ORDINANCE NO. 475, AS AMENDED

The Board of Supervisors of the County of Butte, State of
California, under and pursuant to Ordinance No. 475, as amended,
and declaring an emergency, DO ORDAIN as follows:
SECTION l . The hereinafter described area situate in :the
County of Butte, State of California, sha11 be and it is hereby
zoned as an "A-3" {Agricultural) District, for a period of 120
days, and such area sha11 be subject to the restrictions and re-
~stricted uses and regulations hereinafter specified and provided.
Said area so zaned being located in the unincorporated area of
~'Bitte County, California, west of Chico, more particularly des-
:. ,
!crbed as follows:
Beginning at the NW corner of Lot 9 of "Morehead
Ranch Sub No, 1" as recorded in map of record in
Book 9, Page 14, also being on the south right-of-
way line of Oak Park Ave.; thence east along the
north line of said Lot 9, 300 ft.; thence south,
parallel to the west line of said Lot 9 to the south.
line of said Lot 9, also being the north line of Lot
12 of said subdivision; thence east to the NE corner
of said Lot 12; thence south along the east line of
said Lot 12 and its southerly prolongation to the NE
corner of Lot 19 of said sub.; thence continuing
south along the east line of said Lot 19, 286.94 ft.;
thence east, parallel to the north line of Lot 19,
423.18 ft. to the east line of Lot 20 of said sub-
division; thence southerly along the easterly line
and southerly prolongation to its intersection with
the south r~.ght~-of-way line of Chico River Road;
thence westerly along said right-of -way line to the
NW corner of Lot 1 of the "Mary E. O`Conna~ Sub."
as recorded in map of record in Book 8, Page 19 in
the Office of the Butte~County Recorder; thence north
along the northerly prolongation of Lots the west
line 1, 2, 3, 4, 5, 6, and 7 of said Sub., also
being the east right-of-way line of Chico River Road,
to the south line of Lot 54 of "Morehead Ranch Sub.
No. 2" as recorded in map of record in Book 10, pages
1 8 & 9; thence west along the south line of Lots 52,
53 & 54 of said Sub, to the SW carnet of said Lot
2 52; thence north along the west line and its northerly
porlongation to the south line of Lots 4~ and ~l
3 of said sub., also being the north right-of-way line
of Santa Clara Ave., thence west along said lot line
4 to the SW corner of said Lot 4l; thence north along
the west line of Lots 34 and 41 of said Sub . to the
5: NW corner of said Lot 34, also being on-~the south
right-of-way line of Oak Park Ave.; thence east
8 along said right-of -way line to the point of begin-
- Wing. Containing 235 acres, more or less.

8 SECTION 2 , REGULATIONS ~'OR AN "A-3" DISTRICT: The
9 following regulations shall apply in an "A-3" District:
10 2.l USES PERMITTED:
II a. Single-family dwellings
12 b. General farming, horticulture, commercial livestock,
13 poultry production, warehousing and storage.
I4 c. Accessary buildings and uses pertinent to the
15, permitted uses, including agricultural processing
16 plants .
17 d. Housing facilities (.including mobile homes) to
18 accomodate only agricultural employees and their
19 families employed b_y the owner or operator of the
2U premises; and provided further that such housing
2I facility shall be considered accessory to the main
22 building and sha11 conform to the provision per-
23
taming to required yard and open space for dwellings.

e. Mobile homes to house one family when such mobile
~ home is the only housing facility located on the
26
premises, provided the following conditions are con-

formed to :
1. The floor area within the mobile home sha11 not
be less than five hundred (500) square feet.,
2. The parcel of land conforms to Section 2.3 (Mini-
mum lot area of 5 acres), or is a smaller parcel
of land lawfully cre ated prior to the enactment
of the Ordinance, subject to written approval
by the Director of Planning,
2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT
IN EACH CASE:
a. Golf courses and country clubs.
b. Public or quasi..public uses including churches, fire
houses, hospitals and clinics, parks and playgrounds,
schools, public utility buildings and professional
buildings,
2.3 MINIMUM LOT AREA REQUIRED:
Minimum lot area shall not be less than five (5) acres
2.4 FRONT YARD REQUIRED:
Minimum front yard shall be fifty (50) feet from the
centerline of the road, except where the road is ',

classified by the County as a Federal Aid Secondary
Road and the minimum building setback requirement
shall be fifty-five (5 S) feet from the centerline
of the road .
2 , 5 SIDE YARD REQUIRED
Minimum side yard shall not be Less than five (5} feet

1 SECTION 3. A11 uses of land not specifically authorized
2 and permitted under Section 2 are prohibited wi thin the district;
3 SECTION 4. The penalties for the violation of the zoning
4 hereby imposed within the district shall be as provided in Section
S 15 of Ordinance No. 47~ , Zn compliance with the provisions of the
8 Zoning Enabling Ordinance, this ordinance shall from and after
7 its effective date become a supplement to and part of the Zoning
8 Enabling Ordinance.
9 SECTION 5, This urgency ordinance sha11 take effect imp-
10 mediately upon its passage, and before the expiration of fifteen
31 {1S) days after its passage shall be published once with the names
l~ of all members voting for and aga~.nst the same in the Chico
33 Er~te z~x' ' s a newspaper in general circulation in the
34 County `of Butte, State of California. The-facts constituting
15 the uL~ency on which this ord~.nance is based are:
16 1. To a11ow time for completion of a comprehensive
37 zoning study for the west Chico area.
18 PASSED AND ADOPTED by the Board of Supervisors of the
39 County of Butte, State of California, on the 18th day of Sep-
20 tember, 1973, by the following vote:
23 AYES: Supervisors Cameron, Gilman, Ladd, Madigan and Chairman McK
22 NOES None
23 ABSENT: None
