HomeMy WebLinkAbout1393(33:3 ORDINANCE NO. 1 AN INTERIM ORDINANCE AMENDING COUNTY ORDINANCE 925, CONSOLIDATING "R--l" (SINGLE-FAMILY RESIDENTIAL) ~., The Board of Supervisors of the County of Butte, State of 2 California, under and pursuant to Ordinance No. 475, as amended, 3 and declaring an emergency, DO ORDAIN as follows: 4` SECTION 1. The hereinafter described area situate in the 5 County of Butte, State of California, shall be and it is hereby 6 zoned as an "R-1" (Single-Family Residential} District, for a 7 period of 60 days, and such area shall be subject to $ the restrictions and restricted uses and regulations hereinafter 9° specified and provided. Said area so zoned being located in 10` Paradise , California . 11 The south half of the southwest quarter of Sec 6, T22N, R4E, MDB&M; the east 1,000 ft, of the north half of 12 the southwest quarter of Sec 6, T22N, R4E, MDB&M; and the west 660 ft , of the south half of the southeast 13 quarter of Sec 6, T22N, R4E, MDB&M; containing 130 acres, more or less. I4 15 SECTION 2. The following regulations shall apply in an 18. "R--1" (Single-Family Residential) District: 17 2.l USES PERMITTED: 18 a. Single-family dwellings, not including tents or 19 trailers. 20 b. Accessory buildings pertinent. to the permitted uses. 21; c. Household pats (but not including livestock, poultry 22 or poisonous reptiles.} 23 2.2 LOT AREA: 24 Minimum required area of a lot per dwelling unit. 25 shall be no less than eight thousand, one hundred ~~ twenty-five ( 8 ,125 ) sq . ft . . ~ 2 .3 LO'I' WIDTH 2 Minimum lot width shall not be less than sixty-five ~ (65} feet. 4 2.~ FRONT YARD: 5 Minimum front yard shall be fifty (50) feet from the ~ centerline of the road, except where the road is 7 classified by the County as a Federal Aid Secondary 8 ~ Road, the minimum building setback requir:dment shall 9 be fifty-five (55) feet from the centerline of said ~~ road . I3 2 .5 S IDE YARDS ~~ Minimum side yard shall not be less than five (5} 13 feet . 14 2.6 The following uses subject to securing a use permit 15 in each case; 16 a. Golf COUr5e5 and .country clubs. ~'~ b. Public and quasi-public uses including churches, I8 firehouses, hos itals p , parks, playgrounds, schools x9 and public utility buildings. 2U SECTION 3. A].Z uses of land within the district not 2I. s ecificall authorized and p y permitted in Section 2 are prohibited. 22 SECTION 4. Incompliance with the provisions of said 23 Zoning Enabling Ordinance, the same is hereby amended by adding 24 this Ordinance : iii: _ full.:.- 2~ SECTION 5. The penalties for the violation of the zoning 2B he~eeby imposed within the district shall be as provided in the -2 - 1 Zoning Enabling Ordinance. Tn compliance with the provisions of 2 the Zoning Enabling Ordinance, this Ordinance shall from and 3 after its effective date become a supplement to and part of the 4 Zoning Enabling Ordinance. 5 SECTION 6. For the immediate preservation of the public 6 peace, health and safety of the area hereinabove described, and 7 the residents and inhabitants thereof, it is necessary that this 8 ordinance take effect immediately. A declaration of the facts 9 constituting the necessity therefore is as follows: 10 The adoption of such Interim Zoning Plan is necessary in l]. the public interest, to maintain the status quo in such district 12 pending the determination of the application for such permanent 13 detail zoning. Y4 SECTION 7. This emergency ordinance shall take effect 15 immediately upon its passage, and before the espiratian of 1B fifteen il5} days after its passage shall be published once with 17 the names of all members of the Board of Supervisors voting for 18 and against the same in the Chico Enterprise Record, a newspaper I9 in general circulation in the County of Butte, State of 20 California. 21 PASSED AND ADOPTED by the Board of Supervisors of the 22 County of Butte, State of Cal ifarnia, on the ~Rth day of 23 ,~,~.,,s~ .~ ~ , 1973, by the following vote: 24 AYES: Supervisors Cameron, oilman, t'~adigan and Chairman McK~.llop 2S NOES= Supervisor Ladd 28 ABSENT: None -3 ~- l z 3 4: ~!
