The Board of Supervisors of the County of Butte DO
ORDAIN as follows:
Section ~.. Findings and Intent . Whereas, the Board
of Supervisors of Butte County do hereby find that for the
health, safety and welfare of the people of this County that
it has often become necessary; for the care of persons who by
.reason of old age, disease (either mental or physical), inf irmity
or other cause, are unable, unassisted, properly to manage and
take care of themselves or would benefit from familial assistance,
to allow mobile homes to be placed on smaller parcels than present
County codes or ordinances permit so that such persons will not
have to be institutionalized but rather can reside near their
close relatives who can help care for them. The ability to
care for one's close relative will not only result in better
care for many of our citizens, but will also negate in many
~Isituations the necessity for public assistance which many of our
citizens find degrading and damaging to the pride of the person
concerned and their immediate relatives. This will also provide
privacy and dignity for the relative, as well as independence of
(which these people are deservingo
Section:-2. That the Butte County Code is hereby amended
by adding thereto Section 19--190
Section l9`~19. A variance may be. granted to any
of the provisions of Sections 19-10 and 19-12 of this chapter
by the Board of Supervisors. Anyone applying for variance to
this chapter shah petition therefor directly to the Board of
2' Supervisors, and said petition shall be accompanied by a fee of
2 $25 which is not returnable in the event the variance is not
3 granted. Upon receipt of such a petition the.Board of Supervisors
4 ,shall set same for public hearing and shall advertise notice of
5 such hearing pursuant to Government Code §b061. And provided
g further, such hearing shall not be scheduled earlier than ten
7 days from the date of publication.
g Variances granted hereunder shall contain provisions
g which will accomplish the following:
2~ ~.. That the mobile home may be placed on the property
~,~, without violating any of the setback requirements of the zones
22 in which the property is located.
23 2. That the mobile home shall only be allowed where
24 the zone in which the property is situate allows for the placing
25 and utilization of a mobile home; provided, however, that there
16 shall be no requirement for an additional site for said mobile
27 home as the term "site" is utilized in this Chapter, or any other
18 County ordina nce or code provision, in that this allowed use
29 is temporary in nature.
20 3. That the mobile home to be placed on the property
2I may only be utilized by a relative, either by marriage or by
22 blood or close friend, of the owner of the property on which it
23 is to be placed, and there may be no rent charged to the occupant
24 of the mobile homed The mobile home may be owned by either the
2~ owner of land on which it is to be placed, or the relative or
26 close friend who shall be residing therein.

4o The variance granted hereunder shall be for the
term of one year, however, nothing herein shall be construed
to prohibit an applicant from applying for a new variance at the
end of the yearn Yn the event the applicant who is residing
within the mobile home or the conventional residence for any
:reason moves to another location or is deceased, then in that
event, the variance granted herein automatically expires and the
mobile home shall be removed within 30 dayso Tn the event the
mobile home is not removed within 30 days pursuant to the terms
of the variance, the County sha11 remove said mobile home and
store it at the owner's expensed The County shall require
.either a deposit or bond sufficient to cover the removal._ expense
at the time the application for the variance is approvedo The
amount of such deposit or bond shall be determined at the time
of the hearing for the varianceo The request far the variance
shall be signed by both the applicant and the relative or other
person to receive or render assistance, and shall provide that
Butte County is given a right of entry on the property and the
right to remove the mobile home, and store same at the sole
cost and expense of the applicanto
Section 3. This Ordinance shall be and it is hereby
declared to be in full force and effect from and after thirty (3Q)
days after the date of its passage; and before the expiration
', of fifteen (15) days after its passage this Ordinance shall be
published once with the members of the Board voting for and
against it in the Oroville MercuryT„~, a newspaper published
