AN ORDINANCE ADDING SECTION 13A TO ORDINANCE 475,
E5TABLISHZNG CONDITIONAL USE PERMIT PROCEDURES FOR
CERTAIN HOMES PURSUANT TO WELFARE AND INSTITUTION
CODE SECTION 51.16
The Board of Supervisors of the County of Butte DO ORDAIN
3s follows:
SECTION 1. That Section l3A is hereby added to Ordinance
475 to read as follows:
Section 13A. Tt shall be unlawful to operate or maintain
any state-authorized, certified, or licensed family care home,
foster home or group home serving six or fewer mentally disordered
or otherwise handicapped persons or dependent or neglected children
after October 11 1973, unles a conditional use permit is
obtained as provided in this ordinance. Pursuant to the provisions

of Welfare and institutions Code Section 5116 and notra~thstanding
any provision to the contrary in any zone established as an
amendment to Ordinance 475, a conditional use permit shall be
required for the operation or maintenance of any such family care
home, foster home or group home serving six or fewer mentally
disordered or otherwise handicapped persons or dependent or
neglected children. Such homes shall be a permitted use in all
residential zones including, but not limited to residential zones
for single family dwellings, and that therefore no conditions shall
be imposed upon such homes which are more restrictive than those
imposed on other similar dwellings in the same zone unless such
additional conditions are necessary to protect the health and
safety of the residents or said homes.
The conditional use permits referred_ to herein shall be
applied for, noticed and granted pursuant to the procedures relat-

ing to use permits as provided for iri`Section l3 of Ordinance
475, as amended. Provided, however, that no application fee
shall be required for those out-of-hoarse care facilities providing
care and control for six or fewer children who are under twenty-
one years of age, whose placement in said facility is supervised
by the Butte County Juvenile (Probation) Department or the Butte
County Department of Social. Welfare and whose cost-of-care paymen
do not exceed the regular allowance for dependent children as
provided for by resolution or ordinance adopted by the Board of
Supervisors of the County of Butte.
SECTION 2. This ordinance sha11 take effect thirty (30}
days after the date of its adoption, and before the expiration of
fifteen (15) days after its passage, it shall. be published with
the names of the members voting for and against the same, in the
Oroville Merct~~ a newspaper published in the
County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte this ~ 11th _ day of September 1973•
