HomeMy WebLinkAbout1383ORDINANCE N0, i~jg3 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE 0~' CALIFORNIA, A "C-C" (CONfMUNITY COI~!iI+4ERCIAL' ) DISTRICT, PURSUANT TO ORDINANCE NO. 475, A5 AMENDED ~ The Board of Supervisors of the County of Butte, State off' 2 California, under and pursuant to Ordinance No. 475, of said 3 County, being the Zoning Enabling Ordinance, as amended, DO ORDAIN 4 as follows : 5 SECTION 1. The hereinbelow described area situate in the 6 County of Butte, State of California, shall be and it is hereby 7 zoned as a "C-C" (Community Commercial} District and such area 8 shall be subject to the restricta.ons and restricted uses and 9 regulations hereinafter specified and provided. Said area so ~~ zoned being located in the unincorporated area of Butte County 12 in Durham, California, more particularly described as follow: x2 Lots 1 & 2 of "Monte Vista Village", par map 13 recorded in Map Bk. 24 on Pg. 39 i4 SECTION 2, REGULATIONS FOR "C-C" DISTRICTS, The i'ollaw- 35' in.g regulations sizall apply in all "C-C" Districts; IB 2.1 USES PERMITTED SUBJECT TO PLAN APPROVED BY Tf1E 17' PLANNING COMMISSION: 38 a. Multiple dwellings and dwelling groups, subject to Z9 the height limit, building site area, average Sot 2U width and yard requirements specified for "R-3" 21 Di.s tricts . 22 b. Hotels, Clubs and lodge halls, hospitals, sanitariums 23' and clinics . 24 c. Retail stores and shops of a light commercial ~ character and conducted within a building including 2B appliance stores, banks, barber shops, beauty parlors 13 ~3 l book stores, cleaner or laundry agents and launder- 2 ettes, dress shops, drug stores, food stares, furni-- $ tore stares, millinery shops, professional offices, 4 restaurants, refreshment stands, service stations, ~: shoe shops, storage garages, studios and tailor 6 shops, public utility commercial offices, and other 7 uses which are of a similar character to those 8° enumerated and which will not be detrimental or 9 obnoxious to the neighborhood in which they are to 10 be located . I1' 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 12 IN EACH CASE: 13' a. All uses permitted in "R-1" and "R-2" Districts. 14 b. Mobile home parks. 15 c. Public and quasi=public uses. 16 d. Animal hospitals, auto sales, dancing academies or 17 halls, open air retail sales, theaters, pet shops, 18 wholesale stores or storage, undertaking establish- 19; menu , used car sales, used or second hand goods, 20 and other uses which are of similar character. 'z~- 2.3 $UILD~NG HEIGHT LIPdIT: Forty-five (45) feet. 22 2.4 MINIMUM LOT WIDTH REQUIRED: Twenty-five (2~) feet. 23 2.5 FRONT YARD REQUIRED: None, except where frontage in 24 a block is partially in an "R" District, in which 2~ case the front yard shall be one-half that required 26 in such "R" District. -2- 1 2.6 SIDE YARD REQUIRED: None, except where the side of a 2 lot abuts upon the side of a lot in an "R" District, 3 in which case the abutting side yard shall be not 4 less than five (5} feet, and .except trhere the side 6 yard on the street side of a corner lot abuts on an g "R.:'.__District~:-~in.::.which case: the side yard''on the 7 street side shall be one-half the corresponding front 8 yard required.in such ""R" District. 9 2.7 REAR YARD REQUIRED: Twelve (12) feet, or five (5} ~a~ feet adjacent to an a11ey. Z1 ~.8 OFF--STREET PARKING: Off-~streat parking area shall 12 be approved in advance and as required by the 13 Planning Commission. 14 2.9 FENCES, SCREEN PLANTINGS, ETC.: Fences, screen 15 plantings and other obstructions shall not exceed 1:6 three (3} feet in height in front yards, nor six (~) 17 feet in height in any required rear or side yards. 18,~ In case of corner lots, fences, shrubs, screen '~ 19 plantings or similar obstructions shall not exceed 2~ three (3) feet in height within the sight distance 21. area. 28 SECTION 3. All uses of Land within the District not 23 specifically authorized and permitted under Section 2 are prohib-- 24 ited . ~ SECTION 4. Penalties for any violation of the zoning 26 hereby imposed within the District shall be as provided in the _~_ l zoning Ordinance. Tn compliance with the provisions of the 2 zoning Enabling Ordinance, this Ordinance shall from and of ter 3 its effective date become a supplement to and part of the zoning 4 Enabling Ordinance. 6 SECTION S. This Ordinance shall. be and it is hereby B declared :~o be in full force and effect from and after thirty 430) 7 days after the date of its passage, and before the expiration of 8 fifteen (l5) days after its passage, this Ordinance shall be 9 published once with the names of the members voting for and 10 against it in the Chico Enterprise a newspaper published 11 in the County of Butte, State of California. 12 PASSED AND ADOPTED by the Board of Supervisors of the 13 County of Butte, State of California, this 14th day of 14 A~,~l~t _ 1973, by the following vote: 1~ AYES: Supervisors Cameron, Gilman, Ladd, Madigan and Chairman.
