AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE AN "AR-MH-3" (AGRICULTURAL RESIDENTIAL -
MOBILE HOME) DISTRICT
1 The Board of Supervisors of the County of Butte, State of
2 California under and pursuant to Ordinance No. 475, as amended,
3 and declaring an emergency, DO ORDAIN, as follows:
4 ~~ SECTION 1. The hereinafter described area situated in the
5 County of Butte, State of California, shall be and it is hereby
6 zoned as an "AR-MH-3" (Agricultural Residential - Mobile Home)
7, District for a period of 120 days, and such area shall be subject
8 to the restrictions and restricted uses and regulations hereinafter
9 specified and provided. Said area so zoned being located on
10 Nimshew Ridge and particularly described as:
].1 All that property located within one thousand (100)
feet on either side of:

Magalia Nimshew Road c~- from Skyway to Humbug Road
13 {1.11 miles}; Humbug Road :~ from Magalia-Nimshew
Road to Nimshew Ridge Road (0,5 miles}; Nimshew
14 Ridge Road ::.~ from Humbug -Road to end of County
maintained section of Nimshew Ridge Road (2.43 miles};

containing `~~ ~ acres, more or less.

23'. SECTION 2. REGULATIONS FOR AN "AR-MH-3" DISTRICT:
24 The following regulations sha11 apply in an "AR-MH-3"
~ istrict.

a. Single-family dwellings.. -
b. Mobile Homes - to house one family, when such Mobile
Home is the only housing facility located on the
premises, provided the following conditions are con-
formed to:
1. The gross area of the Mobile Home shall not be
less than 500 square feet.
2. All sanitary facilities shall conform to State
Statutes and regulations and to local require-
ments of the Butte ,County Health Department.
3. All electrical installations shall conform to
State Statutes and regulations as administered
by the Building Division of the Butte County
Public Works Department.
c. Accessory buildings pertinent to the permitted uses.
d. Agricultural uses.
e. Livestock, subject to requirements as follows:
1. For each horse or head of cattle aver one {1}
year of age - eight thousand, one hundred twenty-
five {8,125} square feet.
2. For each head of swine over ten (10} weeks o£ age
- eight thousand one hundred twenty-five {8,125)
square feet.
3. For each head of sheep or goats - two thousand
(2,000} square feet.

1: 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT
2 IN EACH CASE:
g a. Golf courses, country clubs, if permitted, would
4 permit accessory uses such as driving range, pro
5 shop, cocktail bar, restaurant.
g b. Public and quasi-public uses including churches,
7 firehouse, hospitals, parks and playgrounds, schools
and public utility buildings.
g c, Livestock farming.
10 d. Veterinary clinics, outpatient.
1I e, Nurseries and plant gardens.
12 2.3 LOT AREA REQUIRED: Minimum required area of a lot
i3 per dwelling unit shall be not less than, three (3)
14 acres.
15 2.4 LOT WIDTH REQUIRED: Minimum lot width shall be not
16 less- than one hundred thirty (130) feet.
~,7 2.5 FRONT YARD REQUIRED: Minimum frond yard shall be
IS fifty (50) feet from the centerline of the road,
~.9 except where the road is classified by the County as
20 a Federal Aid Secondary Road, the minimum building
21 setback requirement shall be fifty--five (55) feet
22 from the centerline of the road.
23 2.6 SIDE YARD REQUIRED: Minimum side yard shall not be
24 less than ten (10) feet.
~ SECTION 3. All uses of land within the district not
2~~pecifically authorized and permitted in Section 2 are prohibited.

1' SECTION 4. In caanpliance with the provision of said
2 Zoning Enabling Ordinance, the same is hereby amended by adding
S this Ordinance in full. -
4 SECTION 5. The penalties for the violation of the zoning
5, hereby imposed within the district shah. be as provided in the
Zoning Enabling Ordinance. 1n compliance with the provisions of
~ the Zoning Enabling Ordinance, this Ordinance sha11 from and
8 after its effective date become a supplement to and part of the
9 Zoning Enabling Ordinance.
1Q SECTION 6. This urgency ordinance shall take effect
1~ immediately upon its passage, and before the expiration of fifteen
12 (15) days after its passa e shall be

15 in general circulation in the County of Butte, State of California.
1B The facts constituting the urgency on which this Ordinance is
17 based are:

~'~ 1. To allow time for completion of the comprehensive
x9 zoning study for the area which is in progress.
20 2. This urgency ordinance is necessary to preserve the
2I public health, safety and welfare in the subject area until said
22 comprehensive zoning study and rezoning is decided on.

PASSED AND ADOPTED by the Board of Supervisors of the
~ County of Butte, State of California on the 7l~th day of
