Resolution No. 14-0179
A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISOR'S
CERTIFYING THAT IT FIRS REVIEWED AND CONSIDERED
A NEGATIVE DECLARATION
PREPARED BY THE CALIFORNIA WATER SERVICE COMPANY FOR
THE REDIRECTEDC TRACT PG&E WATER FROM THE MIOCENE CANAL TO THE TEIER ALITO POWERS CANAL
AND AUTHORIZING CLERIC OF THE BOARD TO FILE
NOTICEOF DETERMINATION
WHEREAS, the Board of Supervisors has considered entering into a water conveyance agreement with California
Water Service Company and the Department of Water Resources of the State of California for the Delivery of PG&E
Water in accordance with the terms of the County of Butte's State Water Project(S'A'P) Water Supply Contract; and
WHEREAS, County of Butte, acting as lead agency, determined it was appropriate to prepare a Negative
Declaration for the Redirected Contract PG&E Water from the Miocene Canal to the Thermallito Powers Canal; and
WHEREAS, the Board of Supervisors, as the lead agency, consulted with California Water Service during the
environmental review process; and
WHEREAS, the Board of Supervisors has reviewed and considered the Negative Declaration for the Redirected
Contract PGE later from the (Miocene Canal to the Thermalito Powers Canal in accordance with the California
Environmental Quality Act; and
WHEREAS, the Negative Declaration does not identify any significant impacts within the jurisdiction of the Board
of Supervisors as supported by the following:
No new construction or improvements by Butte County, California 'Nater Service Company or
the California Department of later Resources would occur with the proposed project;
0 California 'mater Service Company will continue to meet its contractual obligations to its existing
rural irrigation customers along the Lower Miocene Canal;
a California later Service Company will continue to provide sufficient carrier water to
accommodate seepage, water loss due to leafage and evaporation to meet these contractual
obligations;
a The delivery of the PG&E water from the Miocene Carnal to the Thermalito Powers Canal would
occur within the operating conditions of the State Water Project as determined by current
licenses, permits, regulatory constraints, interim remedial actions and all applicable Biological
Opinions and would therefore have no impacts upon the environment that would require
mitigation; and
WHEREAS, a duly noticed public hearing on the Redirected Contract PGE 'Fater from the Miocene Canal
through State later Project facilities (Lake Droville to the Thermalito Powers Canal) was held before the Board of
Supervisors on June 24,, 2014; and
WHEREAS, the Board of Supervisors has considered the staff report and recommendation of the Butte County
Department of Water and Resource Conservation and the Butte County Department of Development Services, Planning
Division, and public comments.
NOW,THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors takes the following actions:
1. Certifies that it has reviewed and considered the Negative Declaration for the Redirected Contract PG&E Water
from the Miocene Canal to,the Thermalito Powers Canal,
2. Finds the Negative Declaration to be adequate for the purpose of entering into conveyance agreements with the
California Water Service Company and the California Department of Water Resources.
3. Finds that there are no significant impacts within the jurisdiction of the Board of Supervisors identified in the
Negative Declaration.
4. Finds that there is no need for the Board of Supervisors to mitigate any potential impacts.
S. Authorizes the Clerk of the Board to prepare and file a Notice of Determination.
6. The custodian of the record is the Butte County Department of Water and Resource Conservation. The location
of the record is 308 Nelson Avenue, Oroville CA 95965.

AYES: Supervisors Connelly,Wahl, Kirk, Lambert and Chair Teeter
