The Bard of Supervisors of the County of Butte DO ORDAIN
as follows:
That Section 1306 of Ordinance 475 as amended is hereby
amended to read as follows:
13,6 {a} ~,y use permit which is not used within one
year of the date of the granting thereof shall automatically
become null and void and shall not be subject to revival except
by reapplication pursuant to Section 1342p
(b) Any use permit may be revoked if any of the
terms or conditions of such permit are violated or if any acts or
omissions of the permittee in connection with the use authorised
by said permit constitute a public nuisanceo The Planning
Commission shall set a date for a hearing to be held before it on
any proposed revocationo Notice of said hearing shall be
advertised and noticed pursuant to Government Gode Section 65905
and shall be mailed to the permittee by registered mail, return
receipt requested, at least l0 days prior to said hearingo The
Planning Commission may continue the hearing from time to timed
The decision of the Planning Commission shall be on the question
of the revocation or modification of the use permit and shall be
subject to appeal to the Board of Supervisors as provided in
Section 13,5, above, except that the time for filing such a wrist
,appeal shall be ten (10) daysa
{c) If the final decision of the Planning Commissio
or Board of Supervisors, as applicable, is to revoke the use permi
.pursuant to subsection~(b) above, and the use continues even thoug
1 the use permit has been revoked, the Planning Director shall
2 report such facts to the Board of Sup ervisors and to the office
3 of the District Attorney for appropriate action.
4 This Ordinance shall take effect thrity (30) days after
~ the date of its adoption, and before the expiration of fifteen
6 (l5) days after Sts passage, it shall be published once with
7 the names of the members of the Board of Supervisors voting for
8 and against the same, in the _ Chico Bn~erpr.ise ~ a newspaper
9 published in the County of Butte, State of California.
