AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE, STATE OF CALIFORNIA, AN "N-C" {NEIGHBORHOOD-
COMMERCIAL} DISTRICT, AND ESTABLISHING REGULATIONS FOR
THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS

California, under and pursuant to Ordina~.ce No. 475, as amended,
and declaring an emergency, DO ORDAIN as follows:
SECTION 7.. The hereinafter described area situate in the
County of Butte, State of California, shall be and it is hereby
zoned as an "N-C" (Neighborhood-Commercial}.District, for a
period of 12b days, and such area shall be subject to the
restrictions and restricted uses and regulations hereinafter
specified and provided. Said area so zoned being located in
Paradise, California.
A portion of the.sauth half of Sec. 19, T22N, R4E,
~IDB&M, described as:
Beginning at the intersection of Pentz-Magalia Hwy.
and the north right-of-way line of Stearns Rd.;
thence west alp.ng said north right-of-way line 284.83 ft.;
thence north, 399.06 ft.; thence east to Pentz-
Magalia Hwy. centerline; thence soutk~,:~~.3~46~~ft.;
thence east, 406.42 ft.; thence south 385.6 ft.
to the north right-of-way line of Stearns Rd.; thence
west, 352.35 ft, along said north right-of-way
line to the point of beginning.
A portion of the north half of Sec. 30, T22N, R4E,
MDB&M, described as beginning at the intersection
of the south right-of-way line of Stearns Rd. with
the east right-of-way line of Pentz-Magalia Hwy.;.
thence east 317.25 f~.; thence 5 15° 42' S6" E,
220 ft.; thence S 09 l2' 35" E, 204.04 f t.; thence
5 890 l5' W, 360.21 ft, to the east right-of-way
line of Pentz-Magalia Hwy.; thence west to the
west right-of-way line of Pentz-Magalia Hwy.; thence
N 050 08' W along s$id west right-of-way to a point
located 23.0 ft. south of the south right-of-way of
Stearns Rd.; thence N 880 45` 35" W, 162.02 ft.;
thence N 080 ll' 10" E, 221.99 ft. to Stearns Rd.;
thence east along the south right-of-way of Stearns
ftd. to the point of beginning.
Z SECTION 2. The following regulations shall apply in an
2 "N-C" (Neighborhood-Commercial) District:
3 2.1 USES PERMITTED SHALL BE LIMITED TO THE FOLLOWING:
4 a. Faod stores, drug stores, hardware stares, variety
5 .stores, jewelry stores, book stores, laundry services,
6 and similar-personal services.
7 b. Professional offices.
8 2.2 OFF STREET PARKING REQUIREMENTS:
9 The area for off -street parking shall be not less
10 than two (2) square feet for each square foot of
Y1 gross floor space,
12 2.3 OTHER REQUIREMENTS:
13 a. Copies of the site plan fbr the development shall
14 be submitted and approved by the Public Works
16 Department, Health Department, and the Planning
l6 Commission.
17 b. On any boundary line which is ac~common property line.
18 with property classified for uses in the "R° category,
ig a wa~.l or view--obscuring fence not less than five (5)
20 feet or more than six (6} feet in height shall be
2~ installed and maintained for screen purposes and
22 controlling trespass; except where the wall of a
23 building is on such common property line, no separate
24 wall or fence need be installed along the portion of
the property line occupied by the wa11 or the

'¢ SECTION 3. All uses of land within the District not
5: specifically authorized and permitted under Section 2, are
8 prohibited.

10 SECTION 5. The penalties for the violation of the zoning
11 hereby imposed within the district sha11 be as provided in the
12 Zoning Enabling Ordinance.
13 SECTION 6. For the immediate preservation of the public
14 peace, health and safety of the area hereinabove described, and
15 the residents and inhabitants thereof, it, is necessary that this
16 ordinance take effect immediately. A declaration of the facts
17 constituting the necessity therefore is as .follows:
18 The adoption of such Interim Zoning Plan is necessary in
19 the public interest, to maintain the status quo in such district
20 pending the determination of the application for such permanent
2I detail zoning.
22 SECTION 7. This emergency ordinance shall take effect
23
immediately upon its passage, and before the expiration of fiftee
24
(l5) days after its passage shall be published once with the name
25
of all members of .the Board of Supervisors voting for and against
28
