The hereinafter described area situate in the .County of Butte, State of California, shall be and it is hereby zoned as an "A-3" (Agricultural) District for a period of 6Q^ days, and such area shall be subject to the restrictions and 'restricted uses and regulations hereinafter specified and provided, Said area so zoned being located in the unincorporated area of -Butte County at Durham, California, more particularly described as follows: Parcel I Generally located at the town of Durham. Beginning ai the intersection of Durham-Chico Highway and the centerline of the Southern Pacific Railroad right- of-way; thence southerly along centerline of said right-of-way to its intersection with Hanlon Road; thence west along Hanlon Road and its extension to the south quarter corner of Section 36, T2lN, R1E; thence north along the Section centerline of said Section 35 and Section 25, 1'21N, R1E, to Durham- Chico Highway; thence north and east along Durham- Chico Highway to the point of beginning. Containing 1,200 acres, more or less. Excepting therefrom AP 40-25-24 (M-2 Ordinance 1036) . Parcel Being located in the unincorporated area of Butte II County particularly described as follows: Lots 75, 88, 89, 90, A, B , C, D, E, F, G, H, I, J, K, L, P+I, N, O, P, V, a and the westerly 930 ft. of Lot 74, the westerly 704 ft. of Lot 75, and the easterly half of Lot 67; all of the Dur~iam S tote Land Settlement as recorded in Book 8, pale 16 and 23 in the Recorders Office., County of Butte. Also that area described as beginning at the I3~~ 1 southwest corner of Lat 88, Durham State Land Settlement. Also being on the east line of Lott 2 Road; thence easterly along the south line af.~:, Lot 88 to its southeast corner; also being on 3 the west 1 i ne of Lot 76, Durham State Land S ettl e- meat; thence south along the west line of Lot 76 4 to its southwest corner; also being on the north line of the Durham-Oroville Highway; thence west 5 along the north line of Durham-Droville High way to its intersection with the east line of Latt s Raad; thence north along the east line of Lott Road to the point of beginning. Containing 19i 7 acres, mare°~.or~~.ess. 8 SECTION 2. REGULATIONS FOR AN."A-3" DISTRICT: 9 The following regulations shall apply in an "A-3" District: 10 2.1 .USES PERMITTED: 11 a. Single-family dwellings. 12 b. General farming, horticulture, commercial 13 livestock, poultry production, warehousing and storage. 14 c. Accessory buildings and uses pertinent to the 15 permitted uses, including agricultural. processing plants. 18 d. Housing facilities (including mobile homes) to 17 accommodate only agricultural employees and their families employ- 38 ed by the owner or operator of the premises; and provided further 19 that such housing facility shall be considered accessary to the 20 main building and shall. conform to the provision pertaining to 21 the required yard and open space for dwellings. 22 e. Mobile Home s. to house one family when such 23 mobile home~~ais-the-only housing facility located on the premises, 24 provided the following conditions are conformed to: ].. The floor area within the mobile home>>shall 28 not be less than five hundred-(5001 square feet. --2 -- { 1 2. -The parcel of land conforms to Section 2,3 2 ~ (Minimum lot area of 5 acres), or is a smaller parcel of land 3 lawfully created prior to the enactment of this Ordinance, subject 4 .to the written approval by the Director of Planning. ~: 2.2_ THE FOLLOWING USES SUBJECT TD_ .SECURING A USE 6 PERMIT IN EACH-CASE: . 7 a. Golf Courses and country clubs. 8 b. Public or quasi.--public uses including churches, 9 f ire houses, hospitals, and clinics, parks and playgrounds, 10 .schools, public utility buildings and professional buildings, 11 c. Hunting and fishing camps, including those 12 which accommodate recreational vehicles and travel trailers, and 13 gun clubs, when located on sites of not less than five (5) acres. 14 2.3 MINIMUM LOT AREA REQUIRED: 15 Minimum lot area shall not be Less than five (5) acres. 18 2.4 -FRONT YARD .REQUIRED 17 Minai.mum front yard shall be fifty (50) feet from the centerline 18 of the road, except- where the road is classified by the County 19 as a Federal Aid Secondary Road and the minimum building setback 20 requirement sha11 be fifty-five (55) feet from the centerline of 21 said road. 22 2.5 SIDE YARD REQUIRED: 23 Minimum side yard shall not be less than five (5) feet. 24 SECTION 3. All uses of land within the district not ~ specifically authorized and permitted in Sections 2 and 3 are 28 prohibited. -3- 1 SECTION 4. The penalties for the violation of the 2 zoning here.~y ~.mposed within the district shall be as provided in 3 Secta.on 15 of Ordinance No. 475. Tn compliance with the provision; 4 of the Zoning Enabling Ordinance, this ordinance shall from and 5 after its effective dale become ~a supplement to and part of the 6 • Zoning Enabling Ordinance. % SECTION S. This urgency ordinance sha11 take effect 8 immediately upon its passage, and before the expiration of 9 fifteen '~15) days after its passage shall be published once with 10 the names of all members of the Board of 5upervisars voting for 11 and against the same in the Chico Enterprise , a newspaper in 12 general circulation in the County of Butte, State of California. 13 The facts constituting the urgency on which this ordinance is 14 based are; 15 1. T~~ existing A-2 Zone permits uses which may be 16 incompatible with the developed single family dwelling nature of 1~ the subject area. 18 2. The Planning Commission will soon be consider- 19 ing a petition requesting rezoning of the subject area into 20 zoning districts more restrictive than the existing districts. 21 3.
