HomeMy WebLinkAbout1370ORDINANCE NO. 1370 AN INTERIi~4 ORDINANCE BONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-SR" ~AGRTCUL- TURAL-SUBURBAN--RESIDENTIAL) DISTRICT AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND CONSTRUCTION OF BUILDINGS. The Soard of Supervisors of the County of Butte, State of ~~California under and pursuant to Ordinance Na. 475; as amended, ~~and declaring an emergency, DO ORDAIN, as follows: SECTION 1. The hereinafter described area situate in, the 10 I3. 12 13 14 15 16 17 is' 19. 20 2]. 22 23 24 28 County of Butte, State of California, shall be and it is hereby zoned an "A-SR" (Agricultural.-Suburban Residential) District, for a period of 120 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided, and area so zoned being located near Chico, California, and particularly described as: The southwest: quarter of the northeast quarter of Sec. 9, T22N, R1E; the east half of the northeast quarter of Sec. 9, T22N, RlE, located south of Sycamore Creek; the west half of the northwest quarter of Sec. 10, T22N, R1E; located south of Sycamore Creek; also a portion of the southeast quarter of Sec. 9 described as beginning at the northwest corner of Lot 8 of "Hobart Sub", per map of record in the Office of Butte County Recorder, in map book 4 on Page 24; being in Eaton Rd ., thence southeasterly. along the west 1 ine of Lot 8 and Lot 7, said "Ilobart":..:Sub" to the southwest corner of said Lot 7; thence- south- westerly on the westerly prolongation of the south line of said Lot 7 to State Hwy. 99; thence northwesterly along the east right of way line of State Hwy. 99 to a line located 1320 ft. northwesterly of and parallel with the westerly prolongation of the south line of Lot 7 said "Hobart Sub", thence northeasterly along said line 800 ft.; thence northwesterly at right angles to said line 295 ft, to Eaton Rd .; thence east along Ea tan Rd. to the point of beginning, ~: containing 1G5 acres, more or less, Chico. SECTION 2. REGULATIONS FOR AN AGRICULTURAL SUBURBAN-- `~~ ~~ RESIDENTIAL DISTRICT ( "A-SR") 1` 2 3 4 5 B 7 8 9 10 I1 12 13' 14` 15 16 1'7 18 19, 24 21 22 23 24 23 26 The following regulations shall apply to an Agricultural Suburban-Residential 17 istrict ("A-SR"): 2.l USES PERMITTED: a. Single-family dwellings, not including tents or mobile homes. b. Accessory buildings pertinent to the permitted uses. 2.2 AGRICULTURAL USES, EXCEPT LIVESTOCK SUBJECT TO THE FOLLOWING REQUIREMENTS: .~.a. For each horse or head of cattle over one (l) year of age one half acre, 21,780 sq. ft. b. For each head of swine over ten (10) weeks of age, one half acre, 21,780 sq, ft. c. For each head of sheep or goats, one quarter acre, 10,890 sq. ft. 2.3 LOT AREA: Minimum required area of lot per dwelling unit shall be ~ not less than 8,125 sq. ft. 2.4 LOT 6JTDTH: Minimum lot width sha11 be not less than sixty-five feet. 2.5 FRONT YARD: Minimum front yard shall be fifty ESO) feet from the centerline of the road except where the road is classified by the County of Butte as a Federal Aid Secondary Road, the minimum building setback requirements shall be fifty--f~,ve (55) feet from the centerline of said road. -2- 1 2.6 SIDE YARD: 2 1~Iinamum side yard sha11 be not less than five (5) feat. 3 SECT20N 3. The following uses subject to securing a Use 4 Permit in each case: fi;, a. Public and quasi-public uses, including churches. B b. Hospitals, parks and playgrounds, schools and public 7' ' utility buildings .~ 8 SECTION 4. All uses of land within the district not 9 specifically authorized and permitted in Sections 1 and 3 are 1~ prohibited. 11 SECTION 5. For the immediate preservation of the public 12 peace, health and. safety of the area hereinabove described, and 13 the residents and inhabitants thereof, it is necessary that this 14 ordinance take effect immediately, A declaration of the facts 15 constituting the necessity therefore is as follows: 18' The adoption of such Interim Zoning Plan is necessary in 17 the public interest, to maintain the status quo in such district 18 pending the determination of the application for such permanent 19 detail zoning. 20 ', SECTION 6.
