The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as an "5--2" (Suburban Residential) District :for a period ~0 3~~,~~, ~ :w. , and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located near Oroville, more particularly described as follows: Being protians of Section 11, 12, 13 & 14, T19N, R4E, NtDB&M. Described as: Beginning at a point in the centerline of Olive Highway said-point located 500 ft, west of Ward Blvd, idter- secti~vn~ thence N 33° 56' W, 226.8 ft; thence S 8&° 29' W, 650.2 ft; thence. W. Q° 4-3' E, 132 ft. mare or less to the north line of said Section 14; thence west along said north line to Palermo Canal; thence meandering northerly along P.alermv Canal to the west ]ine of said Section 11; thence north along said west line to the northwest corner of said. Section 11; thence east along the north. line of Section 11 & ]2 to Canyon Drive; thence easterly along-Canyon Drive to the northeast corner of "Orovil]e- Wyandotte Fruitlands Unit #2" per map retarded in map book ]1 on pages 11 and 12 ~n the office of Butte County Recorder; said corner being in the north line of said Section 12; thence continuing east along the north line of Section 12 to the north quarter corner of Said Section 12; thence south along the north south centerline of said Section ]2, to Nillcrest Avenue, thence easter]y along Nillcrest Avenue to the northeast corner of Lot 8 of "Monte Vista Terrace Subdivision Unit #1", per map recorded in map book 20 on page 3; thence south along the east line of said Lot 8 to the south ]ine of said Subdivision; .thence southerly along the east l ine of ~- Lots 7 tbrou.gh ] of said Sub-division of the southeast corner of said Subdivision; continuing south paral]el with and 250 ft. east of the centerline of Riverview,, Drive t~ the north 1 ine of "Ballantrae N~anor, Units 1 #1 & 2, per maps recorded in map book 24 on pages 4Z and 43 and bank 3O on page 20; thence easterly and souther- 2 ly along the north and east lines of said "Ballantrae Manor Subdivision" to the south line of Section l2; 3 thence west along the south line. a.f said Section to Riverview Drive; then~c~e southerly along Riverview Drive 4 ~ to Olive Highway; thence westerly along the Olive High- way to the point of beg~i~n~~ag, containing 123b acres, 6 mare ar less. Na. 1338) , as shown on€~~maps an file in the Office of Butte County Assessor, on the first Monday 8 of March, 1972. 9 SECTION 2. Regulations for an "S-2" District. The 10 fol. ].owing regulations shall apply in an "S-~2" District: 11 2.1 USES PERMITTED: 12 a. Single-family dwellings, not including tents or 13 mobile homes. 19~ b~. Accessory buildings pertinent to ..the. permitted uses. 15 2.2 Agricultural. uses, except livestock, subject to the 16 following requirements: 17 a. For each-horse or head of cattle over one year of 18 age, eight thousand one hundred twenty-five (8,1.25) 19 square feet. 20 ~. For each head of~swine over ten {10) weeks of age, 2I eight thousand one hundred twenty-five {8,125) 22 square feet. 23 c. For each head of sheep or goats, two thousand 24 {2,000) square feet. ~ 2.3 LOT AREA: 28 Minimum required area of a lot per dwelling unit shall be not less than one {1) acre. -2 - 1 2i 3 4 s 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 2S 2.4 LOT WIDTH: Minimum lot width shah. be not less than one hundred thirty {130) feet. 2.5 FRONT YARD: Minimum front yard shall be fifty {50} feet from the centerline of the road. except where the road is classified ley the County as a Federal Aid Secondary Road,. the minimum building setback requirement shall be fiftywf~.ve {55) feet from the centerline of said road. 2 .6 5I1~E YARD Minimum side yard sha11 be not less than ten {10} feet. SECTION 3. The following uses subject to securing a Use Permit in each case: a. Public and quasi-public uses, ,including churches. b. Hospitals, parks and playgrounds, schools and public utility buildings. SECTION 4. All uses of land within the district not specif ically authora,zed and permitted in sections 2 and 3 are prohibited. SECTION 5. In compliance with the provisions of said Zoning Enabling Ordinance, the same is .hereby amended by adding this Ordinance in full. SECTION 6. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling-Ordinance. In compliance with the provisions of -3 ~- 1 -the zoning Enabling Ordinance, this Ordinance shall from and 2 after its effective date become a supplement to and part of the S zoning Enabl~.ng Ordinance. 4 SECTION 7. This urgency ordinance shah. take effect 6 immediately upon its passage, and before the expiration of fifteen 6 (15) days after its passage shall be published once with the 7' names of all members of the Board of Superv~,sora voting for and 8 against the same in the _ S?Y'~?~'1 ~1_e MerCt~r,~, a newspaper 9 in general circulation in the County of Butte, State of California 10 The facts constituting the urgency on which this Ordinance is 11 based are:: 12 1. The existing A-R Zone permits uses which may be 13 incompatible with the developed single family dwelling nature of 14 the subject area. 15 2. The Planning Commission is considering a petition 16 requesting rezoning of the subject area into zoning districts more 17 restrictive than the existing districts. 18 3. This urgency ordinance is necessary to preserve the x9 public health, safety and welfare in the subject area until said 20 rezoning to "S-2" is decided. 21 PASSED AND ADOPTED by the Board of Supervisors of the 22 County of Butte, State of California, on the 10th day of 23 J~.ly 1973, by the following vote: 24 25 2B _4- 7.
