HomeMy WebLinkAbout14-094 V l L Resolution No, 14-094 A RESOLUTION F THE BUTTE COUNTY BOARDCIS' SUPERVISORS ADOPTING A MITIGATEDNEGATIVE DECLARATION FOR U TTE COUNTY SUPPLEMENTAL JAIL FACILITY PROJECT, FOR WHICH AN INITIAL STUDY WAS PREPARED IIS ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the original Butte County .fail was constructed in 1964; and WHEREAS, the current Jail facility no longer meets the operational needs of Butte County, and. WHEREAS, this facility is outdated and inefficient due to its linear design; and WHEREAS, In 2013, the Sheriffs Office commissioned a facility related Needs Assessment which identified shortcomings of the existing main jail facility and recommended the construction of a supplemental jail facility; and WHEREAS,S, passage of the Assembly bill 109 program in 2011 has added additional inmates into the already crowded Butte County Correctional System; and WHEREAS, the Senate Bill 14122 program has been established to provide counties a funding source to update facilities; and WHEREAS, Brute. County is the lead agency for the Butte County Supplemental :Tail. Facility Project per the California.Environmental Quality Act(CE A); and WHEREAS, the Board of Supervisors has considered an Initial Study and Mitigated Negative Declaration in accordance with the CEA For the Butte County Supplemental Jail Facility Project; and. WHEREAS, a duly noticed public hearing was held on.July 29, 2014; and. WHEREAS, the Board of Supervisors has considered all. public comments received.. ]SOW, ,rHEREFORE, BE IT RESOLVED, by the hoard of Supervisors of the County of Butte, State of California, as follows: I. The proposed Supplemental Jail Facility entails a relatively minor construction project, that when operating, will accommodate about a ten percent (10%) increase to the current average County Jail population and staff, 1 Construction and operation of the proposed Supplemental Jail Facility will have no impact upon agricultural or mineral resources; 1 Construction and operation of the proposed Supplemental Jail Facility will have a less than significant impact upon biological resources, geology and soils (geologic hazards), land use, population and housing, public services, recreation, transportation/traffic, and utilities and services; 4. Construction and operation of the proposed Supplemental Jail Facility will have a less than significant impact with mitigation incorporated for aesthetics/visual resources (night-time glare), air quality (fugitive dust and diesel emissions), hydrology and water quality (storm-water runoff and adequate drainage) and noise (construction noise). BE IT FURTHER RESOLVED that the Butte County Board of Supervisors hereby adopts the Mitigated Negative Declaration and seven mitigation measures: Mitigation Measure #1 - Aesthetics (Minimize Off-Site Glare from Exterior Lighting); Mitigation Measure 42 - Air Quality (Ensure Adequate Dust Control); Mitigation Measure #3 - Air Quality (Minimize Combustion Emissions from Heavy-Duty Construction Equipment) Mitigation Measure #4—Cultural Resources (Protection of Cultural Resources Found During Work); Mitigation Measure #5 — Hydrology/Water Quality (Prepare Low Impact Development Plan to Manage Post-Construction Stormwater Runoff); Mitigation Measure #6— Hydrology/Water Quality (Redesign Drainage Conveyance as may be Necessary); and Mitigation Measure 47—Noise (Limit Work to Daytime Hours and Provide Best Available Noise Suppression). BE IT FUTU'HER RESOLVED that the Butte County Board of Supervisors approves filing of an application for funding to construct the proposed Supplemental Jail Facility at such time as an application process for said funding becomes available. PASSED AND ADOPTED by the Butte County Board of Supervisors on this 29th day of July, 2014 by the following vote.
