The hereinafter described area situated in .the County of Butte, State of California, sha11 be and it is hereby zoned an "AR-MH" (Agricultural Residential-Mobile Home} District for a period of 120 days, and such area shall be sub- ject to the restrictions and restricted uses and regulations. hereinafter specified and provided. Said area so zoned being Located east~of` Ora~il~:e and described as: Ali of Lots 173, 174, ....3.7;~ & 178 of"Oroville 4+Tyan- dotte Fruitlands.Unit No ..5:', per map filed in the Office of Butte County Recorder, in Map Book 8 on Page 37A, containing 75 acres, more or less. SECTION 2. REGULATIDNS FOR AN "AR MH" DISTRICT: The following regulations shall apply in an "AR-MH" District: 2.1 USES PERMITTED: a. Single-family dwellings. b. Mobile Homes - to house one family, when such mobile home is the only housing facility located on the premises, provided the following conditions are conformed to: ~.} The gross, area of, the. mobile home sha11 not be less than 5~a square feet. 2) All sanitary facilities shall conform to State 1 Statutes and regulations and to local require - 2 menu of the Butte County Health Department. 3 3) A11 electrical installations shall conform to ¢ State Statutes and regulations as administered 6 by the Building D~.vision of the Butte County g Public Warks Department. 7 c. Accessory buildings pertinent to the permitted uses. 8 d. Agricultural uses. 9 e. Livestock, subject to requirements as follows: 10 1) Minimum lot .area to be devoted to residential II use sha11 be not less than eight thousand, 12 one hundred twenty five- (8,125) square feet. 13 2) Exclusive of the area devoted to the residential 14 use, the. following lot or parcel areas shall be 15 required for each animal. raised or kept on the 16 premises: 1.7 a) For each horse or head of cattle aver one 18 ; _ -.(:1}-year of age - eight thousand one hundred 19 twenty-five (8,125) square feet. 2U b) Far each head of swine over ten (10) weeks 2I of age - eight thousand, one hundred twenty-- 22 five (8,125) square feet. 23 ~ c) For each head of sheep or goats - two 24 ~ .. .thousand (2,000) square. feet.: ~. '~ 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 2B IN EACH CASE: -2 - ~,'~ a. Duplex dwellings and multiple-family dwellings. 2 b. Golf courses, country clubs, if permitted, would 3 permit accessory uses such as driving range, pro 4 shop, cocktail bar, restaurant. ~ c. Public and quasi--public uses including churches, 6 firehouses, hospita~.s, parks and playgrounds, q schools and public utility buildings. g d. Commercial poultry farming and livestock farming. 9 e. Veterinary clinics, outpatient. lp f. Nurseries and plant gardens. Il 2.3 LOT AREA REQUIRED; Minimum required area of lot per Z2 dwelling unit shall. be not less than eight thousand, one hundred 13 twenty-five (8,125) square feet. ~.4 2.4 LOT WIDTH REQUIRED: Minimum lot width shall be not 15 less than sixty--five ( 6S ) feet . 16 2.5 FRONT YARD REQUIRED; Minimum front yard shall be 17 fifty (5Q) feet from the centerline of the road, except where 18 ;the road is classified by the County as a Federal Aid Secondary l9 Road, the minimum building setback requirement shall be fifty -five 20 (55) feet from the centerline of the road. 21 2.6 SIDE YARD REQUIRED: Minimum side yard shall be not ~~ less than five (5} feet. 2~ SECTION 3. All U5e5 of land within the district not 24 specifically authorized and permitted in Section;~~ 2 are prohibited ~ SECTION 4. In compliance with the provisions of said 28 Zoning Enabling Ordinance, the same is hereby amended by adding -3- 1 this Ordinance in full. 2 SECTION 5. The penalties for the violation of the zoning 3 hereby impaled within the district shall be as provided in the 4 Zoning Enabling Ordinance. In compliance with the provisions of b `the Zoning Enabling Ordinance, this Ordinance shall from and 6 after its effective date become a supplement to and part of the 7 Zoning Enabling Ordinance. 8 SECTION 5. This urgency ordinance shall take effect 9 immediately upon its passage, and before the expiration of fifteen 10 (15) days after its passage shall be published once with the lZ .names of all members of the Board of Supervisors voting for and 12 :against the same in the proville Mercury ____, a newspaper 13 in general circulation in the County of Butte, State of Califor- 14 nia. The f acts constituting the urgency on which this Ordinance 15 ,is based are: 1B 1. A petition for permanent rezoning will soon be con- 17 sidered by the Planning Commission. 18 2.
