ORDINANCE NO. ~39b
AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, AN "A-R" (AGRICULTURAL-
RESIDENTIAL) DISTRICT, AND ESTABLISHING REGULATIONS
FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS.
The Board of Supervisors of the County of Butte, State
of California, under and pursuant to Ordinance No. 475, as amended,
;being the Zoning Enabling Ordinance, DO ORDAIN as follows:
SECTION 1. The hereinafter described area situate in

the County of Butte, State of Californ~.a, shall be and it is hereby
zoned as an "A-R" (Agricultural-Residential) District and such
(area sha11 be subject to the restrictions and restricted uses and
`regulations hereinafter specified and provided. Said area so zoned
being located in the unincorporated area of Butte County, near
,Chico, California, more particularly described as follows:
A portion of Lot 37 of the Third Subdivision of the
John Bidwell Rancho accord~.ng the Official Niap
thereof on file in the office of the Recorder of
the County of Butte, State of California, and more
particularly described as follows:
BEGINNING at a point on the Northeasterly line of
said Lot 37 from which point the most Northerly
corner thereof bears N 37° 31' W, 752.03 ft.; thence
from said point of beginning and continuing along
~' the Northeasterly line of said Lot 37 and the center
of Nord Avenue S 37° 31' E 207 ft.; thence through
said Lot 37 S 52° 29' W, 306.14 ft. to an iron
pipe in the Northeasterly line of the California
and Oregon Railroad (Southern Pacific) right of way
and the Southwesterly line of said Lot 37; thence
along said line N 60° 48' W to a point that bears
S 52° 29' W from the point of beginning; thence
N 52° 29' E to the point of beginning.
Containing 1.5 acres, more or less.
SECTION 2. REGULATIONS FOR AN "ASR" DISTRICT:
The following regulations shall apply in an ="A=R"
District:
2.1 USES PERMITTED:

a, Single-family dwellings, not including tents or
trailers .
b. Accessory buildings pertinent to the permitted uses.
c. Agricultural uses.
d. Livestock, subject to requirements as follows:
~:. Minimum lot area to be devoted to residential
use shall be not less than eight thousand one
hundred twenty--five (8,125} square feet.
2. Exclusive of the area devoted to the residential
use, the following lot or parcel area shall be
required far each animal raised or kept on the
premises:
a} For each horse or head of cattle over one
{1} year of age--eight thousand one hundred
twenty-five (8,125} square feet.
b) For each head of swine over ten (10} weeks
of age--eight thousand one hundred twenty
five (8,125) square feet.
c) For each head of sheep or goats--two thou-
sand (2,000} square feet.
Z.2 THE FOLLOWING USES SUBJECT TQ SECURING A USE PERMIT
IN EACH CASE:
a. Duplex dwellings and multi--family dwellings.
b. Golf courses, country clubs, if permitted, would
permit accessory uses such as driving range, pro
shops cocktail bar, restaurant.

c. Public and quasi-public uses including churches,
fire houses, hospitals, parks and playgrounds,
schools and public utility buildings,
d. Commercial poultry farming and livestock farming.
e. Vetertinary clinics, outpatient.
f. Nurseries and plant gardens,
2.3 LOT AREA REQUIRED: Minimum required area of a lot
per dwelling unit shall not be less than eight thousand one
hundred twenty-five {8,125) square feet.
2.4 LOT WIDTH REQUIRED: Minimum lot width shall not be
less than sixty--five (65} feet.
2.5 FRONT YARD REQUIRED: Minimum front yard shall be
fifty (5Q} feet from the centerline of the road, except where the
road is classified by the County as a Federal Aid Secondary Road,;
the minimum building setback requirement shall be Fifty-five (55}
feet from the centerline of the road.
2.6 SIDE YARD REQUIREMENT: Minimum side yard shall not
be less than five {5} feet,
SECTION 3. All uses of land within the district not
specifically authorized and permitted in Section 2 are prohibited
SECTION 4. In compliance with the provisions of the
Zoning Enabling Ordinance the same is hereby amended by adding
this ordinance in full,
SECTION 5. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in the
Zoning Enabling Ordinance.

1 SECTION 6. This ordinance shall be and it is hereby
2 declared to be in full force from and after thirty (30) days after
3 `the date of its passage and before the expiration of fifteen (J 5}
4 days after its passage this ordinance shall be published once with
6 the names of the members of the Board voting for and against it in
g the Chico Ender rise Record a newspaper published in the
7 County of Butte, State of California.
8 PASSED AND ADOPTED by the Board of Supervisors of the
~ County of Butte, State of California this ~-~-tsh day of
