HomeMy WebLinkAbout1394ORDINANCE NO. 1394 1 2 3: 4 5 6 7 S 9 10 I1 . 12 13 14 15 1B 17 18 as 20 21 22 23 24 2S 2B AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-SR" (AGRICULTURAL-5UBURBAN- RESIDENTIAL} DISTRICT AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND CONSTRUCTION OF BUILDINGS. The Board of Supervisors of the County of Butte, State of California under and pursuant to Ordinance Na. X75; as amended, DO ORDAIN, as follows: SECTION 1. The hereinafter described area situate'in the County of Butte, State of California, shall be and it is hereby zoned as "A-SR" (Agricultural-Suburban-Residential} Distric and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided, and area so zoned being located near Chico, California, and particularly (described as: The southwest quarter of the northeast quarter of Sec. 9, T22N, RiE; the east half of the northeast quarter of Sec. 9, T22N, R1E, located south of Sycamore Creek; the west half of the northwest quarter of Sec. 10, T22N, R1E; located south of Sycamore Creek; also a portion of the southeast quarter of Sec. 9 described as beginning at the northwest earner of Lot 8 of "Hobart Sub", per map of record in the Office of Butte County Recorder, in map book 4 on Page 24; being in Eaton Rd., thence southeasterly along the west line of Lot 8 and Lot 7, said "Hobart Sub: to the southwest corner of said Lot 7; thence south- westerly on the westerly pralongation of the south line of said Lot 7 to State Hwy. 99; thence north- westerly along the east right-of-way line of State Hwy 99 to a line located 1324 ft. northwesterly of and parrallel with the westerly prolongation of the south line of Lot 7 said "Hobart Sub'.', thence northeasterly along said line 800 f t.; thence northwesterly at right angles to said line 295 ft. to Eaton Rd.; thence east along Eaton Rd. to the point of beginning, containing 165 acres, more or less, Chico. SECTION 2. Regulations for an Agricultural-Suburban- ~~Residential District ("A-SR"}: The Following regulations sha11 apply to an Agricultural- ~~ Suburban-Residential District {•"A-SR"): 2 2.1 USES PERMITTED: 3; a. Single-family dwellings, not including tents or 4, mobile homes. ~, b. Accessory buildings pertinent to the permitted g~ uses . ~ 2.2 AGRICULTURAL USES, EXCEPT LIVESTOCK SUBJECT TO g THE FOLLOWING REQUIREMENTS: ~ a. For each parse or head of cattle over one (1} Zp year of age one half acre, 21,780 sq. ft. ~I b. For each head of swine over ten {la} weeks of 12 age, one half acre, 21,780 sq. ft. 33 c. For each head of sheep or goats, one quarter acre, ].4 la, 890 sq, ft. 15 2.3 LOT AREA: lg Minimum required axea of lot per dwelling unit shall be 17 not less than 8,125 sq. ft. 18 2.4 LOT WIDTH: lg Minimum lot width shall be not less than sixty-five ~Q (65) feet. 23 2.5 FRONT YARD: 22 Minimum front yard shall be fifty (5a) feet from the ~3 centerline of the road except where the road is classified by 24 the County of Butte as a Federal Aid Secondary Road, the minimum '~ building setback requirements shall be fifty-five (55) feet 26 from the centerline of said road. -2- l 2.6 SIDE YARD: 2; Minimum side yard sha11 be not less than five {5} feet. '3 SECTION 3. The following uses subject to securing a 4: Use Permit in each case: 5'! a. Public and quasi-public uses, including churches. g b. Hospitals. parks and playgrounds, schools and public 7 utility buildings. 8 SECTION 4. All uses of sand within the district not 9. specifically authorized and permitted in Sections 1 and 3 are '` 10 prohibited. 11 SECTION 5. Penalties for any violation of the zoning 12 hereby imposed within the District shall be as provided in the 13 Zoning Ordinance. .In compliance with the provisions of the 14 Zoning Enabling Ordinance, this Ordinance shall from and after 15 its effective date became a supplement to and part of the Zoning ~6 Enabling Ordinance. 17 SECTION 6. This Ordinance sha11 be and it is hereby ~$ declared to be in full force and effect from and after thirty Z9 (30) days after the date of its passage, and before the expiration 2Q of fifteen {15} days after its passage, this Ordinance shall be 21 published once with the names of the members voting for and 22 against it in the Chico'Ente_~przse_ , a newspaper published 23 in the County of Butte, State of California. 24 PASSED AND ADOPTED by the-Board of Supervisors of the ~ County of Butte, State of California, this 28th day of 28 Air ust 1973, by the following vote: w 3- 1 AYES: Supervisors Cameron, Gzlman, Ladd, Madigan and Chairman McKil op 2 NOES: None 3 ABSENT: None 4 NOT VOTING: None 5: ~ 8.
