AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE
COUNTY OF BUTTE AUTHORIZING AN AMENDMENT TO THE
CONTRACT BETWEEN THE BOARD OF SUPERVISORS AND THE
BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC
EMPLOYEES' RETIREMENT SYSTEM
The Board of Supervisors of the County of Butte DOES
ORDAIN as follows:
SECTION 1Q That an amendment to the Contract between
the Board of Su ervisors of the County of Butte and the Board of

Administration, California Public Employees' Retirement System
is hereby authorized, a copy of said amendment being attached
hereto, marked "Exhibit ~AA'A, and by suc1~ reference made a part
.hereof as though herein set out in fu11o
SECTION 2q The Chairman of the Board of Supervisors
is hereby authorized, empowered, and directed to execute said
amendment for and an behalf of said Agencyo
SECTION 3o This Ordinance shall take effect 3D days
after the date of its adoption, and prior to the expiration of
~~ days from the passage thereof shall be published at least
once in the Orovil~.e Mercury , a newspaper
of general circulation, published and circulated in the County
of Butte and thenceforth and thereafter the same shall be in
full force and effecto

The Board of Administx~ation~ Public Employees Retirement Systems hereinafter
referred to as Board.. and the &7ARD OF S'aPERVISORS of the COUNTY OF ~TTEi herein-
after referred to ws Public Agency having entexed into a contract under date of
Febr+zary 26, 1945, effective April l~ 1945, and as amended effective October 1~
1947, December ].~ 1951y J~z3.y l~ 1956y November 1? 1956, November ~.~ x.959, September
Ss 3.860, October 1, 1960 October l~ 1961, September 16, 1964, and October l~ 1968,
and as provided by Chapters 170 and 316y Statutes of 1971, which provide for pasti-
cipation of Publa.c Agency in said Systems Board and Public Agency hereby agree as
follows:
A. Paragraphs 1 through 9 are hereby stricken from said contract as executed
effective April 1, 1945, and are hereby replaced by the following pars--
. graphs numbered 1 through 9 inclusive:
l.. All words and terms used herein which are defined in the Public Employees
Retirement l;aw shall have the meaning as defixied therein unless otherwise
• • specifically provided. "Normal retirement age" shall mean age 6O for
- • miscellaneous members and age 55 for local safety members.
2. Public Agency sha11, participate i.n. the Public Employees1 Retirement
System from and after Apr~.l 3.~ 3.945, mal~i.ng its employees as hereinafter
• provided members of said System subject to all provisions of the Publ~.c
. ~ Employee s Retirement Zaw except such as apply only on election of a
contracting agency aid are not provided for herein and to all amendments
.to said Zaw hereafter enacted except such as by express provision thereof
apply only on the election of contracting agencies. '
3. Employees of Public Agency an the following classes and groups shal3.
became members of said Retirement System except such in each such class
and group as are excluded by law or this agreement: •
a. 3;oca1. firemenherein xeferred to as local safety members);
b. County peace officers (herein referred to as lots]. safety members};
-c. Employees other than 1oca1 safety members (herein referred to as
miscellaneous members}.
In addition to the employees excluded from: membership by said Retire-
ment Zavr, the following employees shall not become members of the
Retirement System:

HIRED ON OR AFTER OCTOBER 19 196$.

4, The fraction of final compensation to be provided for miscellaneous
members far .each year of credited prior and current service shall be
that provided in Section 21253-.13 subject to the reduction provided
therein for service on and after January 1~ 1g56 of members whose
serv~.ce has been included in the federal system.
5. The following prov~.sions of the Public Employees' Retirement law
which apply only upon election of a contracting agency shall apply
to the Public Agency and its employees:
a. County Peace Officers shall participate as local safety members
from and after this amendment to contract in 1973 (Section
2ooz1.7}.
~b. "County Peace Officer" shall include persons employed on and
. 'after this amendment to contract in 1973 in positions described
in Section 20021.6, ~ .
c.
Section 21252.6 including the provision thereof for reduction
~.n the fraction of final. compensation to be provided fob each
year of prior and current service far members any of whose local
safety service Y3as been included in the federal system and as to
such members such reduction shall apply to all local safety
service whether or not all such serva.ce has been included iri the
federal. system.
d,. Section 20952.5 (providing for age 50 as the mir~7rm» voluntary
retirement age for local safety members with benefit payments
.commencing prior to age 55 subject to actuarial discount}.
~. b. County peace officer Sexv5.ce for members becoming local safety members
.~ on and after this amendment to contract in 1973 shall also include
,- service prior to that date in employment described in Section 20021.5
and 20021.6.
7. ~Public,Agency shall contribute to said Retirement System as follows:
. ~ a. Kith respect to miscellaneous members the agency shall contribute
. the following percentages of monthly salaries earned as miscel-
. laneous members of said System:

for-prior service benefits.
(2} 7.1.8 percent on account of the liability for current service
. benefits.

as local safety members of said System:

benefits.
c. A reasonable amount per annum, as fia~ed by Board to cover .the costs
of admni.stering said System as it affects the -employees of F~zblic
Agency not including the costs of speci.a~. valuations or o~ the
periodical investigation and valuation required by law.
d. A reasonable amount as•fixed by the Baaxd~ payable i.n one install
went' as the occasions arise, to covex costs of special valuations
on account of employees of Public Agency and costs of the period-
ical investigation and valuation required by law.
8. Contributions required of Pablic Agency and its employees shall be
' subject to adjus-t,~cent by-Board on account of amendments to• the• Publzc
Employeest Retirement Systems as determined by the periodical investi-
.gatiox~ and valuation required by said Retirement Zaw.
9. Contributions required of Public Agency and its employees shall be
paid by Publzc Agency to the Retirement System within thirty days
' after the end of the period to which said contributions refer. if
more or less than the correct amount of contribution is paid for any
~~~~-" period, proper adjustment shall be made in connection with subsequent
remittances or adjustments on account of errors in payments between
the employee and Board. Payments by Public Agency to Board may be
• • made in the form of warrants, bank checks bank drafts certified
checks, money orders or cash, ~ •
