ~a.digan and Chairman McKi:l; 22 NOES: None 23 ABSENT: None 24 C._S~~- ACK McKILLOP, airman ~ utte County Board of Supervisor_ ATTEST: 28 CLARK A.
